consideration paid by the party of the second part,does hereby grant and release unto the party of the second part,
the heirs or successors and assigns of the party of the second part forever,
All that certain plot,piece or parcel of land situate,lying and being at Fishers Island,Town of Southold,County of
Suffolk and State of New York,being bounded and described as set forth on Schedule A attached hereto.
BEING AND INTENDED TO BE a portion of the same premises conveyed to the party of the first part as Parcel
I by deed,dated March 9,2012 and recorded in the Office of the Suffolk County Clerk on June 4,2012 in Liber
12695 page 153.
This conveyance of the premises described on Schedule A hereto(being a portion of said Parcel I described in the
aforesaid deed recorded in Liber 12695 page 153)was approved by the Planning Board of the Town of Southold
by resolution adopted on November 1,2021. By accepting this deed,the party of the second part acknowledges
and agrees that the premises conveyed hereby(being a part of SCTM No. 1000-002.00-01.00-008.001)shall
merge with and become a part of the remaining premises of the party of the second part adjoining the premises
conveyed hereby on the south (formerly SCTM No. 1000-002.00-01.00-008.002, a portion of which premises
adjoining on the south as heretofore existing being conveyed to the party of the first part by deed intended to be
recorded simultaneously herewith)and shall not,except as so merged with such remaining premises,constitute
a separate building site under applicable laws,ordinances,rules and regulations.A perimeter description of said
merged parcel is set forth on Schedule B hereto and a reduced version of the lot line change map approved by the
Planning Board of the Town of Southold depicting the authorized land transfers is set forth on Schedule C hereto.
TOGETHER with all right,title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants that the parry of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for any other purpose.The
word"party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.
