O. Box 604, Fishers Island, New York 06390; WITNESSETH : WHEREAS, Grantor is the owner in fee of premises situate at 4997 ) Equestrian Avenue, Fishers Island, Town of Southold, County of Suffolk and State of New /I►� York (SCTM No.1000-009.00-09.00-003.001); having acquired title to such premises by deed recorded in the Office of the Suffolk County Clerk on June 27, 2018 in Liber 12967 page 125 (hereinafter referred to as "Grantor's Premises"); and WHEREAS, poles, lines, boxes and other utility equipment and devices for the provision of electric, telephone and water services to properties in the vicinity of Grantor's Premises have been or will be newly installed at the expense of the owners of such properties (collectively, the"Replacement Facilities")to replace obsolete facilities for such services; and WHEREAS, each Utility Company is willing to assume ownership of Replacement Facilities relevant to the services it provides, such assumption to be on condition that it acquires a permanent easement over a portion of Grantor's Premises, which portion includes but is not limited to the land on which the Replacement Facilities are installed, and Grantor is willing to grant such an easement upon the terms and conditions hereinafter set forth; NOW,THEREFORE, in consideration of the sum of Ten Dollars($10.00)and other good and valuable consideration paid by the Utility Companies, the receipt and .sufficiency of which are hereby acknowledged, Grantor hereby grants and releases unto the Utility Companies and their respective successors and assigns, a permanent easement(the"Electric/Telephone Line Easement"), subject to the terms and conditions herein, upon, across, over and/or under the Electric/Telephone Line Easement Area described below for the use, construction, operation, maintenance, repair, improvement, inspection and replacement of poles, electrical power lines,transformers,telephone lines, power and communication cables and boxes, conduits, guys, anchors and any other utility equipment or devices of any nature that may now or may hereafter be employed to provide utility services to properties in the vicinity of Grantor's Premises. The Electric/Telephone Line Easement shall not include an easement for water service except to the extent necessary for a water line to cross the Electric/Telephone Line Easement Area described below over that portion of the Electric/Telephone Line Easement Area described in its first course and distance below. 1 ti Except to the extent necessary to provide such utility services solely to Grantor's Premises or such requirement is waived in writing by the Grantor, all such utility services shall be installed underground.This Electric/Telephone Line Easement shall include the right of the Utility Companies and their respective contractors, agents, servants and employees to enter upon the Electric/Telephone Line Easement Area to undertake any actions consistent with the purposes for which this easement is granted, including but not limited to the trimming, cutting and removal of trees and other vegetation that in their reasonable judgment might interfere with the continuity of any utility service, and the obligation of the Utility Companies and their respective successors and assigns to restore any disturbed area as nearly as practicable to its original condition after the placement, installation, maintenance, repair, inspection and replacement of any such utility service. Except for costs to first place and install the Replacement Facilities (which have in fact been so placed and installed as of the date hereof), the cost of placement, installation, maintenance, repair, inspection and replacement of any such utility service and of restoration of the affected area shall be borne solely by the Utility Companies and their respective successors and assigns. The Electric/Telephone Line Easement Area covered by this Grant of Easement is described as follows: All that certain plot, piece or parcel of land situate, lying and being at Fishers Island in the Town of Southold, County of Suffolk and State of New York, being ten (10) feet in width and having a center line described as follows: BEGINNING at a merestone set at the southwesterly corner of Grantor's Premises, said merestone being located 5126.07 feet West of a point which is 1469.85 feet North of a monument marking the United States Coast and Geodetic Survey Triangulation Station "PROS"; and RUNNING THENCE North 600 13' 12" West, 19.12 feet to a point; THENCE North 36° 46' 47" West, 53.42 feet to a point; THENCE North 170 54' 18" West, 41.54 feet to a point; THENCE North 10° 49' 11" West, 55.31 feet to a point; THENCE North 28° 10' 19" West, 50.22 feet to a point; THENCE North 240 48' 12" East, 22.74 feetto a point; THENCE North 11" 27' 43" West, 102.91 feet to a point; THENCE North 02' 13' 09" East, 63.25 feet to a point; THENCE North 030 09' 51" West, 9.90 feet to a point; THENCE North 14° 45' 14" West, 6.98 feet to a point; 2 THENCE North 44° 12' 21" West, 3.00 feet to a point in the northerly line of Grantor's Premises. Grantor hereby grants and releases unto the Utility Companies and their respective successors and assigns, a permanent easement (the"Water Line Easement") upon, across, over and/or under the Water Line Easement Area described below for the use, construction, operation, maintenance, repair, improvement, inspection and replacement of water mains and pipes and any other utility equipment or devices of any nature that may now or may hereafter be employed to provide utility services for the provision of public water to properties in the vicinity of Grantor's Premises. The Water Line Easement Area covered by this Grant of Easement is described as follows: All that certain plot, piece or parcel of land situate, lying and being at Fishers Island in the Town of Southold, County of Suffolk and State of New York, being ten (10) feet in width and having a center line described as follows: BEGINNING at a point in the southerly boundary of Grantor's Premises, said point being located North 65 degrees 31 minutes 00 seconds East, 8.03 feet from a monument which is located 5126.07 feet West of a point which is 1469.85 feet North of another monument marking the United States Coast and Geodetic Survey Triangulation Station "PROS"; and RUNNING THENCE North 70' 44' 50" West, 7.68 feet to a point; THENCE South 59° 41' 04" West,14.11 feet to a point. This Grant of Easement is made on the condition that, in the event the previously installed utility equipment and devices are ever replaced, the same shall be relocated off Grantor's Premises and into the roadway adjoining Grantor's Premises on the west and the easement rights with respect thereto shall lapse and be of no further force or effect. 3 This Grant of Easement shall run with the land and be binding upon and inure to the benefit of the respective successors and assigns of Grantor and the Utility Companies.
