BOUNDARY LINE AGREMENT
AGREEMENT made this ^day of December, 2021 between Vivian B. Stein
and Craig Stein , residing at 4345 North Road, Greenport,NY, 1944 ,party of the first part; and
Derek Durley, residing at 139 West 82"d St, Apt. #313,New York,NY, 10024, party of the
second part, WITNESSETH:
WHEREAS,Vivian B. Stein, Craig Stein and Derek Durley, the parties to this
agreement are the present owners in fee of the adjoining parcels of improved real property and
the parties wish to define and establish such boundary line for all time,it is agreed as follows:
WHEREAS,Vivian B. Stein and Craig Stein,the parties of the first part are the owners
in fee simple of the premises known as 4345 North Road, Greenport, in the Town of Southold,
County of Suffolk,and State of New York, which property is more fully described in a certain
deed executed between Vivian B. Stein(Grantors)and Vivian B. Stein and Craig Stein
(Grantees), dated March 17, 2011 recorded in Liber 12657 Page 744 on April,21, 2011 in the
Suffolk County Clerk's Office. (See Exhibit A attached hereto), and also known as Section
Section: 035.00 Block: 02.00 Lot: 09.002 (hereinafter-the"Stein"premises) and
WHEREAS,Derek Durley, the party of the second part is the owner in fee simple of the
premises known as 4445 North Road, Greenport, in the Town of Southold,County of Suffolk,
and State of New York,which property is more fully described in a certain deed executed by
David L. Gillispie,Jr. and Roda H. Gillispie(Grantors) and Derek Durley (Grantees), dated
August 16, 2017,recorded in Liber 12929 Page 153 on September 12,2017 in the Suffolk
County Clerk's Office (See Exhibit B attached hereto), which property is immediately
adjoining on the East of the above referenced premises of the party of the first part, and also
known as Section 035.00 Block 02.00 Lot 07.000, (hereinafter the"Durley"premises).
WHEREAS,the boundary line to the East of the"Stein"premises is also the West
boundary line of the "burley"premises; and therefore a"common boundary line".
NOW THEREFORE, Derek Durley,party of the second part, Covenants as follows:
A. As party of the second part, has been shown a survey of the "Stein"premises made
and certified by Ward Brooks Land Surveyor, dated November 9, 2021 which establishes the
common boundary of the adjoining parcels in accord with the agreement of the parties to this
agreement (See Exhibit C attached hereto and made part of this Agreement).
B. Hereby certifies that he has agreed that the "Common boundary line" as depicted in
the said Survey is accurate and true and that he makes no claim for ownership by adverse
possession or otherwise to the portion of the land where the gravel driveway extends about 7.4
feet to the West of the"Common boundary line".
C. Hereby certifies that himself,his heirs, distributes, executots,,administrators,
successors and assigns, make no claim of ownership to that portion of the"Stein"premises on
which said gravel driveway encroaches on the"Stein"property as shown on the Survey,by
adverse possession or otherwise.
D. Hereby releases any claim that he may have in and to the property located about 7.4
feet West of the easterly record line on the"Stein" premises.
IT IS MUTUALLY AGREED AND COVENANTED TO that this agreement shall run with the
land and be binding upon and ensure to the benefit of the successors in interest of the parties.
IN WITNESS WHEREOF, the parties have hereunto set their hands and seals the day and
year first above written.
