SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated March 9, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP)Policy Standards.The LWRP Coordinator issued a recommendation dated June 16,2022.Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is ViCONSISTENT with the LWRP policy standards and is therefore INCONSISTENT with Policy 1. The as-built conversion of the existing accessory garage to two (2) recreation rooms is inconsistent with this policy as is the installation of a sanitary system and bathroom facilities. Building structures without property reviews erodes community character and circumvents the codes and regulations in place that protect, health, safety, and the environment. PROPERTY FACTS/DESCRIPTION: The subject property is a 22,995 square foot nonconforming parcel located in the Residential R-40 Zoning District. The northerly property line measures 135.69 feet and is adjacent to Richmond Creek, the easterly property line measures 312.94 feet, the southerly property line measures 76.86 feet and is adjacent to a 20 foot Right of Way and the westerly property line measures 293.81 feet. The parcel is improved with a one-story frame dwelling with wood deck and stairs attached to the rear of the dwelling. There is a stone path walkway that leads to a wood deck on the westerly side of the residence with a long composite ramp that leads to a wood floating dock. There is a 23.2 ft. by 14.3 ft. frame building south of the dwelling and north of the gravel driveway. The accessory structure is located south of the driveway and is 22.4 ft. by 34.2 ft. with three(3) doors, one large glass door to the north, a regular entry door on the west side and another entry door on the east side of the structure. There is an outdoor shower on a small deck on the easterly side of the accessory structure. The property has deer fencing on both the east and west sides up to the frame building south of the dwelling and along the front and up to the frame building on both sides. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-13C; and the Building Inspector's January 4, 2022 Notice of Disapproval based on an application for a permit to legalize an as-built conversion of an existing accessory garage to two (2 recreation rooms; at 1) not a permitted accessory use; located at: 625 Wood Lane, (Adj. to Richmond Creek)Peconic,NY. SCTM#1000-86-6-7. RELIEF REQUESTED: The applicant requests variances to legalize an as-built conversion of an existing garage to (2) recreations rooms at 625 Wood Lane, Peconic, NY. SCTM#1000.86-6-7. The as-built construction, on this nonconforming 22,995 square foot lot in the Residential R-40 Zoning District is not permitted pursuant to Article III, Section-13C. Recreation spaces in accessory building is not a permitted accessory use. ADDITIONAL INFORMATION/BACKGROUND: The applicant was issued a Building Permit#43202 on November 17, 2018 to construct a non-habitable accessory garage. The plans received by the Building Department for the accessory garage were prepared by James DeLuca, Architect, dated August 16, 2018 and show rooms identified as "garage space, storage space, and a closet". A Certificate of Occupancy was requested in August 2021, but was denied by the Building Inspector because the improvements exceeded the building pen-nit that was issued for non-habitable garage and storage space. At the public hearing the applicant's agent informed the Board that the plans approved by the Building Department for the accessory structure's building permit included notations that the interior would be finished with radiant heat,tiled floors, board and batten wood finishes, a cathedral ceiling finished with cedar and rooms labeled recreation space. Additional plumbing for a powder room was added during construction. The Zoning Board inspected the property before the July 7, 2022 public hearing and found no garage or recreation room/space, but were able to see from the outside two furnished rooms that were being used for sleeping. Air conditioning and pull-down stairs leading to the upper area have been installed in the structure. A neighbor testified that she had witnessed people wearing bathrobes leaving the accessory structure in the morning and walking to the residence. The Accessory Garage Plans received by the Office of the Board of Appeals (two original copies signed and sealed by James DeLuca, Architect, (Sheets A 1 & A2) last revised February 16, 2022 show recreation space, a powder room, and storage space. There is also a proposed storage space in the attic. The Members of the Board of Appeals did not receive the same set of plans in their individual packets but rather plans stamped "Disapproval" "Received September 20, 2021, Building Department, Town of Southold." These plans were prepared by James De Luca, Architect, labeled last revised "As Built Conditions" dated 12-24-19 include sheets C 1 Plot Plan with a list of Notations, A 1 Elevations and Building Section, and A2 floor plans. On the plot plan there is a marginal notation pointing to a"proposed one story rec space&garage structure."On sheet Al the elevations are labeled Garage(although no overhead garage door is proposed),and the building section labeled Storage Space and there is a small type notation under this label "tile floor finish over elect radiant heating(htg)material(mat.)" Finally on the floor plan labeled Garage Plan on Sheet A2,the two labels printed as storage space and garage space have been crossed out and replaced with handwritten labels noted as "recreation room"and"recreation space."A handwritten note says pre-finished wood flooring.There are also small printed notations saying "board and batten interior finish" and a split heating and air conditioning unit is shown. Based upon these revised plans, the Building Department issued a Notice of Disapproval originally dated September 24, 2021 and RENEWED January 4, 2022 to "legalize an as built conversion of an existing accessory garage to two recreation rooms"which was disapproved pursuant to Article III, Section 280-13 (C) which states that"Recreation spaces in an accessory building is not a permitted accessory use." Page 3, July 21,2022 #7651, Burke SCTM No. 1000-86-6-7 The Architectural Plans obtained and stamped approved by the Building Permits Examiner on November 7, 2018, reveals the following: • C1 - Title Page last revised September 5, 2018 plot plan indicates a rec space. • Al - Elevations last revised September 5, 2018—no indication of rec space. • A2—Floor Plans last revised August 16,2018 shows garage space and storage space with closet with no indication of rec space. Based upon these revised and inconsistent architectural plans, and personal inspection by the Members of the Board,the Board concludes that the Notice of Disapproval dated renewed January 4,2022 was correctly issued FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 7, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1.Town Law 267-b(3)(b)(1). Grant of the requested variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Town Code does not allow for recreation spaces in an accessory building; i.e., not a permitted accessory use, and the granting of this proposed use variance would set a precedent that would undermine town code. The Town Code has allowed the Board of Appeals to approve the conversion of existing accessory garages to accessory apartments and pool houses for applicants that qualify according to Special Exception Standards through proper application to the Zoning Board of Appeals. 2. Town Law&267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method,feasible for the applicant to pursue, other than an area variance. The applicant can include recreational space in their existing dwelling or they can make an addition to their dwelling for this permitted use in a principal dwelling. 3. Town Law 4267-b(3)(b)(3). The variance requested herein is mathematically substantial, representing 100% relief from the code. Additionally, the applicant converted the as built accessory garage into habitable sleeping/living space with a half bathroom without a proper building pen-nit. 4. Town Law §267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Habitable space in accessory structures require eligible applicants (homeowners whose dwelling is their principal residence) to request and obtain a Special Exception permit from the Board of Appeals for an accessory apartment in an accessory structure to be rented to a relative or individual on or eligible for the Town's Affordable Housing Registry. The Town Code does not permit home offices, sleeping space or recreation space in accessory structures. A half bath is permitted in an accessory garage. 5. Town Law X267-b(3)(b)(5). The difficulty has/ been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is not the minimum action necessary and adequate (to enable the applicant to enjoy the benefit of a recreations space while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. An undesirable change will not be produced in the character neighborhood or a detriment to nearby properties if granted because: This neighborhood has many accessory structures that are being utilized in a variety of ways including accessory apartments and several nearby properties have two residences.The owner does not intend to increase the occupancy or the traffic on the property beyond its current use which is for their family alone. The owner intends to use.the accessory structure for storage. The existing residence is a modest one story 1324 sq.ft. house situated close to Richmond Creek on a lot that is 76.86 wide. All components of the accessory structure including property line setbacks, height and size limitations and lot coverage met the requirements for the issuance of a building permit and were not seen to cause an undesirable change in the neighborhood. 2. The benefit sought by the applicant cannot be achieved by some other method feasible for the applicant to pursue, other than an area variance because: The original permit was issued for plans submitted Sept. 12, 2018 for an accessory structure including an area designated "Recreation Space" on the Site Plan and on the Application for the Building permit. The permit included, as clearly noted on the plans, that the interior of the accessory structure would be finished with radiant heat under tiled floors, board and batten wall finish, a cathedral ceiling finished with painted cedar, as well as trimmed, high quality doors and windows. The applicant was not informed at the time that the permit was issued that the duly noted "degree of finish" would prevent the issuance of a CO at the conclusion of the project. Irl order to remove the heat and air conditioning, flooring, wall finish, ceiling finish and trim and to replace the existing quality doors and windows with lesser substitutes would be a substantial financial burden. The alleged hardship relating to this property is quite unique because there are more than a dozen other properties in the neighborhood with large accessory structures that appear to not be used for parking vehicles. Several adjacent properties have two residences. How can we judge the "degree of finish" inside those structures? The owners are willing to compromise in any reasonable way to meet the requirements of the Building Department and the Board of Appeals including applying to make the structure an accessory apartment. However, one of the requirements for the application for an accessory apartment is a`--valid rld they cannot move forward without it. FE13 . 3. The amount of relief requested is not substantial because: All other aspects of the accessory structure meet the,requirQ ' n regulations set forth by the Town of Southold. 4. The variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The relief requested is for a duly permitted and inspected structure that is not unlike others in the neighborhood and it is the intention of the owners to maintain the high standards they have set on their property for the protection of the current conditions of the neighborhood. These high standards include modest structures and privacy screening as well as family oriented enjoyment of the property. 5. Has the alleged difficulty been self-created? (a)The permit was issued for an application that included plans that had clear notations on "degree of finish" leading to the assumption that the plans were within the parameters of the issuance of a CO. (b) The new septic system was approved and inspected by Suffolk County leading to the expectation that the addition of a powder room to the plans was not a problem. The additional plumbing was also inspected and approved by the Town of Southold Building Inspector-John Jarski on 2.25.19 (c) The conversion of the smaller garage area to a storage area was not noted as problematic when it was duly inspected by Southold Town Building Inspector John Jarski on 12.6.18 wherein he noted that the foundations were OK to backfill. (d)All inspections were performed as required and at no time was it mentioned that the revisions to the plans would prevent the issuance of a CO. The property is nonconforming with a total area of 22,738.32 sq. ft. and lot width (frontage) along the roadway of 76.86 feet. The parcel is improved with a single-family dwelling with an existing setback 21 feet from the northwesterly corner of the dwelling to the bulkhead and 37+- feet from the northeasterly corner of the dwelling, at the closest points. BASIS OF APPLICATION: Building Inspector's March 17, 1999 Notice of Disapproval citing Section 100-239.48 with respect to a setback reduction at the northwesterly corner from 217"(existing) to 14+- feet, at its closest point from the bulkhead, and at 11+- feet at the northeasterly corner, of the proposed deck addition. AREA VARIANCE RELIEF REQUESTED: Applicant is requesting an open, unroofed deck at the north end of the dwelling, having dimensions of: 11 ft. at one end and 24 feet at the opposite end, to a maximum width of 24'6". The proposed setbacks are: (a) 11 ft. from the bulkhead to the deck steps at the northeasterly comer; (b) 21'7"+- from the bulkhead to the deck steps at the northwesterly corner. No encroachment into the side yards is proposed for the deck addition. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board, and personal inspection, the Board makes the following findings: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because applicant's proposed deck will be open and unroofed and will not be enclosed. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the dwelling has been in its nonconforming location for more than 40 years. They need to apply to ZBA for that and Mike Leigey was going to get back to me on what the owner wanted to do. The ZBA will not accept an application for an.accessory apartment in an accessory building without a CO, but we can't issue.a CO for this garage. They will either have to rip all finishes.out, and we can then CO it out as a true accessory garage (which I doubt they want to do) or they will have to apply to the ZBA as an as-built recreation room or whatever they want to call it at this stage (John said there was no kitchen when he was last there). It was inspected - I have images of the inspection tickets. The first inspection appears to have been done 12.6.18 and the last one 6.26.19. There are six of them in all. John did most of them. The permit number on the tickets is 43202. The architect(Jim DeLucca 631-553-3155) and the contractor(Mike Liegey 631-897-7318) both claim that revised plans were submitted that show the final configuration of the structure. According to the owners the area where the car was to be parked has been eliminated and they would like the entire building to be considered an accessory apartment for the use of the family. I would like your help in determining what I need to do to start the process to obtain a CO for this structure and then an application to the Zoning Board. Is there still a valid permit on file? Do I need to re-apply? Do you have drawings that reflect the current revisions?
