EXECUTIVE SESSION
9:15 A.M. - The Board met with C.S.E.A. representatives Christine Stulskly, Pres-
ident, Betty Wells, and Patrick Haggerty, to discuss personnel.---Following this
discussion the Board met privately in Executive 'Discussion to review wage and polic~/
with respect to the C.S.E.A. contract; possible purchase of property for the Town;
possible litigation; and P.B.A. negotiat'ions.
10:25 A.M. - William Behr, Chairman, and William Gardner, member, Economic Advisory
Committ'ee me~',with the,'Board to report that they are in-the process of preparation of
the. final report of the Committee, but will need additional timid. The Board agreed to
extend the appointment of the Committee members to March 31, ~1987 (see resolution no.
23)°
10:50 A.M. - John Fitzpatrick and Robert Schacter~' Investment Executives from Paine
Webber, met with the Board to present the Putnam Public:Employee Deferred Compen-
sation Plan which they propose for the Town. Fo~lowing'a review of the investment
options, they agreed to have their~attorney meet with Town Attorney Tasker to dis'cuss
a possible contract for the Town.
11:20 A.M. - Gary Loesch, P.E. and George Desmarias, P.E., Holzmacher, McLendon
and Murrell, P.C. met'with the Board. Mr. Loesch reviewed the proposed location
of the weighing facility to be const'ructed at the Landfili~ Cutchogue. He advised the
Board that the bid documents should be ready by the end of January. It was decided
soil borings should be taken (see resolution no. 24) to determine the most stable
location for the scale.---Mr. Desmarais reviewed his findings with respect to necessary
corrections to be made at the Scavenger Waste Treatment Facility, Greenport. He and
Mr. Loesch also reviewed the H2M proposal for a 1987 Retainer for Engineering/Analytical
Services at the Scavenger Waste Plant. The Board agreed H2M services are still needed
as the plant has not been in~ full operation for a year. The Board agreed to accept
their proposal (see resolution no. 25) in'the amount of $2a;,500.00, and requested Mr.
Loesch to have a contract drawn which is to be reviewed by Town Attorney Tasker.
The Board aSked;Mr. Loesch to discuss with fils-superiors a pos~ble proposal for H2M
to run the plant should they reach an agreement with the Village of Greenport to dis-'
d~ntiniJe their :management.
EXECUTIVE SESSION
11:20 A.M. - The discussion with Gary Loesch and George Desmarias was interrupted
briefly for the Board to have a telephone conversation with the Town's C.S.E.A. and
P.B.A. negotiator Charles Graves concerning certain' interpretations of the C.S.E.A.
contract provisions.
12:55 P.M. - Dog Pound - Contractor Saetta, while excavating for the construction
of the new kennel building, disCOvered cesspools under the site. Revisions must be
made and Architect Garrett Strang will be contacted to review the problem with Mr.
Saetta.
1:00 P.M. - Superintendent of Highways Jacobs dis(~ussed possible methods for disposal
of the metal at the Landfill'. He will' investigate further and report back to the Board.
1:05 P.M. - Recess for lunch.

EXECUTIVE SESSION
2:15 P.M. - Board:~discussed ~r6gr'ess of ~P.B.A. contract negotial~ions with Board
representative Councilman Penny, and agreed to approve a Memorandum of Under-
standing (see resolution no. 26) subject to the approval of Town Attorney Tasker.
2:30 P.M. - For Discussion Items: (1) Request from Eastern Long Island Hospital
for finan~i~al' as~si.stance-in"ithe amount of $10,000 to help toward their goal of $250,000
in'contributions for 1986. The '1986 Budget is'not in surplus at this time, and the
Board cannot make a final determination un~i.l',~at'least the end of January. (2) Review
of the status of the water machine which was transferred to the Village of Greenport
when the Senior/Youth Center was undergoing renovations. Councilman P~nny, in.:a
conversation with .Greenport Mayor Hubbard, determined that the Village was under
the impression the water machine was given to them. The Board agreed to rescind
~heir ~'esolutior~ of i2/16/86 to ;,a,.s.er the machin~ back {see resolution no. 30). ~
(3) Letter from Deep Hole Creek Association requesting $475.00 assistance toward ~,
their prbposed priv~ate dredging project; The Board established a policy in 1984
not to contribute to private dredging projects, and reaffirmed this policy by placing
resolution no. 27 on the agenda. (4) Reviewed proposed agreement between
Szepatowski Assodates, Inc. and the Town for Planning Consultant services during
· 1987 (see resolution no. 28). (5) Discussed appointment of part-time Clerks in
the Accountihg Department and Building Department through a work/study program
with Southold High School and Mattituck High School (see resolution no. 29). (6)
Set Tuesday, January 13th to interview Accountant applicants, and Wednesday, Jan-
uary 14th to interview Planner applicants.--Agreed to close Town Hall on January
19th, Martin Luther King Day.--Discussed the appointment of Building Department
Clerk on Fishers Island, Clarence Dixon, as a -fow~'representative for the Suffolk
County Department of Health and Consume~ Affairs on Fishers Island. This will be
placed on the organizational meeting agenda for a resolution.--Reviewed request of
James Goodwin to renew his "Junk Dealer's License. Exe~:utive Administrator Lessard
advises the operation meets all requirements for a junk yard. Town Clerk was
authorized to issue the license.---Supervisor advised the Board of the possibility
of acquirrng a surplus van from the County for CAST. Board had no objection.--
Discussed possibility of 'employees attending the Association of Towns at their own
expense, without being docked for the day, the Town to pay the registration fee.
Board agreed.
3:00 P.M. - Town Board presented Special Resolution to retiring Senior Account
Clerk Joan L. Richter (this special' resolution is 'entered in full during the Regular
Meeting commencing at 7:30 'P.M.).
4:00 P.M. - Reviewed regular meeting agenda resolutions.
4:45 P.M. - Audited outstanding vouchers.
5:'15 P.M. - Work Session adjourned.

A Regular Meeting of the Southold Town Board was held on Tuesday, December
30, 1986 at the Southold Town Hall, Main' Road, Southold, New York. Supervisor
Murphy opened the meeting at 7:30 'P.M. with the Pledge of Allegiance to the Flag.

WHEREAS, JOAN L. RICHTER, a most valued employee of the Town of Southold will
retire from public service on December 31, ~1986; and
WHEREAS, JOAN L. RICHTER has given generously of her time and expertise in' her'
faithful service to the Town of Southold and its residents as a member of the Account-
ing and Finance Department and Supervis0r's Office since June 26, 1B72; and
WHEREAS, her record of fine service to the Town of Southold and its people deserves
the sincere gratitude of those with whom and for whom she has served, now, there-
fore, be it ~
RESOLVED that the Town Board of the Town of Southold hereby expres, ses their'most

and the sale of the development rights, where Hallockville will receive the income.

interested.

with upland disposal, construct a bulkhead, and install a pier, ramp, and float at
Budd's Pond, Southold. Comments by January 12, 1987.
2. New York State Department of Environmental Conservation., notice of complete
application of Windsway Building Corp,. to create a four lot residential subdivision with

how to improve this critical health care service.
4. Notice from the New York State Department of Environmental Conservation
that they are planning a series of "Town Meetings" on a round-robin~basis"between
Janaury 1987 and April .1988 in all towns on Long Island. Southold's meeting will be

combined single limit :liability insurance coverage for Police vehicles, effective immediately.

directs Supervisor Francis J. Murphy to execute an agreement between the County
of Suffolk and the Town of Southold for. the 1987 Southold Town Youth S~rvices
Special Delinquency Prevention Proc]ram grant in'the amount of $10,000.00.

SUPERVISOR MURPHY: Number 7 is the SEQR determination on the Zehner change
of zone.
COUNCILMAN STOUTENBURGH: Could I say something just in here. I think we
haven't really had time to meet with anybody that i-knows too much about this; We've
'sat in on many hearings and for. me to be handed this "and asked to vote on it ~l think
is not really right. I think we should sit 'down with our Planner and make sure that
we understand exactly what we're do!ng and I would like to see it tabled.
TOWN CLERK TERRY: Excuse me, Paul, we are under a deadline. It is almost
30 days since the close of the Final Environmental Impact hearing.
SUPERVISOR MURPHY: We have to vote on it.'
CQUNCJLMAN STOUTENI3U.RGH: When is the 30 days up?
TOWN CLERK TERRY: We closed the hearing on December 2nd. It will' be up on
January 1st. We're within'a time frame. We had to hold action on this resolution
at our December 16th meeting to wait for the formal resolution from our Planner
who had been working on it.
COUNCILMAN STOUTENBURGH: Okay.
7. Moved by Supervisor Murphy, seconded by Councilman SchOndebare,
WHEREAS, howard Zehner, d/b/a Youngs Boatyard & Marina {formerly Southport
Development Corp.) has proposed a change of zone from "C" Light Industrial Distric~
to "M-l" General Multiple Residence District on certain property' located south of .the
Main (State Route 25) Road, on the westerly side of Sage Boulevard', Greenport, New
York, consisting of 12. 461 acres; and
WHEREAS, a Draft Environmental Impact Statement was prepared and accepted for
review, and was the subject of a public'hearing on February 4, 1986, and recessed
to February 25, :1986; and
WHEREAS, an Addendum to the Draft Environmental Impact Statement was prepared ~
and received for review, and together with the Draft E'n_v. ironmentaland Impact Statemenl I1
was the subject of a 'pubiic'h~;adng on Apr:,~ 8,: 1986; !4
WHEREAS, the Town ~f Southold caused a Final Environmental Impact Statement to bA~
prepared and the same was accepted for review; and
WHEREAS, a public'hearing was held on the Final Environmental Impact Statement on
November 18, :1986 and recessed to December 2, 1986; and
WHEREAS, the comment period of the Final Environmental Impact Statment has expired;
and
WHEREAS, 6NYCRR 617.. 9(c) requires that the Town Board, as lead agency, make
findings before rendering a decision on this'action based on the Final Environmental
Impact Statement; now, therefore, be it
RESOLVED, that pursuant to 6NYCRR 619.9(c) the Town Board of the Town of
Southold makes the followin9 findings for the above described change of zone petition:
1.. All requirements of SEQR, ini;luding Article 8 Of the State. Environmental
Conservation Law, Part 617 Of 6NYCRR, and Chapter 44 of the Code of the Town of
Southold have been met.
2. The Town Board has given consideration to the Final Environmental Impact
Statement in making its findings.
3. The uses permitted under the "M-I" General Multiple Residence Dis1~ric~
more closely comply with the uses proposed under the Town's Master Plan than the
uses permitted under the "C" Light Industria! District.
4. The change of zone from "C" Light Industrial-to "M-I" General Multiple'
Residence Disl~ric[ for the premises on Sage Boulevard will' not have a significant
adverse effect on the environment. The range of land uses permitt'ed under the
proposed zone will have less of an adverse impact than under the 'existing zoning
designation. ,
la) Specific land uses permitted.under the "M-l" District may, however,
cause signifii;ant adverse environmental impacts unless proper mitigating
measures are instituted.
lb) The Final Environmental Impact Statement for the change of zone does
not demonstrate beyond a reasonable doubt for the particular combination
of land uses proposed as the development project "Zehner" that:
_1_. Adverse surface runoff conditions will not result from a development
proposed under the change of zone.
2. A sanitary disposal system can be designed without adversely
affecting groundwater.
3. A sub-surface drainage system can be des-igned that will' preclude
adverse impacts on the surface waters surrounding the site of
the change of zone.
4. That satisfactory access to the site of the change of zone can be
provided without a significant adverse environmental impact
res u Itl ng therefrom.
5. That the process of removal, of the spit 'near the center of the
site will not have a signifi~:ant environmental impact in terms of
turbidity, affect on shellfish within:and adjacent to the cove,
upland disposal of the sediments and off-site impacts of upland
disposal.
(c) The Final Environmental Impact Statement does propose mitigation
measures to address items (4b) 1 through 5 which, when applied to
a complete and duly submitt:ed site plan application, may mitigate
adverse environmental impacts to the maximum extent practicable.
Id) Such a complete and duly submitted site plan is not and cannot be
required at the stage of the change of zone, thus fully developed
mitigation measures applicable to all of the conceivable uses permitl~ed,
and alternative combinations, sizes, and locations of these uses are
not available for scrutiny pursuant to SEQR at this time.
(e) When complete site plans are duly submitt'ed to the Town under the
proposed "M-I" Dis[ric[, further review under SEQR will be necessary
to insure that there will' be no adverse environmental impact in terms
of surface runoff, sanitary system design and operation, subsurface
drainage, access, spit removal, and full compliance with the zoning
ordinance for the development known as "Zehner" {formerly Southport)
or any other particular combination of uses.
Conclusion:
1. Consistent with social, economic and other considerations essential' to the
Town of Southold, from among the presently reasonable and available alternatives
thereto, the ch~ang eof zone requested,.mi.n, imi~zes adverse environmental effects with
respect to the existing zo'ning (Jesighation t0~tl~e maximum extent practicable.
2. Consistent with social, economic, and other considerations essential to the
Town of Southold, to the maximum extent practicable, adverse impacts revealed during
the SEQR process for the requested change of zone will be minimize~l or avoided by
further analysis under SEQR during the site plan process for "Zehner" (formerly

payment of $3,102.'25 overtime due to Community Development .Administrator James

SUPERVISOR MURPHY: Ail 'right, I'd like one more. I'd like to appoint a Standin§
Committee on the operation of the Scavenger Waste Plant.
COUNCILWOMAN COCHRAN: We're the Commissioners. Each and every one of us.
COUNCILMAN SCHONDEBARE: l'm.a little confused too.
SUPERVISOR MURPHY: Well, ! agree we are.. I think for the coordination we're
all members actually of ali committees.
COUNCILMAN PENNY: We are the commissioners.
COUNCILMAN STOUTENBURGH: How about for the building?
COUNCILMAN PENNY: We're still' commissioners. We act as commissioners. There's
probably not a provision in the arrangements we have as commissioners to pass these
duties on to other people.
SUPERVISOR MURPHY: We're not passing to other people. We're dealing with other
people. Fine, we'll all do it.:

: I'd have to agree with Frank. I wouldn't mind seeing
Waste Plant. We've got six members. It's too much
back to all six at once.
SUPERVISOR MURPHY: And to try to get six people down there.
COUNCILMAN SCHONDEBARE: And six people to get down here to do it is too
cumbersome, too difficult. I'm one of those who's difficult and I plead guilty. I
think a committee would be worthwhile. Especial'ly if we're going with an attorney
to help us out. I think we'd have better communications. More centralized and a
tighter group who are handling it to get back to the rest of the Board. Right now
it's Jim McMahon, what he knows. It's Frank, what he knows. It's H2M. We have
maybe some of us from the Town Board on it and I think maybe it would be worth-
while. I agree with Frank.
COUNCILMAN PENNY: I have no problem. I would even volunteer to be on that
committee and I sometimes wonder that with all this discussions that no meetings
have been called, because I would have been very happy to attend many more
sessions of this organization down there, but have not having been called to do it.
SUPERVISOR MURPHY:

We were just called last Tuesday.
We were asked by H2M
I got a-letter from H2M and I told you I was leaving town,
Frank. I was out of town for the week. Before that there were no calls to meet
or do anything it.'
COUNCILMAN SCHONDEBARE: That's all water under the bridge or over the dam.
That's not going to do anything. Are we in~ favor of establishing a committee?
COUNCILMAN STOUTENBURGH: Yes.
COUNCILMAN SCHONDEBARE: Why don't we make a resolution, so move, second
and establish a committ'ee, and. then we'll appoint members to,the committ~ee from
the -Town- ~c~rd. · I will'.be a Town Board committee?
COUNCILMAN 'STOUTENBURGH: Only Town Board?
COUNCILMAN SCHONDEBARE: Well let's not start with people in:the community and
everything else and go no where.
SUPERVISOR MURPHY: It's the Town Board. A Town Board committee.
COUNCILMAN SCHONDEBARE: A standing committee of the Town Board.

RESOLVED that this meeting be and hereby is recessed at 7:55 P.M. for the purpose
of holding a p~ublic hearing at 8:00 P.M. on the use of the 1987 Community Development
Funds.

COUNCILWOMAN COCHRAN: I'd just like to. congratulate those that worked on the
acquisition of the Hartranft property. It's nic~ to see Joe Townsend, and Paul, no
matter what their politic:al affilitation, plus the public sector and what can happen
with everyone working together. Paul, I think it's great.
COUNCILMAN STOUTENBURGH: I think it was great too. The great was was that
little guy came in'here as cripPled up as he was, just beaming that he did:something
right.
SUPERVISOR MURPHY: He drove out in the snow.
COUNCILMAN STOUTENBURGH: They don't make them like that any more.
COUNClLWOMAI~ COCHRAN: And I wish everyone a Happy New Year.
SUPERVISOR MURPHY: A Happy New Year for everyone and a healthy one. A motion
