Kimack. The applicant is looking for approval of an "as built" porch in the back of the house. He had approval from the ZBA for a screened porch but made it into a habitable conditioned space with windows and heat to be used as a family room. s> 711 I believe an application is required with documentation that answers the following issues: • This is the east facade,which looks out onto a pool and a 6' solid wood fence at the back of the property. The property behind that is a wooded lot on Tabor Street. We purchased the ho2016 completed a 1 year gut-renovation of the house, and additionally, had the porch built. I know Mike Kimack and Mark Schwartz have been working on the Porch details with you, and they've been keeping me in the loop, but I felt if i jumped in here I could help add some context. Regarding the original HPC approval of the porch, plans were submitted to the Building Dept in 2016 while we were in the throes of renovating the original structure.....and we're not sure either why the Building Dept didn't put the porch plans in front of the historical board. It's possible that since the porch was not visible to the street,that either the building dept or the HPC at the time determined it didn't fall under the purview of the HPC.This may have reflected the HPC focus at the time which, IMO,was more on the streetside viewable aspects of historical homes. In so far as the structure and windows of the porch,we would have welcomed HPC input prior to the porch build in 2016 had it been presented to them.We had already met with the HPC board regarding our renovation of the original structure of the house in 2015/2016, and followed all instructions provided, including using wood windows with muntins,wood doors,the same clapboard style cedar siding, etc. Examples of everything we used were provided to the HPC. The home was in terrible shape structurally when we purchased it. Previous owners throughout the years made repairs to the house using shoddy construction techniques, which we had to rip out. Faults included 3 roofs being built over the years over the kitchen, beams going nowhere, load bearing walls that were not properly framed, a sagging& rotting 1 roof, and a termite ridden foundation.We invested close to$750k to restore the ho—me....re-framing the house, re- building the foundation,fixing all the faults....while abiding by HPC direction, with work completed in late 2016. That said, even though we no longer own the home,we agreed with the new buyers to pay for reasonable actions to put the porch into a more consistent alignment with the exterior of the original structure in order to secure the renewed variance.The most obvious direction here we believe would be the replacement of the current slider windows on the porch with the same double hung, wood windows that are found throughout the main structure, which will keep the porch in alignment with the house, using the same 2016 HPC approved single pane Series E windows with installed muntins. Mark communicated to me that different windows are being suggested for the porch, rather than the Series E Andersens that are in the house now. Can you clarify what you are looking for in these windows/doors, not by brand, but in terms of the window's properties?That way we can figure out what to do next. It truly saddens me that a situation has arisen, as a result of a lack of forthrightness,for me to have to be writing this letter. Unfortunately, I am unable to attend the zoom Southold Town Historic Preservation Commission public hearing at 3:40 on Thursday December 9th, 2021 re the application of Keith and Lynette Kane's request for a Certificate of Appropriateness under Section 170-7 (b) of the Southold Town Code. However, I would like to go on record with the following comments. When the Kanes first purchased the home at 335 Village Lane in Orient and were contemplating the renovations/changes they were planning for the property and found that they needed a variance as their construction would require a variance because what they were planning was too close to my property at 455 Village Lane, Mr. Kane spoke to me. He told me that he had always dreamed of having a screened in porch and wished to add one to his property. He asked me if I would refrain from contesting the granting of a variance for the addition of a SCREENED IN PORCH even though it would not meet the present distancing requirements. I told Mr. Kane that I would not contest the granting of a variance for a SCREENED in PORCH for which he sought a variance from the Zoning Board of Southold Town. Unfortunately, it seems that Mr. Kane sought a variance for a SCREENED in PORCH and then,without seeking approval, went ahead and built a PERMANENT conditioned habitable space,thus not only being untruthful to me, his neighbor, but to the Zoning Board of Appeals Town of Southold as well. I will be advising the Zoning Board of Appeals, before their January 6th meeting, of this same lack of forthrightness on Mr. Kane's part. Once again, I am truly saddened to find myself in the position of having to write this letter, however I feel it is my duty to do so in an effort to prevent others who may move to Orient in the future and feel that they too need not be open and honest about their intentions when filing for their variance.
