GRANT OF EASEMENT
THIS GRANT OF EASEMENT is made this 24'rK day of March, 2022, by
HENRY L. FERGUSON III,Trustee of the Henry L. Ferguson III Trust Agreement dated
February 12, 2015, 390 High Street, Mystic, Connecticut 06355, and SUSAN S.
FERGUSON, Trustee of the Susan S. Ferguson Trust Agreement dated February 12,
2015, 390 High Street, Mystic, Connecticut 06355 (hereinafter referred to collectively as
("Grantor"), to Calvert Barrows Hall and Eleanor Latrobe Hall, both residing at 236 S.
Beach Road, Hobe Sound, Florida 33455(hereinafter referred to collectively as"Hall"), and
Ellen McCance Parker, residing at 1570 Mansion House Drive-#426, Fishers Island, New
York 06390 (hereinafter referred to as "Parker", with Hall and Parker hereinafter referred
to collectively as "Grantee");
WITNESSETH :
WHEREAS, Grantor is the owner in fee simple of a parcel of land located at
570 Mansion House Drive, Fishers Island, Town of Southold, County of Suffolk and State
of New York (SCTM No. 1000-009.00-01.00-011.000), more fully described in Schedule
A attached hereto (hereinafter referred to as "Grantor's Premises"); and
WHEREAS, Hall is the owner in fee simple of two parcels of land located at
Sappho Road, Fishers Island, Town of Southold, County of Suffolk and State of New York
(SCTM Nos. 1000-009.00-01.00-009.003 & 1000-006.00-05.00-007.001), more fully
described in Schedule B attached hereto, and Parker is the owner in fee simple of a parcel
of land located at Sappho Road, Fishers Island, Town of Southold, County of Suffolk and
State of New York (SCTM No. 1000-006.00-05.00-012.005), more fully described in
Schedule C attached hereto(said parcels so owned by Hall and Parker hereinafter referred
to collectively as "Grantee's Premises"); and
WHEREAS, a water line or pipe and related equipment were previously
installed under a portion of Grantor's Premises for the purpose of providing public water
service to Grantee's Premises; and
WHEREAS, Grantee desires to acquire a permanent easement over a ten-
foot wide portion of Grantor's Premises, which portion includes the land under which the
water line or pipe and related equipment serving Grantee's Premises were installed, and
Grantor is willing to grant such easement upon the terms and conditions hereinafter set
forth;
NOW,THEREFORE, in consideration of the sum of Ten Dollars($10.00)and
other good and valuable consideration paid by Grantee to Grantor, the receipt and
sufficiency of which are hereby acknowledged,

Grantor hereby grants and releases unto Grantee and Grantee's heirs,
successors and assigns, as appurtenant to and for the benefit of Grantee's Premises, a
permanent easement under the Easement Area described below for the use, construction,
operation, maintenance, repair, improvement and replacement of water lines and pipes
and related equipment for the provision of public water service to Grantee's Premises.
This easement shall include the right of Grantee and Grantee's contractors, agents,
servants and employees to enter upon the Easement Area to undertake any actions
consistent with the purposes for which this easement is granted, including but not limited
to actions that in the reasonable judgment of Grantee might interfere with the continuity of
public water service to Grantee's Premises; provided, however, that by undertaking any
such actions, Grantee shall be obligated to repair any resulting damage and to restore
Grantor's Premises as nearly as practicable to their condition existing immediately prior to
the undertaking of such actions.
The Easement Area covered by this Grant of Easement is described as
follows:
All that certain plot, piece or parcel of land, situate, lying and being at Fishers
Island, Town of Southold, County of Suffolk and State of New York, being ten (10) feet in
width and having a center line described as follows:
BEGINNING at a point on the easterly line of premises of Fishers Island
Utility Company, Inc., said point being located 3840.71 feet North of a point which is
2226.85 feet West of a monument marking the United States Coast and Geodetic Survey
Triangulation Station "PROS'; and
RUNNING THENCE South 30 degrees 54 minutes 16 seconds East, 57.02
feet to a point;
THENCE South 45 degrees 09 minutes 14 seconds East, 49.63 feet.
This Grant of Easement shall run with the land and be binding upon and inure
to the benefit of the respective heirs, successors and assigns of Grantor and Grantee.
IN WITNESS WHEREOF, Grantor has executed this Grant of Easement as
of the day and year first above written.
