Southold Town Clerk ZBA FILE: #7638 NAME OF APPLICANT: Karibu, LLC/Pascal Shaary PROPERTY LOCATION: 90 Kimberly Lane, Southold, NY SCTM#1000-70-13-20.20 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25,and the Suffolk County Department of Planning issued its reply dated February 23, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 47,311 square foot lot located in the R- 40 Zoning District. The northerly property line measures 295.00 feet and is adjacent to Pine Neck Road,the easterly property line measures 125.00 feet and is adjacent to Kimberly Lane, the southerly property line measures 315.92 feet and the westerly property line measures 150.05 feet. The property is a corner lot. The property is improved with a two-story frame residence with an attached two-car garage and deck. There is an inground swimming pool located at the rear of the house but in a technical side yard because of two road frontages, along with an existing wood frame 20.5 feet x 16.4 feet storage shed pool house adjacent to the. swimming pool as shown on the survey prepared by Paul Barylski, L.S., and dated March 25, 2021. BASIS OF APPLICATION: Request for Variances from Article III, Section280-15 and the Building Inspector's December 9, 2021, Amended January 19, 2022 Notice of Disapproval based on an application for a permit to construct a new accessory storage shed, construct an accessory hot tub (jacuzzi), and to legalize the conversion of a storage shed into pool house at; 1)jacuzzi located in other than the code permitted rear yard; 2) storage shed/pool house located in other than the code permitted rear yard; 3) In addition, the applicant seek to lift the ZBA condition (File No. 3902) that states that the existing storage shed can only be used for storage purposes and only have electricity; located at 90 Kimberly Lane, Southold,NY. SCTM#1000-70-13-20.20 Page 2,June 16,2022 #7638, Karibu,LLC SCTM No. 1000-70-13-20.2 RELIEF REQUESTED: To construct an accessory storage shed and accessory jacuzzi, in a side yard where code requires a rear yard location, and to legalize the conversion of a storage shed into pool house which is not permitted pursuant to Condition 43 of ZBA File#3902 which states: "That the accessory structure only be used for storage purposed and only to have electricity." The Site Plan indicates the pool house use and shows the structure having its own septic system. ADDITIONAL INFORMATION: As stated previously,the parcel is a corner lot with two front yards. The existing shed was granted a front yard variance#3902 and has a Certificate of Occupancy dated July 11, 1990. The Code has changed that now the location of the shed is conforming and because of the prior conditions placed on the use of the shed now requires a variance for a conversion to a pool house. The proposed jacuzzi is proposed to be located behind the dwelling but the new covered porch(BP 447167 issued 12-221)places the jacuzzi in a side yard. This, again, is a technical variance. All of the variances applied for are technical variances due to a corner lot with the location of the existing dwelling. The applicant will install a new septic system for the pool house if approved. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 2, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. This residence is located in a subdivision with many luxury homes that have amenities such as pool houses, hot tubs and storage sheds. This property is heavily vegetated so the pool and existing shed cannot be seen from Pine Neck Road. The proposed new shed will be located next to the driveway along the heavily screened property and will be used only for storage 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property is burdened with two front yards which places the proposed storage shed in both a front and side yard and the addition of the proposed screen porch on the rear of the house technically places a proposed jacuzzi partially in a side yard No access is permitted onto North Bayview Road or Pine Neck Road from the subject property. The only access is from Kimberly Lane which is a subdivision road. 3. Town Law §267-b(3)(b)(3). The variances granted herein are mathematically substantial. The location of the hot tub and storage shed/pool house both represent 100% relief from the code. The variance relief for lifting the condition on the existing shed to allow it to be converted to a pool house required Zoning Board of Appeals approval. Is also mathematically substantial representing 100%. However no adverse impacts will occur as a result of these variances on a lot with two road frontages. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a pool house,jacuzzi, and new storage shed while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Planamento,and duly carried, to GRANT the variances as applied for, and shown on the Site Plan (Sheet S-1) prepared by Mark Kevin Schwartz, Architect and dated January 14, 2022 and rescind condition #3 in ZBA#3902 (dated 12/15/90) SUBJECT TO THE FOLLOWING CONDITIONS: 1. A new septic system shall be installed to service conversion of the existing storage shed to the proposed pool house 2. No kitchen or cooking area shall be installed in the pool house. 3. Only a sauna, half bath and changing room is permitted in the pool house(no indoor shower) This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and mcT require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk, within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. In your letter, you explain that the original location of the proposed shed, located 23.4 feet from the side yard property line,was incorrectly shown on the approved site plan. Furthermore, you explain that the proposed shed will be too close to the pool fence and too far from Pine Nick Road where it would be visible from Kimberly Lane. Pine Neck Road is adjacent to the lot but the lot does not have direct access on Pine Neck Road. The shed remains hidden from all the roads. By this application, appellant requests an interpretation and a variance approving a 215 ft. long by 85 feet deep, and to locate a new principal dwelling structure as shown on the September 21, 1988 Survey Map prepared by Peconic Surveyors & Engineers, P.C. with setbacks shown as follows: (a) 70 feet from the northerly front property line along Pine Neck Road; (b) 50 feet from the easterly front property line along Kimberly Lane; (c) 223+- feet from the front property line along North Bayview Road; (d) 15 feet from the southerly property line along Lot No. 19. 5. Article XI, Section 100-119 of the Zoning Code provides as follows: CORNER LOTS. (Amended 2-1-1983) . On a corner lot, front yards are required on both street frontages, and one (1) yard other than the front yards shall be deemed to be a rear yard, and the other or others, side yards. No obstruction shall be erected or maintained at street intersections within the triangle formed by the street lines of such lot and a line drawn between points along such street lines thirty (30) feet distant from their point of intersec- tion. 6, Article III, Section 100-31, Column "A-40" of the Bulk Schedule, of the Zoning Code, requires minimum: (a) front yards at 50 feet each; (b) rear yard at 50 feet; (c) minimum sideyard at 15 feet; (d) total side yards at 35 feet. 7. Also noted in the subdivision records and the survey map are the restrictions for "natural state" buffers within 20 feet of the front property lines along North Bayview Road and Pine Neck Road, and the requirement for no access off of Pine Neck Road or North Bayview Road. 8. Also noted is the fact that some time subsequent to the filing of the variance application and prior to the hearing of this application, a foundation was constructed without the issuance of a Building Permit.
