I believe I 5 have highlighted some of the revisions 6 earlier today, but I would happy to take any 7 question and certainly listen to any 8 comment? 9 (No Response ) . 10 SUPERVISOR SCOTT RUSSELL : 11 COUNCILWOMAN JILL DOHERTY : Make a 12 motion to close the hearing . 13 COUNCILMAN ROBERT GHOSIO : Second . 14 SUPERVISOR SCOTT RUSSELL : All in 15 favor? 16 COUNCILWOMAN SARAH NAPPA: Aye . 17 COUNCILMAN JAMES DINIZIO JR . : Aye . 18 COUNCILWOMAN JILL DOHERTY : Aye . 19 COUNCILMAN ROBERT GHOSIO : Aye . 20 JUSTICE LOUISA EVANS : Aye . 21 SUPERVISOR SCOTT RUSSELL : Aye . 22 * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * 23 LOCAL LAW OVERRIDE TAX LEVY 24 COUNCILMAN ROBERT GHOSIO : Please 25 take notice of a Public Hearing will be held 3 1 before the Town Board of the Town of 2 Southold, at Southold Town Hall Meeting 3 Room, 53095 Main Road, Southold, New York, 4 on the 3rd day of November, 2021 at 7 : 00 5 o ' clock . To consider a Local Law to 6 Override the Tax Levy Limit established by 7 and set forth in General Municipal Law 8 Section 3-c as follows : 9 The purpose of this Local Law is to 10 allow the Town of Southold to override the 11 limit on the amount of real property taxes 12 that may be levied by the Town of Southold, 13 Suffolk County, New York pursuant to General 14 Municipal Law 3-c, and to allow the Town of 15 Southold to adopt a town budget for town 16 purposes and any other special or 17 improvement districts governed by the town 18 board for the Fiscal Year 2022 . That 19 requires a real property tax levy in excess 20 of the "tax levy limit" as defined by 21 General Municipal Law Section 3-c . The Town 22 of Southold has made significant efforts to 23 reduce spending in an effort to avoid 24 piercing the tax levy limit, however, in 25 order to account for the increase in costs 4 1 to provide town services and fund town 2 operations for 2022 , while at the same time 3 maintaining the Town ' s high credit rating 4 and general fund reserves , will likely 5 require adoption of a budget in excess of 6 the tax levy limit . The authority of this 7 Local Law adopted pursuant General Municipal 8 Law 3-c ( 5 ) which expressly authorizes a 9 local government ' s governing body to 10 override the tax levy limit by the adoption 11 of a Local Law approved by a vote of sixty 12 percent of the Town Board . The tax levy 13 limit override . The Town Board of the Town 14 of Southold, County of Suffolk, is hereby 15 authorized to adopt a budget for the Fiscal 16 Year 2022 that requires a real property tax 17 levy in excess of the limit established by 18 and set forth in General Municipal Law 3-c . 19 If a court determines that any clause, 20 sentence, paragraph, subdivision, or part of 21 this Local Law or the application thereof to 22 any person, firm or corporation, or 23 circumstance is invalid or unconstitutional , 24 the court ' s order or judgment shall not 25 affect, impair, or invalidate the remainder 5 1 of this Local Law, but shall be confined in 2 its operation to the clause, sentence, 3 paragraph, subdivision, or part of this 4 Local Law or in its application to the 5 person, individual , form or corporation or 6 circumstance, directly involved in the 7 controversy in which such judgment or order 8 shall be rendered . Effective date of this 9 Local Law shall take effect immediately upon 10 filing with the Secretary of State . You 11 have a copy, an Affidavit of its publication 12 in the New London Day, as well as , the Town 13 Clerk ' s website, bulletin board . And 14 publication in the Suffolk Times . That is 15 all I have . 16 SUPERVISOR SCOTT RUSSELL : I am going 17 to ask anybody to comment on this particular 18 -- 19 COUNCILWOMAN JILL DOHERTY : Do you 20 want to explain more on the tax levy -- in a 21 work session a couple of weeks ago, you kind 22 of -- 23 SUPERVISOR SCOTT RUSSELL : Yeah . 24 There is fundamental difference between a 25 tax levy and a tax break . The tax levy for 6 1 the most part, it ' s basically -- a little 2 bit of a complicated explanation, but 3 basically think of it as a dollar to dollar 4 spending from year one to year two . It ' s a 5 calculation based on the amount of dollars 6 you spend . Then the tax rate is different 7 in that the tax rate can be influenced by a 8 lot of things . Not just the increase that 9 you ' re spending . Based on the new budget . 10 It can be also -- the tax rights impacted by 11 change in assessed value and all sorts of 12 other things . That is why those two numbers 13 generally don ' t match . 14 COUNCILMAN ROBERT GHOSIO : I just 15 read the summary . I didn ' t see it had 16 ( inaudible ) prepared for . So this might 17 help a little bit as well . The New York 18 State Comptroller has determined that the 19 tax levy cap for the fiscal year 2022 will 20 be 20 . In order to maintain the Town ' s high 21 bond rating and help fund balance reserves , 22 it may be necessary to adopt a property tax 23 cap levy in excess of the limit that was 24 established by the Comptroller . Local Law 25 authorizing a tax level in excess of the 7 1 limit is established by the Comptroller, 2 requires a vote of sixty percent of the Town 3 Board . A vote of approval . And again, the 4 full text is available for review in the 5 Town Clerk ' s Office and the Town ' s website . 6 SUPERVISOR SCOTT RUSSELL : Would 7 anybody like to comment? 8 COUNCILMAN JAMES DINIZIO JR . : What 9 is the actual levy going to be? 10 SUPERVISOR SCOTT RUSSELL : The actual 11 tax rate is an increase of 2 . 690 . But 12 again, that is just one function of the 13 actual right .
