WHEREAS,a survey was made,which showed thatthe Defendants' pool fence encroaches upon the Plaintiffs'aforesaid property. A copy of the survey reflecting the Defendants'encroachment beyond the shared property line described above is attached hereto and made a part hereof as Exhibit A. WHEREAS,the Plaintiffs and the Defendants desire to confirm their rights ofownership to their respective properties,and to settle the above referenced matter; NOW,THEREFORE,it is mutually covenanted and agreed as follows: 1. The parties mutual boundary line shall remain unaffected by the location ofthe pool fence as depicted on a certain survey of Lot 2,Map of Bayview Farm,filed January 18, 19 82 under FHeNo. 7045 prepared by Kenneth Woychuk Land Surveying,PLLC dated June 28,2020. In case the notice is given, and the work is not commenced within one hundred and eighty(180)days after the receipt thereof,Plaintiffs or any subsequent owner of the Plaintiffs'premises,their agents,employees and servants,may enter upon the premises,without unreasonable interference on the part of Defendants,their heirs,successors or assigns,and removethe fence from the Plaintiff's'property. 4. Said one hundred and eighty (180)days notice,shall not be demanded until on or after October 1,2026.
