A 50' wide naturally vegetated buffer zone adjacent to the tidal wetlands boundary shall remain undisturbed with the exception of the 6' wide path. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That ff future operations of the Town of Southold require the removal and/or alterations in the lOcation of the work herein authorized, or if, in the opinion of the Board of TruStee% the work shall cause unreasonable obstrucuon to free navigation, the said Permittee will be required, upon due notice, to remove or. alter 'this work or project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee ot the completion of the work auth- orized. 9. Box 1179 Southold, New York 1 t971 Fax (516) 765-1823 Telephone (516) 765-1800 August 27, 1990 Roy Haje, President en-Consultants, Inc. 1329 North Sea Road Southampton, NY 11968 Re: Thomas Zukas, SCTM %1000-76-3-23.1 Dear Mr. Haje: The following action was taken by the Board of Town Trustees during its regular meeting held on August 23, 1990 regarding the above matter: WHEREAS, ROY HAJE IN BEHALF OF THOMAS ZUKAS applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated June 27, 1990 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on August 23, 1990 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED THAT ROY HAJE IN BEHALF OF THOMAS ZUKAS BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: Construct a timber dock consisting of a 4' X 10' upland inclind ramp; 4' x 15' fixed elevated (3.5 above grade of marsh) walk; a 4' X 14' hinged ramp; a 6' X 20' float secured by (2) 8" diameter.pilings. This permit will expire two years from the date it is signed if work has not commenced by said date. Fees must be paid, if applicable, and permit issued within six months of the date of this notifiCation. Two inspections are required and the Trustees are to be notified upon completion of said project. Please return to the Building Department for a determination on the need for any other permits which may be required for this project. Box 1179 Southold, New York 11971 To: From: Dated: Re: SOUTHOLD TOWN CONS ERVATION ADVISORY Southold Town Trustees Southold Town CAC July 25, 1990 Wetland Applications Recommendations The CAC made the following recommendations at its meeting .of July 19, 1990: RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 6-4-90-35-3-p/o 12.5 & 12.6 of John Braider. The CAC disapproves the requested 354 ' of timber retaining wall because no need is demonstrated. The CAC suggests a natural planting of spartina in "cleared area" would prevent any fruther erosion and any leaching into the pond. The CAC recommends approval of the proposed floats. Foot of Gull Pond, Greenport Vote of Council: Ayes: All Motion carried. Wetland Application No. 6-3-90-87-5-1 of Howard Ludecker was tabled. Wetland Application No. 6-2-90-106-4-1 of Sebastian Cove Property Owners Assoc. was tabled. RESOVLED to recommend to the Southold Town Trustees approval of Wetland Application No. 6-6-90-76-3-23.1 of Thomas Zukas to construct a dock and float. The CAC approves provided the dock does not extend into the creek as to block navigation. The matter of nonjurisdiction cannot be determined since the location of the well and sanitary system was not provided. Smith Drive South, Southold Vote'of Council: Ayes: All Motion carried RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 7-1-90-81-1-19 of William Griffo to construct two groins. The CAC recommends disapproval because the establishment of groins is bad not in the best interests of the environment, groins create problems and exacerbate a bad situation. Basin Road, Southold Vote of Council: Ayes: All Motion carried. Regarding the Larry T'~tl"iitl application no. 1-14-90-117-5-46.
