SAWICKI ~ T N U T E S SPECIAL MEETING JULY 25, 1985 A Special Meeting of the Southold Town Board of Appeals was held on Thursday, July 25, 1985 at 7:30 p.m. at the Southold Town Hall, Main Road, Southold, New York. Present were: Gerard P. Goehringer, Chairman; Serge Doyen, Jr.; Robert J. Douglass. Absent were: Charles Grigonis, Jr. and Joseph H. Sawicki. Also present was Robert W. Tasker, Esq. The board members were requested to meet tonight to discuss several areas of the Master Plan revisions as proposed. The board members expressed their concerns about the importance of retaining Special Exceptions with the Zoning Board of Appeals, and the Planning Board reviewing the same project under the "Site Plan" regulations. Other areas of the Master Plan were discussed The Town Attorney advised the board that the Zoning and Planning Boards should have been invited to each of the .Master Plan review sessions, which have been held on Tuesdays and Thursdays, from 2 5 PENDING COMPLIANCE: Appeal No. 3184 - PETER AND P~TRICIA LENZ. The subject variance was conditionally granted on April 19, 1984, and to date, no compliance has been made or any attempts in good faith. In researching this matter, it was found that on September 30, 1983, an application was made to the Building Department for a Pre-C/O by E. On October 25~ 1983 an application was made for a pre-CiO to the Building Departm__ent by [u~.D_d~s_%edt & Foy'~egard]~_ng th_e~_ premises. Dur,ing October 1982~ a~Notice Q]~_vD~.isa])prova] was issued by the Building Department indicating that the p__ropose~d subdivision required Planning Board approval and Z~B~'A. app~ov~l on the insuffi- cient lot width~ and for 280~A access appn~ov~al_,. ~t has recently~_ been found that .a PreyC~O was issued'by.~._the Build~-ng Department. on December 23~, 1983 under #Z12159~ home~gr~ the Z,B.A. ap.plicat~on was pending at thi's time, ian.d a condi~tional apprQval was later rendered on April 19~. I wrote to you on July 18~ 1985 asking that you giye the matter with the conditions Imposed on the grant of the variance and approval of access to your property immediate attention and also advised you that if you do not intend to comply, the board will have no oi~'her alternative but to set this matter down for a new hearing to revoke the variance and access pr'ewiously granted. I am advised by our town attorney that he di~'scussed this matter with your attorney~ Abigail Wickham, and that he also discussed th~s m~tter with you on_ the telephone, and that you indicated to him that you had no intention with not complying with the conditions imposed. I again ask you to advise thi~s~board within the next 10 days whether or not you intent to comply with the conditions. If no response is received from you within said period, the 'board will proceed to set this matter down-' for a new hearing to consider the question os revoking the variance and approval of access previously granted Vote of t-he Board: Ayes: Messrs. Goehringer, Doy~, and Douglass~ (Absent were: Members'Grigonis and Sawicki.)~ This resolution was adopted ~by unanimous vote of a quorum of the members present. Southold Town Board of Appeals -3- July'25, 1985 Regular Meeting INCDMPLETE VARIANCE: In reviewing the application and forms left With the Building Department recently, it was noted that several items were missing, and the documents as submitted could not be accepted for filing. The Chai~rman?indicated that a letter would be sent to Dr. Damianos requesti?g the following additionally: (~) the three copies of the application has not been notarized; (b) the original Notice to Adjacent Property Owners form has not been completed~ signed and notarized on the reverse sides for three adjoining ~roper'ty owners; (c) the adjacen¥owner t~-the north has not been notified as required by Section 100-125 [1000~86~01-01; (d) four copies of a su~y or sit~ plan showing the area of the festival in.question together with a ~showing of the entire parcel, and showing any proposed fences~ egress~ ingress, parking areas~ tents~ sanitary facilities available to the public, and all information concerning personnel for the affair; (e) $75~00 filing f~e pasable to the Southold Town Cler.k. The Chairman also indicated that if the Damianos papers were filed and complete by August 8~ 1985~ there was a great possi, b~ility this matter would be placed on our August 22nd calendar ~or public hearing. There being no other business properly coming before the board at this time~, the Chairman declared the meeti.ng adjourned. The meeting adjourned at 10:15 p.m. Respectfully submitted, .
