of Suffolk and State of New York, being more particularly bounded and described as set forth on Schedule A
hereto.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part by deed,dated January
29, 1982 and recorded in the Office of the Suffolk County Clerk on March 5, 1982 in Liber 9151 page 25.
SUBJECT TO covenants,restrictions and easement rights as set forth on Schedule A hereto.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part,the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever,except as aforesaid. .
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the parry of the first
partwill receive the consideration forthis conveyance and will hold the right to receive such consideration as a trust

ALL that certain plot, piece or parcel of land, situate, lying and being at Fishers Island, in
the Town of Southold, County of Suffolk, and State of New York, being more particularly
bounded and described as follows:
BEGINNING at a point on the northerly side of Old Mallory Road where the same is
intersected by the westerly boundary line of land now orformerly of Christian Dietrich, said
point being located 211.06 feet North of a point which is 552.86 feet East of a monument
marking the United States Coast and Geodetic Survey Triangulation Station "NIN";
RUNNING THENCE from said point or place of beginning along said last mentioned land,
the following five (5) courses and distances:
1. Northwesterly and northerly along the arc of a curve bearing to the right having
a radius of 17.00 feet, a distance of 15.60 feet;
2. North 31 degrees 19 minutes 30 seconds East, 42.64 feet,
3. North 35 degrees 14 minutes 00 seconds East, 132.14 feet;

feet, a distance of 173.28 feet to the point or place of BEGINNING.
SUBJECT TO the following covenants, restrictions and easement rights which shall be
appurtenant to and for the benefit of other premises of the party of the first part adjoining
the above-described premises on the west (SCTM No. 1000-007.00-06.00-007.000,
hereinafter the "Benefitted Premises"), which said covenants, restrictions and easement
rights shall run with the land and inure to the benefit of and be binding upon and
enforceable by the party of the first part and the party of the second part and their
respective distributees, personal representatives, successors and assigns who may at any
time have an interest in the Benefitted Premises or the premises conveyed hereby.
1. No building or other structure and no portion of any sanitary system shall be erected
or installed in that portion of the premises conveyed hereby which is bounded and
described as set forth at the end of this Schedule A (the "Restricted Area");
provided, however, that this restriction shall not be construed to prohibit the
installation of a single driveway and any utility, telephone, water lines, and
landscaping, through the Restricted Area for the purpose of serving a residence
constructed on the premises conveyed hereby; and provided further, however, this
restriction shall not be construed as affecting required setbacks under applicable
zoning laws, ordinances, rules and regulations.
2. Aside from clearing for construction of the single permitted driveway and its related
landscaping and any utilities, there shall be no removal of more than fifty percent
(50%) of existing trees in the Restricted Area.
3. Subject to their being removed along with their contents within one year from the
date hereof, those buildings and structures currently located in the Restricted Area
that are appurtenant to the Benefitted Premises may remain in their current
locations and the then owner of the Benefitted Premises shall have an easement
over the Restricted Area to the extent reasonably necessary for the use,
maintenance, repair and replacement of the same in such locations ("permitted

actions"), subject to the obligation to indemnify and hold harmless the then owner
of the premises conveyed hereby for any loss or damage resulting to such owner,
his agents, contractors, guests, invitees from the conduct of any permitted and
unpermitted actions, including but not limited to any violation of environmental laws
by reason of dumping or discharge of pollutants on the premises. This provision
shall survive closing.
The Restricted Area is bounded and described as follows:
BEGINNING at a point on the northerly line of a road located 213.91 feet North of a point
which is 429.03 feet East of a monument marking the United States Coast and Geodetic
Survey Triangulation Station "NIN", said point being at a point of curve to the left having
a radius of 336.75 feet and the direction of whose radius at that point is South 09 degrees
16 minutes 02 seconds East; and
RUNNING THENCE southwestwardly along said road line and along the arc of said curve,
48.70 feet;
THENCE still along said road line South 72 degrees 26 minutes 50 seconds West, 100.00
feet;
THENCE North 08 degrees 27 minutes 00 seconds West, 120.43 feet;
THENCE North 46 degree 57 minutes 10 seconds West, 238.37 feet;
THENCE North 53 degrees 47 minutes 40 seconds East, 223.05 feet;
THENCE South 22 degrees 33 minutes 27 seconds East, 402.98 feet to the point or place
