AGREEMENT,made this 19 day of September,2021 between
Allison Forstmann and Stephan Forstmann,both residing at 10 City Place,
PH 2D,White Plains,New York 10601 hereinafter referred to as Plaintiffs;
and Robert Ehrlich and Madelyn Ehrlich both residing at 17 Main Avenue,
Sea Cliff,New York 11570,hereinafter referred to as Defendants.
WITNESSETH:
WHEREAS,the Plaintiffs own vacant real property located at 1750
Orchard Street,Orient,New York and further describedas SCTM No. 1000-
025.00-05.00-002.000,which abuts the northern border ofDefendants
property described,infra.
WHEREAS,the Defendants own improvedreal property located at
820 Old Farm Road,Orient,New York and further described at SCTMNo.
1000-025.00-05.00-010.000,which abuts the southern border of Plaintiffs'

aforesaid property.
WHEREAS,the deeded property line coordinate shared by the
Plaintiffs and Defendants is North 78 Degrees 03 Minutes 50 Seconds West
a distance of 154.78 feet.
WHEREAS,a survey was made,which showed thatthe Defendants'
pool fence encroaches upon the Plaintiffs'aforesaid property. A copy of
the survey reflecting the Defendants'encroachment beyond the shared
property line described above is attached hereto and made a part hereof as
Exhibit A.
WHEREAS,the Plaintiffs and the Defendants desire to confirm their
rights ofownership to their respective properties,and to settle the above
referenced matter;
NOW,THEREFORE,it is mutually covenanted and agreed as
follows:
1. The parties mutual boundary line shall remain unaffected by the
location ofthe pool fence as depicted on a certain survey of Lot 2,Map of
Bayview Farm,filed January 18, 19 82 under FHeNo. 7045 prepared by
Kenneth Woychuk Land Surveying,PLLC dated June 28,2020. A copy of
the survey is attached hereto and made a part hereof as Exhibit A.
2. The portion ofthe pool fence that is not located on the common
boundary line may remain as it now exists and so long as it stands,but
Defendants,their heirs,successors or assigns,will within one hundred and
eighty(180)days after receiving written notice from the Plaintiffor any

subsequent owner of the Plaintiffs'premises,shall,at their own expense,or
at the expense of the then owner of Defendants'p remises,proceed to
remove the fence as it now stands, and replace the same upon the boundary
line so established or remove the fence.
3. In case the notice is given, and the work is not commenced within
one hundred and eighty(180)days after the receipt thereof,Plaintiffs or any
subsequent owner of the Plaintiffs'premises,their agents,employees and
servants,may enter upon the premises,without unreasonable interference on
the part of Defendants,their heirs,successors or assigns,and removethe
fence from the Plaintiff's'property.
4. Said one hundred and eighty (180)days notice,shall not be
demanded until on or after October 1,2026.
TT IS MUTUALLY COVENANTED AND AGREED by theparties
that this agreementshall run with the land and be bindingupon and enure to
thebenefit of the respective heirs,executors,administrators,successors and
assigns of each of the parties.
IN WITNESS WHEREOF,the parties have set their hands on the
day and earwritten above.
