The following action was taken by the Southold Town Board of
Trustees at the regular meeting on July 29,'1993:
RESOLVED that the Southold Town Board of Trustees grants a
waiver to clear a 6' wide pathto the open pile dock. A 50' wide
naturally vegetated buffer zone adjacent to the tidal wetlands
boundary shall remain undisturbed with the exception of the 6'
wide path.
Dock must be placed along land within 90 days of the meeting or
all permits will be revoked.

To construct a timber dock consisting of a 4' X 10' upland
inclined ramp; 4' X 15' fixed elevated (3.5 above grade of
marsh) walk; a 4' X 14' hinged ramp; a 6' X 207 float
ba~l (2) 8" diameter pilings.
in accordance with the detailed specifications as presented in
the originating application.
IN WITNESS WHEREOF, The said Board of Trustees here-
by causes its Corporate Seal to be affixed, and these presents to
be subscribed by a maiority of the said Board as of this dat,e.
TERMS and CONDITIONS
The Permittee Thomas Zukag
residing at Smith Drive South. Southold. NY 11971 N.Y., as
part of the consideration for the issuance of .the Permit does understand and prescribe to the fol-
lowing:
1. That the said Board 'of Trustees and the Town of Southold are released from any and
all damages, or claims for damages, o£ suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expense,
defend any and all such suits initiated by third parties, and the said Permittee assumes full l~hility
with respect thereto, ro the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Permit is valid for a period of 24 mos. which is considered to be the
estimated time required to complete the work involved, but should circnm,tances warrant, request
for an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permi~e wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
4. That .the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That ff future operations of the Town of Southold require the removal and/or alterations
in the lOcation of the work herein authorized, or if, in the opinion of the Board of TruStee% the
work shall cause unreasonable obstrucuon to free navigation, the said Permittee will be required,
upon due notice, to remove or. alter 'this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permittee ot the completion of the work auth-
orized.
9. That the Permittee will obtain all other permits and consents that may be required sup-
plemental to this permit which may be subject to revoke upon failure to obtain same.

Dear Mr. Haje:
The following action was taken by the Board of Town Trustees during
its regular meeting held on August 23, 1990 regarding the above
matter:
WHEREAS, ROY HAJE IN BEHALF OF THOMAS ZUKAS applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated June 27,
1990 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on August 23, 1990 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT ROY HAJE IN BEHALF OF THOMAS ZUKAS BE AND HEREBY IS
GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: Construct a
timber dock consisting of a 4' X 10' upland inclind ramp; 4' x 15'
fixed elevated (3.5 above grade of marsh) walk; a 4' X 14' hinged
ramp; a 6' X 20' float secured by (2) 8" diameter.pilings.
This permit will expire two years from the date it is signed if work
has not commenced by said date. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notifiCation. Two inspections are required and the Trustees are to
be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for work to
be done below Mean High Water Mark:

Wetland Applications Recommendations
The CAC made the following recommendations at its meeting .of July 19, 1990:
RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland
Application No. 6-4-90-35-3-p/o 12.5 & 12.6 of John Braider. The CAC
disapproves the requested 354 ' of timber retaining wall because no need is
demonstrated. The CAC suggests a natural planting of spartina in "cleared
area" would prevent any fruther erosion and any leaching into the pond.
The CAC recommends approval of the proposed floats.

Motion carried.
Wetland Application No. 6-3-90-87-5-1 of Howard Ludecker was tabled.
Wetland Application No. 6-2-90-106-4-1 of Sebastian Cove Property Owners Assoc.
was tabled.
RESOVLED to recommend to the Southold Town Trustees approval of Wetland
Application No. 6-6-90-76-3-23.1 of Thomas Zukas to construct a dock and float.
The CAC approves provided the dock does not extend into the creek as to
block navigation. The matter of nonjurisdiction cannot be determined since the
location of the well and sanitary system was not provided.

Motion carried
RESOLVED to recommend to the Southold Town Trustees disapproval of
Wetland Application No. 7-1-90-81-1-19 of William Griffo to construct two
groins. The CAC recommends disapproval because the establishment of groins
is bad not in the best interests of the environment, groins create problems and
exacerbate a bad situation.

Motion carried.
Regarding the Larry T'~tl"iitl application no. 1-14-90-117-5-46. The CAC feels the
project would do more damage to the environment that it would prevent the
loss of some land.

The following actions were taken by the Southold Town Board of
Trustees on Thursday, April 29, 1993:
RESOLVED that the Southold Town Board of Trustees suspend any
boats being docked at the present dock and gives 90 days for the
dock to be arranged as follows: the piles are to be placed on
the marsh and the float between the piles up against the marsh.
The dock with a boat shall not be more than 1/3 the way across
the canal.
RESOLVED that the Southold Town Board of Trustees table the
request for a waiver to clear property until such time that the
dock has been taken care of.

GENERAL CONDITIONS
By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compli-
ance with the ECL, all applicable regulations and the conditions specified herein or attached hereto.
1 The permittee shall file in the office of the appropriate regional permit administrator, or other office designated in the special conditions, a notice of intention to commence
work at least 48 hours in advance of the time of commencement and shah also notify him/her promptly in writing of the completion of the work.
2 The permitted work shall be subject to inspection by an authorized representative of the Department of Environmental Conservation which may order the work suspended if
the public interest so requires pursuant to ECL §71-0301 and SAPA §401(3).
3 The permittee has accepted expressly, by the executi°n °f the applicati°n' the full legal resp°nsibility f°r all damages' direct °r indirect' °f whatever nature' and by wh°mever
suffered, arising out of the proiect described herein and has agreed to indemnify and save harmless the State from suits, actions, damages and costs of every name and descrip-
tion resulting from the said project.
4 The Department reserves the right to modify, suspend or revoke this permit at any time after due notice, and, if requested, hold a hearing when:
a) the scope of the project is exceeded or a violation of any condition of the permit or provisions of the ECL and pertinent regulations are found; or
b} the permit was obtained by misrepresentation or failure to disclose relevent facts; or
c) newly discovered information or significant physical changes are discovered since the permit was issued.
5 To maintain a valid permit, the peri~ittee must submit a renewal application, including an'/forms, fees or supplemental information, which may be required by the
Department, at least 30 days prior to the expiration date of the existing permit (180 days prior for: State pollution discharge elimination system permits (SPDES), Solid
waste management facilities permits (SWMF), or Hazardous waste management facilities permits (HWMF)). .
This permit shall not be construed as conveying to the applicant any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the
permitted work or as authorizing the impairment of any rights, tide or interest in rea[ or personal property held or vested in a person not a party to the permit.
The permittee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way which may be required f~r this project.
Issuance of this permit by the Department does not, unless expressly provided for, modify, supersede or rescind an order on consent or determination by the Commissioner
issued heretofore by the Department or any of the terms, conditions, or requirements contained in such order or determination.

10. That if futur~ operations by the State of New York require an

if, in the opinion of the Department of Environmental Conservation
it shall cause unreasonable obstruction to the free navigation of said
waters or flood flows or endanger the health, safety or welfare of
the people of the State, or cause loss or destruction of the natural
resources of the State, the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused
thereby without expense to the State, and if, upon the expiration or
revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be com-
pleted, the owners, shall, without expense to the State, and to such
extent and in such time and manner as the Department of Environmental
Conservaticm may require, remove all or any portion of the uncompleted
structure or fill and restore to its former condition the navigable
and flood capacity of the watercourse. No claim shall be made against
the State of New York on account of any such removal or alteration.
11. That the State of New York shall in no case be liable for any damage
or injury to the structure or work herein authorized which may'be caused
by or result from future operations undertaken by the State for the
conservation or improvement of navigation, or for other purposes, and
no claim or right to compensation shall accrue from any such damage.
12. Cranting of this permit does not relieve the applicant of the responsi-
bility of obtaining any other permission, consent or approval from
the U.S. Army Corps of Engineers, U.S. Coast Guard, N~k~ York State
Office of General Services or local 8overnment which may be required.
13. All necessary Im'ecautio,s shall be taken to preclude contamination
of any wetland or waterway by suspended solids, sediments, fuels,
solvents, lubricants, epoxy coatings, paints, concrete, leachate or any
other environmentally deleterious materials associated with the
project.
14.. Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse piles, ridges across
the bed of a waterway or floodplain or deep holes that may have a
tendency to cause damage to navigable channels or to the banks of
a waterway.
15. Thereshall be no unreasonable interference with navigation by thework
'herein authorized.
16. If upon the expiration or revocation of this permit, the project hereby
authorized has not been completed, the applicant shall, without expense
to the State, and to such extent and in such time and manner as the
Department of Environmental Conservation may require, remove all or
any portion of the uncompleted structure or fill and restore the site
to its former condition. No claim shah be made against the State of
New York on account of any such removal or a~teration.
17. If. granted under Article 36, this permit does not signify in any way
that the project will be free from flooding.
18. If granted under 6 NYCRR Part 608, the NYS Department of Envirork
mental Conservation hereby certifies that the subject project will not
contravene effluent limitations or other limitations or standards under
Sections 301,302, 303, 306 and 307 of the Clean Water Act of 1977
(PL 95-217) provided that all of the conditions listed herein are met.
