SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 thru A 14-25, and the Suffolk County Department of Planning issued its reply dated January 19, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated May 27, 2022. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available, it is recommended that the proposed action is INCONSISTENT with LWRP policy standards and is therefore INCONSISTENT with the LWRP. Policy 1. Foster a pattern of development of the Town of Southold that. Enhances community character,preserves open space, makes efficient use of infrastructure, makes beneficial use of a. coastal location, and minimizes adverse effects of development. The (as-built) structures are not supported by this policy as it does not enhance community character and sets precedent contrary to the Board's procedures and authority. With the submission of the Zoning Board of Appeals application and approval by the Board to grant the expansion of the pre-existing non-conforming uses, the"as built"actions can therefore become CONSISTENT with the LWRP. PROPERTY FACTS/DESCMPTION: The subject property is a non-conforming 11,954 square-foot lot located in the R-40 Zoning District. The northerly property line measures 27.31 feet, then slopes east at 29.79 feet,then drops southerly 72.16 feet,then east 34.00 feet then northerly at 50.24 feet, and is adjacent to East Creek(Eugene Creek). The easterly property line measures 146.80 feet, the southerly property line measures 98.11 feet and is adjacent to Fleetwood Road and the westerly property line measures 173.22 feet. The property is improved with two single-family dwellings (aka as Cottage 41 and Cottage #2). Cottage #1 is located on the easterly portion of the property and is approximately 875 square feet with an attached wooden deck at the rear of the frame dwelling. The rear yard is very close to wetlands as shown on the survey map prepared by John T. Metgzer.LS and dated October 29,2005 along with floor plan drawings of the two dwellings prepared by Louis Schwartz, PE, and dated February 11, 2021. BASIS OF APPLICATION: Request for Variances from Article XXIII, Sections 280-123; Article XXIII, Section 280-124; and the Building Inspector's November 30, 2021 Notice of Disapproval based on an application for a permit to legalize "as built" alterations (convert screen porch to living space, new heat, waterside deck) to an existing seasonal cottage known as Cottage #1 and legalize "as built" alterations (convert screen porch to living space, new heat)to an existing seasonal cottage known as Cottage#2, at; 1) Cottage# 1 and#2 nonconforming uses shall not be enlarge, reconstructed, or structurally altered or moved unless the use of such building are changed to a conforming use; 2) Cottage 41, located less than the code required minimum side yard setback of 10 feet; located at : 910 Fleetwood Road, (Adj. to East Creek) Cutchogue,NY. SCTM#1000-137-4-22. RELIEF REQUESTED: The applicant requests variances to permit as built alterations to Cottage #1, east structure: (convert screen porch to living space; new heat; waterside deck) to an existing seasonal cottage and Cottage#2,west structure: legalize"as built"alteration(convert screen porch to living space;new heat) to an existing seasonal cottage at: 910 Fleetwood Road, Cutchogue, NY. SCTM#1000-137-4-22. The as built construction,on this non-conforming 11954 square foot lot in the R-40 Zoning District, is not allowed pursuant to Article XXIII, Section 280-123, Article XXIII, Section 280-124 which states; "A nonconforming building containing a non-conforming use shall not be enlarged, reconstructed, or structurally altered or moved, except as set forth below: unless the use of such building is changed toa conforming use." Additionally, the as built deck on cottage#1 is not permitted pursuant to Article XXIII, Section 280-123,Article XXIII, Section 280-124 which states: lots measuring less than 20,000 square feet in total size require a minimum side yard setback of 10 feet. The survey shows the existing deck to be located at 8.8 feet of the side yard property line. ADDITIONAL INFORMATION: During the Public Hearing held on June 2,2022 the applicant's husband, Mr. Maye,told the Board that Mrs. Maye inherited this property from her aunt who purchased the property in 1974. Between 1974 and 1976 work was performed on the two cottages to convert them from seasonal to year-round dwellings as confirmed by the Certificate of Occupancy issued by Southold Town Building Department in August of 1976. The Building Inspector stated that both dwellings had heating installed and conform to the Town Code. The applicant simply wishes to legalize the improvements that were made in order to receive a rental permit from the Town. As to the "as built deck" on cottage #l, the applicant estimates the work was done in the early 2000s. They are seeking a variance for the side yard setback of 1.2 feet. Southold Board of Trustees approved the deck application September 20, 2021. In 2018 the previous owner,Mrs. Maye's aunt, received Southold Board of Trustee approval for an"as built" 8 feet by 8 feet shed and (2) 6 feet. x 6 feet panels installed between the shed and bulkhead. There was a condition on this approval that the owner establish and subsequently maintain a 10 ft. wide non-turf buffer area along the landward edge of the bulkhead which has not been done. . FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 2,2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(I). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The cottages have existed in this Page 3,June 16,2022 #7626, Maye SCTM No. 1000-137-4-22 community for many years. The neighborhood was a summer community and almost all the cottages s have been converted to year-round dwellings. Many of the lots in the community are also non-conforming. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant inherited the property and wishes to legalize the previous work. 3. Town Law X267-b(3)(b)(3). The variances granted herein for altering two pre-existing nonconforming dwelling units are mathematically substantial, representing 100% relief from the code. The side yard setback relief is substantial representing 12% relief from the code. However, these two cottages have not enlarged their existing footprints and have existed on the subject property and continuously inhabited for decades as part of the community character. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has not been self-created. The applicant inherited the property without knowledge of previous work. 6.Town Law&267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of the two cottages while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Dantes, and duly carried,to GRANT the variances as applied for,and shown on the survey map prepared by John T. Metgzer, LS and dated October 29, 2005 and floor plan drawings prepared by Louis Schwartz, PE and dated February 11, 2021. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant/owner must submit evidence to the Zoning Board of Appeals and the Southold Town Building Department that current Suffolk County Department of Health Services septic system standards have been met, or in the alternative,make application to the Suffolk County Department of Health Services to install an approved upgraded septic system. 2. The 2018 condition of the Southold Board of Trustees for a 10 foot wide non-turf buffer area along the landward edge of the bulkhead shall be installed. 3. The wooden deck on Cottage#I shall remain open to the sky. 4. No further enlargement of the two cottages/dwellings shall be permitted without Zoning Board of Appeals approval. 5. Only Off-Street, On-Site parking shall be allowed for subject property. 6. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s)within 90 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s) and submit same to the Office of the Zoning Board of Appeals within 12 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a Certificate of occupancy in the time allotted. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. IMPORTANT TIME LIMITS ON THIS APPROVAL Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. In August 2023,we also made application to Health Service to be awarded a.grant under the Septic Improvement Program. To date,.that application is-still under review and they can not provide a time frame.A contractor cannot remove the existing system or install a new one until awarded. My name is James Maye and I am acting as an agent for myj wife Jenn Maye,who is the owner of the property and is also here with me today. Just a brief history, the property was recently inherited from Jenn's Aunt, who purchased the property in 1974. The property consists of two dwellings, known as 835 &875 in the application. Between 1974 and 1976, there was work performed on the two cottages on the property to convert them from seasonal to year round dwellings. We do not have records of exactly what work was completed or the exact timing, but we do have a record of the CO that was issued by the building inspector in 1976 as well as a supplemental letter from the same time from the Building Inspector, both of which are included in your packets. The letter indicates that the cottages had heat systems installed in every room and the dwellings were found to comply with Housing Code for one-family occupancy. The designation of the two dwellings as year round dwellings is also indicated on the property card and tax bill. In the process of applying for updated rental permits after taking ownership,the building inspector noted there were updates to the property including new windows and doors,and a newer heat system. We are seeking approval of the non conforming work that was completed many years ago so the dwellings can continue their existing use and we can obtain updated rental permits. With respect to item#2,the as built deck,our best estimation is the "as-built" deck was installed in early 2000s, since it is indicated on the survey and still in good condition. We are seeking 1.2ft of setback variance and approval of the work. We received Trustee approval for the deck last year. This is a narrow lot, among other narrow lots on Fleetwood Rd.,that have structures that do not meet setback requirements. It has been in place for many years and hasn't changed the character of the neighborhood as many houses have waterside decks too. Lastly,just for clarification to the public, we are not seeking to add or modify the property in any way. We simply want to get approval for work that was done under previous ownership many years ago and be in good standing as property owners. My wife's family has been coming to the North Fork for over 70 years and we also own a historical home on Little Neck Rd where we reside with our children every summer. It should not be considered until after it is completed. It is not clear from the contents of this application what was on the property prior to zoning and what was added recently that is now requested to be permitted. Applicant claims that the subject property is located in a neighborhood with similar structures and setbacks. Only 1 other property in the neighborhood has 2 houses, and no evidence is presented to prove that that property is being used in a legal way. Two rental houses on a single small lot is not typical of Fleetwood Road's neighborhood character. Every property on the creek is connected by sharing an uncommonly valuable, common natural resource. This property is one of the most environmentally sensitive, and most overdeveloped,properties in the neighborhood. The neighbors to the East are tenants. On the marshes to the West,the neighbors are wild maritime plants and animals unable to represent their own interests. The undeveloped parcels to the West are parts of�mproved parcels on the landward side of Fleetwood Road. As the two cottages have been used as rentals, the driveways have been used for purposes other than parking. Vehicles have been parked on the side of, and in, Fleetwood Road. At least one family that recently rented half of the subject property used the property immediately on the other side of Fleetwood for parking and for boat storage. Is that property separate and buildable? In the Questionnaire for Filing with your ZBA Application , Question H is partly answered in the affirmative but the answer was not completed. The application does not include any permit from the Trustees for the cottages which are the principal uses of the property. If the applications for the permits for the deck, shed and wall were missing information, or contained false information, regarding the principal uses,the permits for the deck, shed and wall should be revoked. -7 The subject application does not include any permit for the bulkhead and the floating dock which were installed sometime within the past decade. The survey submitted dated 2005 does not show any bulkhead. Boards installed when the channel was dredged thru the salt marsh no longer exist. The boards that existed before the bulkhead was installed were only a few and they were rotted and broken. When the bulkhead was built there was nothing but air behind it. The Trustee Permit for the shed states that it is specially conditioned on establishment and maintenance of a 10' wide non turf buffer area along the landward edge of the bulkhead. Turf is the only thing planted and maintained right up to the bulkhead. If the cottages were winterized it may have been only very recently. When I knew the tenant living in the East cottage the utilities were not functioning. There was no water in the "kitchen" sink. In winter, space heaters were used to maintain livable air temperatures despite poor windows and doors. The crawl space under the"East structure"where the utility systems were located did not have a floor and was unsuitable for year round use. The Certificate of Occupancy dated 1974 was for two summer cottages. The Certificate dated 1976 is for two one family dwellings. Were the cottages occupied by separate families before zoning was established?Were the cottages occupied year round before zoning was established?Were the cottages used as rentals before zoning was established?If the variances are not granted will the cottages be approved for rental permits? There was only a single water service supplying both residences. Doesn't the Town have a duty to determine how separate tenancies will be charged for water and gas supplied?The survey submitted dated 2005 does not show any solid waste disposal system. Do the cottages have separate cesspools? The application appears to be for an area variance for a corner of a deck extending only 15"past the required 10ft setback. The legal standard for an area variance is a balance of the real harm to the neighbors vs the real benefit to the property owner. The legal standard for an area variance is not to balance the benefit the property owner imagines. Removing the nonconforming corner of the deck would improve the property as well as the neighborhood. The cottages may be the houses in the neighborhood closest to the creek and to the road. In contrast to the applicant's claim that the neighborhood would not be damaged by the requested variances,reasonable people who inspect the property and the neighborhood would surely find that the property and the neighborhood would be improved if at least one of the cottages were removed or moved across the road. This application requesting variances for as built alterations and expansions of non-conforming uses in unpermitted buildings should be denied. Granting it would be the first step towards future alterations and expansions. At least, if any permit is granted it should be made absolutely clear that no future expansion will be allowed. If a variance is granted, it should only be conditioned on compliance with enforceable land management standards. If such standards do not currently exist then the ZBA can create them. If Southold Town Board has not properly considered the relative environmental impacts of seasonal use by a single family of owners vs year round use by multiple families of tenants, Southold Town ZBA may have obligations to do so here.
