WORK SESSION

9:00 A.M. - Senior Account Clerk Joan Richter met with the Board to discuss problems
which have been occuring with The Nortfi Fork Bank & Trust Co. concerning preparation
of payroll and various reports. Mrs. Richter stated that they have been unable to
resolve the problems and recommends the Board again' contract for the services of
Automatic Data Processing effective January 1st (see resolution no..22).
9:25 A'.M. - Town Plannin,~ Consultant David. Emilita met with the Board to discuss
the preparation of a legal notice for advertisement in the Sunday edition of The New
York Times for the services bfa Consulting Town Planner. Mr. Emilita reviewed the
necessary qualificatiions and will:submit 'a final draft to the Town Clerk for the advertise-
ment (see resolution no. '23).
9:50 A.M. - The Board discussed with ~uperintendent of Highways Jacobs the direction
they should proceed with respect to charging per yard fees for accepting brush and
construction debris 'at the Landfill:with or without the construction of a scale; Mr.
Jacobs stated that he had just spoken to Superintendent of Highways Lavelle of South-
ampton who said the installation of a scale is :the best thing they have ever done. Their
cost was approximately $150,000. Althbugh Supervisor Murphy and Councilmen Penny
and Stoutenburgh still' favor instituting a- per yard fee prior to the construction of a
scale, they agreed to accept the proposal of H2M to prepare specifications for bid for
a scale and related facilities at the Landfill, and requested Town Attorney Tasker to
prepare a bond resOlution for the December 2nd meeting (H2M-see resolution no. 27).
Mr. Tasker also advised the Board that to institute a fee for only brush a~id constructior
debris would be unreasonable, the fee should apply to everything that comes into the
Landfill.
10:15 A.M. Jeffrey G. Terry. met with the Board to review his:proposal prepared
at the request of the SuPervisor, for comPuterization 'of the Scavenger Waste Plant.
Supervisor Murphy advised the Board that over the past six' to eight months about
ten firms have been asked to visi't ;the plant and submit a proposal. This:is'the
only proposal received.' Mr. Terry proposes the purchase of an .AT&T microcompute
and Panasonic printer at a total equipment cost of $3:,980.00; database management
software at a cost of $995.00, and 250 hours estimated programming time, as well as
five hours of instruction at a cost of $2,500.00; The entire proposal includes the
installation and set-up of the system. Mrs. Corinne Bednoski, "clerk at the plant,
was also present and advised the Board that at the present time she generates over
a dozen day to day and monthly reports, as well as daily' record-keeping involving ...... ~'~
tax map numbers for the parcels where a system has been pumped. The computer ~:'.~.,
is a necessity since-Shelter~ Island is now coming into the system and this will'involve
doubling of the reports. The operating~licenses and. construction permits are issued
by the Town Clerk's office and a duplicate disR could be produced for delivery to
that office when a system is :installed at the Town Hall. The Board agreed to contract
for programming and consulting services of Mr. Terry (see resolution no. 31), and
'purchase the equipment.

11:45 P.M. - The Town Board disc.ussed engaging the services of an engineering
firm for co-c~mposting of munici:pal solid:waste and sludge at the Landfill~ They
have~ received proposals from Holzmacher, McLendon & Murrell, P.C., and Lockwood,
Kessler. & Bartlett. A straw vote was taken and Supervisor Murphy, Justice Edwards
and Councilman Schondebare-favored LKB.. Councilman Penny, Stoutenburgh and
Cochran favored H2M. In an effort to move forward with this lengthy project, Super-
visor Murphy, Justice Edwards 'and Councilman Schondebare agreed to engage the
services of H2M (see resolution no. 28).
EXECUTIVE SESSION
12:15 P.M. - Discussed posSible purchase of property, labor-management and personnel
matters.
1:00 P.M. - Recess for lunch.
2:00 P.M. - Rob Brown of Fairwe~ther-Brown, and Alan D. Kan of Pace Products,
Inc. met with the Board to discuss Mr. Brown's proposal for design retro, fit upgrading
of the Senior/Youth Center -building, and Mr. Kan's .proposal for application of silver-
leaf roof coating to t'he' building's roof. _T_h,e roofing material will be ordered, to be..~.
applied by Town personnel. - The~r~[ro-fi~[ :~g'~ading will: be ~6nsider~d at -a' later
date. Councilwoman Cochran brought 'to the Board's attention the immediate problem
of providing an out'side exit from the Accounting Department, which should be
addressed before further repairs to the Senior/Youth building.
2:30 P.M. - A. dolloh Westerlund, William Witske, and Tom Grattan appeared before the
Board to register their~comptaints concerning the location of the Dog Pound at Peconic~
The three gentlemen, residents of the immediate area, spoke abOut ~the barking dogs
during the middle of the night~ unhealthy conditions 'surrounding the pound, and their
fear for the safety of their;family when dogs escape. They said that before constructior
begins on the new kennel area, the Board should consider moving the pound to the
Landfill' area in Cutchogue where it 'had been several years ago. The majority of the
Board agreed that moving the complex would be good idea, and will investigate construct
ing the new kennel area at that site.
2:40 P.M. - Robert Schroeder, Sound Shore Excavating, met with the Board to protest
the increase in'the per yard price of sand from $2.50 to $3.50~ He asked that the
new fee be instituted on January 1st to permit 'contractors to fulfill their:contracts.
He has one contract alone which will' result inca $5,000 loss to him if the increase
stays at $3.50. Richard Corazzini, ":Paul Corazzini & Sons, an asphalt company, who
was also in attendance, said:he was basically present at thisrdiscussion only as an ~ ..
interested party, but feels it would be fair'to rescind the fee increase until ~he end
of the year (see resolutions no. 5, 6, 7, 8)'.
3:00 P.M. - The Board reviewed agenda resolutions-and off-agenda items.

SUPERVISOR MURPHY: Okay, tonight's kind of a special' night. We're starting our
Town Board meeting a half an hour early, and we have a special' program. and it's
the designation and .presentation by the Landmark Preservation Commission. I would
like to introduce the Landmark Commission Chairman John Stack, and to ask him to
introduce his members that are here tonight and to say a few wo~cls to us and then
we have special presentations to some special' people. Thank you, John.
JOHN A. STACK, Chairman, Southold Town Landmark Preservation Commission: It's
certainly nice to be here and it's nice to see you all here. i think this is a rather
momentous occasion. I look back and I see that within' five days it will be just four
years that the first notice of this law was published, and after all of the hearings on
the law the law was finally passed, and the Commit~'ee has worked quite hard to get
all the work done, and there's a lot of work involved.
I just came on about a year and a half ago.
Fortunately I'm on the Committee.
The main work was done by the people

before me. Ralph Williams. Please s~a]~,.~alph. Joy Bea , who is our Secretary,
and Bill Peters. Many of you have seen these people and have been i'n touch with
these people. It's been an interesting piece of work and we're very happy now that
we can bring it to fruition and have it:submitt'ed to the Board--recommend to the
Board that these houses be placed on the Southold Town Landmarks Register. And
that's what'the thing is 'ail about tonight, and we have asked you to come so that
you can receive certificates that we've had made for you, and we hope that they
will find a place of honor in;your home. I'm going to read these according to the
name of the house, because in· some instances there will~ be different people here
to pick them up.

SUPERVISOR MURPHY: We are looking to make our law stronger. We're in:the
process. We had quite a lengthy meeting today to discuss this;
MR. LUCE: In other words, so that he Could tear the building down if he wanted to?
SUPERVISOR MURPHY: We're trying to put some more teeth in our law.
MR. LUCE: Could we get a letter to that effect? Would the Town Board give us a
letter, or Building Department ....
SUPERVISOR MURPHY: I. think maybe as we develop more work and working with
the Town Attorney, with various people to strengthen our law, I think then we could
work with you and maybe just keep in-contact.
MR. STACK: Your interest is :to see that it stays that way, is that it?
MR. LUCE: Yes. Yes. We have no intentions of doing anything with it, but I'd
like to know what's going to happen in the.future.

SUPERVISOR MURPHY: Would all of those who got-a certifi~:ate, and the Committee,
come up and let the press take pictures. What we're trtying to do is 'stimulate interest.
The Landmarks Preservation Committee has been working extremely hard. We would
just ilke to have your input to work with this committee to please help them in their
work. I think it's very important that this ~goe~' on and we're trying to get a little
strength in our law, a little more teeth, so that what happened in Southold a couple
of weeks ago doesn't happen too often in the Town. Thank you very much and we
appreciate you're coming out tonight.

SUPERVISOR MURPHY: We would like to continue with our Town Board meeting.
Moving on to our first item .on the agenda is Reports. These reports, for anyone's

11. At this:.time-I would like to ask our Councilmen if"they have anything
special to report, starting on my right with George Penny.
COUNCILMAN PENNY: Yes, we had a very short span between Town Board meetings
and that' means very few other meetings. We met with one our attorneys, Frank
Yakaboski, :to discuss how to make some chan~es in our Landfill'ordinances. I had a
session on thle-~12th on police negotiations, and further budget review. And that was
about it.
SUPERVISOR MURPHY: Thank you, George. Jay?
COUNCILMAN SCHONDEBARE: Likewise, Frank, thank you. We attended the
meetin~ with Frank Yakaboski.; We also had a Police Committ'ee meeting this morning,
~d four: of us went down to Texas and I'ii let Somebody else who feels up to it 'make
their comments on going down to Texas on Monday and being back in'Town on Tuesday.
I don~t mind telling you on Tuesday morning we woke up and it was 33 degrees in
:Texas, and we got back to lslip:and it was in'~the 40's that night. So it was cold in'
Texas.
SUPERVISOR MURPHY: Paul?
COUNCILMAN STOUTENBURGH: Yes, Frank, on November 7th I sat in on a very
interesting meeting to show that things can come to a head after 30 years, believe
it or not. There was a piece of property down at the end of South Harbor Road
that was owned_by the Wortis Estate, and they wanted to.give it .to someone and it's
taken us exactly 30 years, and this ~is what Bob Tasker told me, because I wasn't
around there, but he said they've been trying to do this'for 30 years, and finally
we resolved that the Park District in Southold will: become owners of that beautiful
beach down there, and the Wortis" wili'get a small place that they will be able to keep -
their boat in; But it does show that there are some philanthropic people still around,
still' interested in this Town, and they have given a very valuable piece of property
to the Town for the Town's purposes, and I'm so glad to see this finally come to be.
I also went down to Texas. The concept here, for those in'the audience new~, is'that
we have to do something at our Landfill' with our-garbage, and one of the alternatives
we're looking into is composting, and we watched this'l~uge vessel, 10 feet in'diameter,
120 feet long, rotating very, very slowly. You could hardly detect it moving. Very
quietly, very. few people in the operation of it,' and that was the part I enjoyed mostly,
the simplicity of it, and pouring garbage in one end and the tailings, meaning the cans

and the things that were non-degradable, coming out the end, and a compost material,
which we're thinking very seriously',of~g~t~tinJg:,into. And it did'--there's many other
ramifications to this, but there were many'answers and there are still some answers
unanswered--questions, rather, unanswered. So it was a worthwhile trip I thought¢
even though it was rather a rushed one, and we took four planes to get down there
and to get back. That's about it,: Frank.
SUPERVISOR MURPHY: Thank you, Paul. Jean?
COUNCILWOMAN COCHRAN: Yes, I also attended the meeting on the 7th in: relation
to the Cooke property. Our Town Trustees were also--at least our President Henry
Smith, was also in attendance, because the Trustees do have some property there
and they will continue to have an area that will be used for mooring. As Paul said,
it has taken 30 years to get this far, and it 'does sound promising, but I ,will'wait
untii everything is finalized. Things can change. Also I went down to Texas with
members of the Town Board. and I Would like to say that I felt it was a worthwhile
expense as far as Town funds are concerned~ We had the opportunity to not only
vieTM this compostinq process, but as Paul said, to have our questions answered.
Aisc I think one of the things is it raised questions that we hadn't thought of in
relation to the organizational base, the financi.al base, clarifibations with the DEC.
So we came home with many more questions which I think is healthy. But ! would
like to say that it was worth every penny that the Town Board spent. Aisc in
addition I'd like to c_ompliment the Landmark CommisSion. I had the opportunity to
go out with them on Friday to inspect the old Edwards house in Orient. And let me
tell you, this 'is a dedicated bunch of people. I mean they climb--! think every Board
member should go just one day for this experience to see the dedication and interest
and the concern that they have. They climbed through cellars---we started at' 9:00
in:the morning and finished at 4:00 in the afternoon; It was one of the most run-'filled
days I've had in a long, long time. So my congratulations to. the Commission. Thank
you, Frank.
SUPERVISOR MURPHY: Thank you,. Jean. Judge Edwards?
JUSTICE EDWARDS: I thought Jean's fun-filled day was down in Tyler, Texas. We
did'go down to Tyler, Texas to look at the Eweson Composter, and there are still:a,
Iot~of questions unanswered. It was nice to see the operation. When we landed in
Dallas we had about a two and a half hour drive and ! got elected to drive one of the
cars, and I've never driven in' such a torrential' downpour i:n all my life--i don't know
who .w_.as driving the other car. Anway, that evening the people that ran,this plant
Uo~vn there took US' out'-fo~'dinner ~nd l:'~l~ink~the-~ajority of' the ~eoPl~"th'at went
~down there will agree that there's some of the 'fineSt oysters that We've ever had that
were put on the half-shell there. -~'They were delicious. This Wednesday at 6:00 o'clock
we're having a-drill of the nuclear power plant Millstone throughout the New London
area. There will be a Northeast Utility person, on Fishers Island, as well as a person
from the Federal Energy Management Association (FEMA) will be over there also just to
~heck~On ~our;operations ~n case of a nu_c_lea~'dis~ster. MillStone' is'running very Well
~'r tl~ere., has been fo'~, the past t~n years¢ "but we still have to abide by the govern-
ment's regulations of having a drill'once a year. At the next meeting I'll be able to
~ive you some more input on that d¢ill, next Wednesday. That's it~ Frank. Thank you.
SUPERVISOR MURPHY: Thank you, Ray. I would just like to add a little bit further.
I'm happy to-report that the Bud.~et, hopefully, will be adopted tonight, and it 'is
higher, I think than anyone on the'Town Bo'ard wants, but there's so many mandated
costs and costs that we really have lost control of, and we really can't do too much
about. The Town is. growing very rapidly. We're increasing in'our personnel.
Personnel services, just by (he way, amounts to about 50% of our budget, and so we
are growing and I congratulate the Town Board on, I think, doing an excellent job
on the budget, bringing it in' in a fair amount. No one likes to have a tax increase,
but mainly because of loss of Revenue Sharing, increased insurance costs, personnel
services it's necessary to have an increase, but I think it'~ a very fair'and a good
budget for the people. I would like to report that the final results of the hurricane
last year, all the brush that we picked up off the roads, many months of work, and
brought down to the Landfall'and .processed, now is being used. We're cleaning up
our sludge beds, and they're about 50% emptied, and we're using all this material
that we ground to absorb the moisture from the sludge beds. It's saving the Town a
fortune. To give you an idea, the Town of Southampton had to--~lean theirs by carting
them to a sewage treatment plant, and this cost is Cantastic. We're ending up with a
result that--a product that we could use in our Landfill in the final capping, and it's

very good. I think he echos all of our sentiments.

of the meeting there will be a time where anyone who would like to address the Town
Board can. So at this-time is there anyone would like to talk just on any of the

Town of Southold is amended as follows:
(2) On land within an AHD District containing more than ten (10) acres of

units [and] and/or unimproved lots therein, [to] shall be reserved for
sale or lease to moderate income families . [shall be as-follows:

Would like to see affordable housing it :would be myself, and I surely will: no~t~ stand
in the way of affordable housing in:this'Town. The only thing I do think is that
I have very strong convictions about the water supply in'this area, and think it's
very questional~le. Others do not, so therefore, 1'11 yield to this. I also don't like
the idea of a high density dumped in; or put in one person's backyard. I .would
much rather see the density spread throughout the Town. This would be another
reason I object_to this kind of a particular war that we're having here, which has

garages and any habitable area shall be included in' the calculation
Of floor area.
11. Subsections E and G of Section 100-144 [CertifiCates of Occupancy) are amended
to read as follows:
E. Every application for a certificate of occupancy or a temporary certificate
of occupancy shall be accompanied by the fee hereinafter specified. Copies
of such certificate will' be issued upon the payment of the fee hereinafter
specified.
G. Upon written request and upon payment of the fee hereinafter specified,
the Building Inspector shall, after in§pection, issue a certificate of
occupancy for any building or use thereof or of land existing at the
time of the adoption of this chapter, o.r any amendments thereto, certifying
such use and whether or not the same and the building conform to the
provisions of this chap.te.r.
Ill. Section 100-144 (certifiCates of occupancy) is hereby amended by adding a new
subsection thereto, to be subsection I, to read as follows:
I. CertifiCate of occupancy fees. The following fees shall be .paid'upon the
filing of an application with the Building Inspector for a certificate of
occupancy, which fees shall be paid into the general fund if the. application
is-approved, or retuFnea to the applicant if'the application is denied:
(a) BusineSs buildings and/or business uses and additions and alterations

dollars ($25.).

(f) Updated certificates of occupancy by reason of additions or alterations:

(g)Copies of certificates of occupancy issued five or less years ago:

SUPERVISOR MURPHY: See. Okay. You never know. Okay, that's the end of
the prepared and added-on agenda. We still' have about five minutes before the
official time for the first public hearing, and-it probably will be--the second one,
I imagine, might be a little lengthy, so if anyone would like to address the Town
Board at this time, please feel free to. I'd like to start on my left. On any matter
at all. Ed Siegmann. Please. use the mike and identify yourself. Thank you.
EDWARD SIEGMANN: You know, just seeing what 'you did'with Number 30, where
you say that you're correcting--a mistake was made on the original map--I assume
you're talking about the map that hasn't been accepted by the public yet, is that
correct ?
SUPERVISOR MURPHY: That's true.
MR. SIEGMANN~' Well, is 'it possible the question that we raised, and nobody seems
to be able to give us an an.swer, of why the zone was changed from the firSt map
that you published, on the second map there was a change. Is it possible that that
was a mistake also, and that the change back to two acre can be covered the same

SUPERVISOR MURPHY: No, Ed, il?~"~an~i~t[i~e|~--this had been changed previously
from the original' map that was submitted by RPPW was changed in the p~o_cess--I
believe a couple times. I'm not sure exactly when it was, but it 'was changed. What
we're doing tonight was a line change. 11~ was drawn incorrectly. The property line
wasn't distinguishable on the map, and the draftsman missed the property line, and
all we're doing--it's a minor change--it's an existing business that would be zoned
busi nes s.
MR. SIEGMANN: Well, since we still'do not ha~e an answer of why those maps
chanqed from one to three or one to two, whatever it is, I would assume, that that
coulc[ be considered' a mistake also, and that mistake could be corrected, instead of
folio.wing along the lines of that agreement that you had among yourselves.
SUPERVISOR MURPHY: We have asked RPPW to look up and see exactly when that
was changed, and who authorized it, and hopefully we'll have an answer.
MR. SIEGMANN: And you'll let us know what happened?
SUPERVISOR MURPHY: Yes.
MR. SIEGMANN: Okay, thank you.
SUPERVISOR MURPHY: Anyone else like to address the Town Board on the left on
any matter at all? In the middle, anyone like to address the Town Board? Over on
the right? Yes, sir.
SAUL MILLMAN: My name is'Saul Millm~n. I own the property on Horton Lane that
is :supp6sed to have an alleged unsafe building, and I have until 'the 21st of November
to demolish and make it disappear. I am working with Chief Westerlund of the Southold
Fire Department to have a controlled practice fire there. He's working getting the
papers and all the information.- In the mean time I do have a demolition permit from
the Building Deparl~ment. I just spoke to Chief Westerlund this 'evening and he needs
about roughly another week, maybe two weeks at the most, I guess, to get all the ~
proper papers to have a practice fire. Is it possible to get an extension of time pa~t
November 21st from the Town Board?
SUPERVISOR MURPHY: Does anyone have any objection to grant a two week extension?
COUNCILWOMAN COCHRAN: i don't.
SUPERVISOR MURPHY:- I ap'preciate your cooperation, and I realize it :does take time
for this type of permit from .the Fire Department. Anyone objecting to this?
COUNCILWOMAN COCHRAN: Specify a definite time.
TOWN ATTORNEY TASKER: You need a ~esolution.' ........ -~ - '-
SUPERVISOR MURPHY: We'll adopt a resolution after. How much time do you feel
you need ?
MR. MILLMAN:- t'd say' two weeks after the 21st. If. it's not quite adequate then
I will notify the Town Board before that.
SUPERVISOR MURPHY: Okay, and maybe ask the Chief to contact Victor Lessard
too. We'll give you three weeks.
MR. MILLMAN: The Chief just spoke to Victor ten minutes ago.
SUPERVISOR MURPHY: Okay., we'll give you three weeks and that should give you
ample time.
MR. MILLMAN: Fine.
SUPERVISOR MURPHY: Okay, we'll have a resolution on it after. Thank you for
your cooperation. Anyone else on the right? Okay, it'~ 7:55 and I'd like to have
a resolution to recess to hold a public hearing.

RESOLVED that a recess be called at this time..7:55 P.M., for the purpose of holding
two public hearings: Proposed "Local Law in' relation to wetland application fees,"
and the ~Final Environmental Impact Statement with regard to the proposed change of
zone by Howard Zehner, d /b/a Youngs Boat Yard & Marina (formerly Southport
Development).

WHEREAS, a proposed Local Law No. 15 - 1986 was introduced at a m~eting of
this Board held ont he 6th day of November, 1986, and

November, 1986, at which time all interested persons were given an opportunity
to be heard thereon, now, therefore, be it
RESOLVED that Local Law No. 15 --1986 be enacted as follows:

A Local Law in Relation to Wetlands Permit Fees
BE IT ENACTED by the Town Board of the Town of Southold as follows:
Chapter 97 (Wetlands) Of the Code of the Town of Southold is hereby amended
as follows:
I. Section, 97-23A thereof is amended to read as follows:
97-23. Fees
A. Every application for a permit 'filed with the Clerk Shall be
accompanied by a filing fee of one hundred fifty ($150.)
dollars, no portion of which shall be refundable.
II. This Local Law shall take effect upon its filing with the Secretary of State.

WHEREAS, the Town Board of-the Town of Southold at a regular meeting l~eld on
October 21, 1986, adopted a resolution determinin~ and orderin9 that Saul and Janet
Millman, the owners of a builcJir~l on Horton 1L~ne,'.~outhold~ shall' erect a six' (6) ' '
foot high chain' link fence a'round the immediate area o'f the building, acceptable and
approved by the Building Inspector, within fifteen (15) days from October 21, 1986,
and the owners of the building or structure on said premises shall make safe, to the
appr. oval of the Building Inspector, or remove the buildin~ or structure on said:
premises on or before the- 21st day of November:, ,1986, and -
~/HEREAS, Saul Millman appeared before the Southold Town Board, at their regular
.meeti. ng held on November 18, 1986, and requested additional time to allow the Southold
Fire Department to obtain: the necessary permits to conduct a controlled burning .of the

RESOLVED that the Town Board of the Town of Southoid'hereby grants Saul and
Janet Miliman until December 12, 1986 to remove the buildin9 or structure on their

RESOLVED that on and after December 12, 1986 all bf the conditions of the Resolution
of the Southold Town Board, adopted on October 21, 1986, and mailed to Saul and
Janet Millman by Registered Mail, Return Receipt, shall become effective and the
Supervisor and the Town Board shall take the necessary steps to remove the building
or structure and the cost' and expense for same Shall be 'collected by the Town of
Southold in the manner provided for in Section 90-9 of the Code of the Town of

to the Board that doesn't have anything to do with anything that's on the agenda
tonight.-

MS. SHAW: Now? Okay.
COUNCILMAN SCHONDEBARE: Provided it's short.
MS. SHAW: This is Valerie.:Scopaz Shaw. I'm a resident of Mattituck. I have a
question that I Would like tO ask the Board about a law that was passed by the
Board a few months .ago, to the best of my recollection. It happens to be Local Law
No. 5 in relation to Bed and Breakfast facilites, and I picked up a copy of this
from the Town Clerk's Office, and I'm a little unsure as to what the meaning of it
is, and l'm just wondering if ! could ask for an interpretation as to what's being
meant.

MS. SHAW: Okay. The first question is, that my understanding is that the Board
of Appeals ultimately has to consider the two items that are mentioned under Sub-
section 16, which is that there should not be more than three rooms in the owner-
occupied dwelling, and cannot be more than six casual and transient roomers, and
that the only other condition attached to that is that adequate off-street parking
spaces shall be provided for the rented rooms, in addition to parking spaces for
the use of family of the owner~ Is.. that the only conditions that the Board of Appeals
must consider?
TOWN ATTORNEY TASKER: ! think it's a Special Exception, isn't it?
MS. SHAW: Yes. ~ ~. ,
TOWN ATTORNEY TASK~ER: -There is a whole section in the Town Code, other than
this, where there are general conditions that must be met, and general criteria that
must be considered, and it's in another section of the Code.
MS. SHAW: Okay. That will explain my confusion. Okay. My second question~is
this: What happens if the proposal or the request for the Special Exception is for
Bed and Breakfast within a private community where road access is over a private
right-of-way, as opposed to a public street?
TOWN ATTORNEY TASKER: What happens?
MS. SHAW: In other words, can the Board of Appeals entertain a request for a~
Special Exception where access to the dwelling is over a private right-of-way, as
opposed to a public--dedicated public street? In other words---
TOWN ATTORNEY TASKER: There's nothing in the Code which prohibits them from
considering that.
MS. SHAW: I'm sorry--~-
TOWN ATTORNEY TASKER: There is no prohibition against them considering such
an application.
MS. SHAW: ! realize that. What I'm asking is, can the Board of Appeals grant
permission--can the Board of Appeals grant a Special' Exception in a situation where
the access to the dwelling is not over a public street? Over private property?
TOWN ATTORNEY TASKER: I just finished' telling you that there is nothing in~the
Code which says they may not do this, so therefore, I would say that since there is
nothing that prohibits it, it'S not prohibited for them to consider one of these things
with access over a private right-of-way. Do I make myself clear?
MS. SHAW: It's not completely clear. Well, because---
TOWN ATTORNEY TASKER: There is nothing---let me put it this way--t-there is
nothing in the Code that says that the Board of Appeals, in'considering an application
for a Bed and Breakfast, cannot consider it if'its access is over a private right-of-
way. There's nothing like that in'the Code. So that doesn't preclude them from
granting one.
MS. SHAW: Well, I understand the Board of Appeals can consider any application
that comes before it. The question is; does the Code address the issue--does it
discriminate between, for instance, in a situation '~vhere there is no public access?
Is' there any requirements that the communitY--the private community which the
applicant is asking for permission--I'm just asking whether there's anything---
TOWN ATTORNEY TASKER: To my knowledge there's nothing specific in'the Zoning
Code which says that the Board of Appeals cannot grant a Bed and Breakfast permit
if the only access to the facility is over a private right-of-way. Okay?
MS. SHAW: Okay. Is the Board of Appeals required to obtain any sort of--or is
the applicant required to obtain a waiver from the Planning Board to waiver conditions
that the Planning Board may have placed on the map specifying that---
TOWN ATTORNEY TASKER: You're going .far afield here.
COUNCILMAN SCHONDEBARE: Valerie, I have a funny feeling, Valerie, that this
is not a hypothetical question on hypothetical issues, and that you've got a specific
case going before the ZBA.
MS. SHAW: Right.

COUNCILMAN SCHONDEBARE: Well, then I really think it's not quite fair'to both
parties in that matter before the ZBA to be coming before the Town Boar,,d...;,.and asking
the Tgwn Attorney questions relating to a matter going before the ZBA. '
MS. SHAW: Okay. I didn't mean for this to be interpreted as a---I'm not baiting
anybody, okay? I just wanted to know. From my reading of the law it wasn't clear
to me. I thought--and evidentially from what Mr. Tasker is say. ng, it's an open
question--a legal question. Okay?
TOWN ATTORNEY TASKER: No, I didn't say that either. This is the problem with
hypotheticals. I didn't say it was an open question. You asked me if tl~ere was any
prohibition in the Code, and I said I know of none. That doesn't make it an open
question.
MS. SHAW: Okay, I'm not arguing with that. I'm sorry. I this has been mis-
interpreted, and I apologize' if'this 'is being interpreted that it 'was. I'm just
simply asking for an interpretation as to what this meant. I'm not putting a
hypothetical question---
TOWN ATTORNEY TASKER: Well, you read the provision from the Code of the -
conditions. Did anything say anything about a private right-of-way? No. As
Jay just said, I think you have a concrete case and you want to brinq it ~in here
and get answers by posing abstract questions and then take-it back t-o the ZBA.
MS. SHAW: Well, it's not--if I may explain' this ~ further---
SUPERVISOR MURPHY: Va|erie, really I don!t think this is~the place for you to be
doing this. If you would have a question maybe you should stop in and talk to-the
Town Attorney some time. Make an appointment.
MS. SHAW: Okay, would that be a possibility.
TOWN ATTORNEY TASKER: Sure, you can make it right after this meeting. But
i don't think it's a proper approach in a public forum to start out with i~ypothetical
questions when .n fact you really nave a concrete issue and you want me to give
answers to l~ypotheticals which will be turned around l lthink.
