RUSSELL, SUPERVISOR 16 LOUISA EVANS , BOARD MEMBER 17 JILL DOHERTY, BOARD MEMBER 18 JAMES DINIZIO, JR . , BOARD MEMBER 19 ROBERT GHOSIO, BOARD MEMBER 20 SARAH NAPPA, BOARD MEMBER 21 22 23 24 25 2 1 BATTERY BARLOW PROPERTY, LLC 2 COUNCILMAN ROBERT GHOSIO : Notice is 3 Hereby Given That, on August 11 , 2015 the 4 Town Board of the Town of Southold enacted a 5 Local Law changing the zoning designation on 6 property located on Fishers Island 7 identified on the Suffolk County Tax Map as 8 SCTM #1000-12-1-1 . 2 , and known as the 9 Battery Barlow Property, from the 10 Residential Low-Density, R- 120 , Zoning 11 District to the Affordable Housing District, 12 AHD; and pursuant to section 280-29 13 ( F) ( 2 ) ( a) of the Town Code upon request of 14 the Town Board, a notice to the applicant, 15 and for good cause shown, the establishment 16 of an AHD District may be revoked 18 months 17 after approval if work on the site has not 18 commenced or the same is not being 19 prosecuted to conclusion within reasonable 20 diligence ; 21 Notice is Hereby Further Given, the 22 Town Board has received a request from the 23 agent for the property owner requesting that 24 the AHD District be revoked and revert back 25 to the R- 120 Zoning District ; 3 1 Notice is Hereby Further Given, that 2 pursuant to the requirements of Section 265 3 of the New York State Town Law and the Code 4 of the Town of Southold, Suffolk County, New 5 York, the Town Board of the Town of Southold 6 will hold a public hearing on the aforesaid 7 revocation of zoning designation at Southold 8 Town Hall , 53095 Main Road, Southold, New 9 York, on the 5th day of October, 2021 at 10 7 : 00 p .m. The purpose of this Local Law is 11 to change the Zoning District Designation of 12 SCTM #1000-12-1-1 . 2 from Affordable Housing 13 District, AHD, to Residential Low-Density, 14 R-120 . The proposed local law for the 15 Public Hearing is being held this evening 16 and proposed to revoke the zoning 17 designation of Affordable Housing District 18 and revert it to Low-Density Residential , 19 R-120 , for the property located on Fishers 20 Island, known as the Battery Barlow Property 21 and identified on the SCTM #1000- 12- 1-1 . 2 . 22 On the request for the agent for the 23 property owner . The full text of the 24 proposed local law is available for review 25 in the Town Clerks Office and on the Town ' s 4 1 website . I do have a notarized affidavit 2 that this hearing was advertised by the Town 3 Clerk, the Town Clerk bulletin board and the 4 Town ' s website . I also have the copy of the 5 notice from -- that was published in the New 6 London Day and also the Suffolk Times . 7 Suffolk Times is here, and I think -- we do 8 have a Memorandum from the Planning Office 9 -- Planning Board office . That the Planning 10 Board supports the proposed change of zone, 11 as it ' s consistent with the Town ' s 12 Comprehensive Plan . The amendment will 13 allow a Fishers Island Community Center and 14 provide additional recreation facilities and 15 housing, employee housing . And that ' s all I 16 have . 17 SUPERVISOR SCOTT RUSSELL : I am going 18 to invite anybody that would like to comment 19 on this particular Local Law, whether they 20 have to catch a ferry or not? 21 COUNCILMAN ROBERT GHOSIO : I just 22 have one last thing . I am sorry . We do 23 have a letter here from the County of 24 Suffolk that this is a decision for local 25 determination, which should not be construed 5 1 as an approval or disapproval . 2 JOHN BENNETT : Good evening 3 Supervisor Russell and Members of the Town 4 Board . I will be very brief . My name is 5 John Bennett . I am a member of Bennett & 6 Read in Southampton, New York . We represent 7 the Fishers Island Community Center . And as 8 has been explained to me, the community 9 center has an understanding or handshake 10 with the owner of the property, that upon 11 receipt of the appropriate approvals to 12 establish the recreational use on the 13 property, they would be purchasing the 14 property . We are obviously in support of 15 the zoning change to allow us to go on to 16 the Special Exception procedure in the Town 17 Code . It will allow further, for the 18 purposes of the community center, and unless 19 there are any other questions , I have 20 nothing else to add . 21 SUPERVISOR SCOTT RUSSELL : Would 22 anybody else like to address the Town Board 23 on this particular Local Law? 24 (No Response ) . 25 COUNCILWOMAN JILL DOHERTY : Anyone on 6 1 Zoom? 2 UNKNOWN FEMALE : No one has their 3 hand raised .
