FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 2, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a waterfront neighborhood which consists of single family homes on sub-standard lots. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could center the house on the parcel after raising it. However, this would bring the house closer to the wetlands and the applicant would have to file for additional approvals from the DEC and Town trustees. The proposed location of the house is as far away as possible from the wetlands. 3. Town Law > 267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 57% relief from the code. However,the variance is for a second story addition and the existing side yard setback will not change. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. As an associated renovation, the applicants wish to renovate and modestly expand the habitable space on the 2nd floor by extending the existing 2nd story over the 1-story portion of the dwelling and covered porch/roof deck on the south side of the house; extending the same covered porch 5 feet to the east with a new roof deck above it; and adding a new entry porch and pergola to the front of the house. These renovations would result in only a 228 sf increase in lot coverage and would not result in a reduction to the dwelling's existing wetland setback, as the footprint expansions are located on the west (front) side"and southeast/southwest corners of the house, farthest from wetlands. And through the below described additionally incorporated mitigation measures, which are designed to protect and improve water quality and protect and restore the quality and function of the adjacent tidal wetland ecosystem, the project will have a net beneficial impact on the adjacent wetlands and waters of the Town: a. The existing conventional septic system will be removed and replaced with a low- nitrogen, innovative/alternative sanitary system (I/A OWTS) located more than 160 feet from wetlands, well outside Chapter 275 jurisdiction, which unlike conventional septic systems is designed to significantly reduce nitrogen loading into the groundwater table. b. A stormwater drainage system is proposed to capture and recharge potential runoff from the roofed dwelling, other impermeable surfaces, and the pervious gravel driveway. c. CARROLL&M.AMELIA MURPHY 230 INLET LANE GREENPORT,NY SCTM#1000-43-5-4 LWRP Policies 5& 6 The proposed renovations would result in only a 228 sf increase in lot coverage and would not result in a reduction to the dwelling's existing wetland setback, as the footprint expansions are located on the west (front) side and southeast/southwest corners of the house, farthest from wetlands. And through the below described additionally incorporated mitigation measures, which are designed to protect and improve water quality and protect and restore the quality and function of the adjacent tidal wetland ecosystem, the project will be consistent with Policies 5 and 6, respectively: a. The existing conventional septic system will be removed and replaced with a low-nitrogen, innovative/alternative sanitary system(UA OWTS) located more than 160 feet from wetlands, well outside Chapter 275 jurisdiction, which unlike conventional septic systems is designed to significantly reduce nitrogen loading into the groundwater table. b. A stormwater drainage system is proposed to capture and recharge potential runoff from the roofed dwelling, other impermeable surfaces, and the pervious gravel driveway. c. A 10' wide, approximately non-turf buffer area would be permanently established adjacent to the tidal wetland boundary adjacent to Gull Pond Inlet. d.
