Dear Mr. Janis:
Representatives of Trustees met with Mr. Zang on April 20,
1993 and discussed the proposed work with the rest of the Board
on April 29, 1993.
The Board decided to stay with their resolution of March 25,
1993 which states the following:
Resolved that the Board of TruStees grants a waiver to raise the
house, but denies the request to bring in fill.
If the applicant still wants to bring in fill the Board request
that a full application be processed with this Board with the
exception of the fees.
The fees will be waived due to the storm damage.
The fee of forty dollars will be return directly to Mr. Zang as
we received the fee from him.
If you have any questions, please do not hesitate to contact
this office.

At the March 25, 1993 regular meeting of the Southotd Trustees
the Board of Trustees denied your request for a waiver to put
fill on your land as this activity will require a completed
Wetland Permit process and $150.00 fee submitted.
Should you wish to raise the house without fill, your waiver for
that limited purpose shall be granted upon submission of the
$40.00 fee.

Dear Mr...Carrara:
In response to your letter to me of January'-'~14th, I have no
objection to your requirement that, fill placement not exceed the
height of the bulkhead within 30 feet of the bulkhead. Also, I
have no objection to your additional requirement that the fill be
sloped downward to eXisting~grade levels as it gets closer to the
property boundaries.
As you requested, I have enclosed a cross section showing the
existing grades and proposed grades. Please note that the existing
level of the dwelling is approximately 3 1/2 to 4 feet below the
top of .the bulkhead...the property slopes downward from the
bulkhead to the dwelling...and that there is some erosion
immediately in front of the bulkhead, which will be filled in not
to exceed the height of the bulkhead. Also, the supporting
materials will be masonry blocks or, if required by the Town code
poured concrete. '

Based on the information you have submitted, the New York State Department
of Environmental Conservation has determined that the parcel . _ ~_
.~_~ project is:
Greater than 300' from inventoried tidal wetlands.
Landward of a substantial man-made structure/ ck %~\~L~=%6
greater than !00' in length which was constructed prior to 9/20/77.
Landward of the 10' above mean sea level elevation contour on a
gradual, natural slope.
Landward of the topographic crest of a bluff, cliff or dune which 'is
greater than 10' in elevation above mean sea level.
Therefore, no Permit is required under the Tidal Wetlands Act (Article 25
of the Environmental Conseryation Law). Please be advised, however, that
no construction, sedimentation or disturbance of any kind may take place
seaward of the 10' contour 'or topographic~crest without a permit. It ms
your responsibility to ensure that all necessary precautions are taken to-
prevent any sedimentation'or other alteration or disturbance to the
ground surface or vegetation in this a~ea as a result Of your project.
Such precautions may include providing adequate work area between the
!0' contour or ~opographic cres~.and the project (i.e. a !5! to 20' wide
q~n~ruction area) or. erection of a. temporary fence, barrier, or hay
bale berm. -
Please note that any additional work, or modification to the project as
described, may require authorization by this Department. Please contact
this office if such are contemplated.
Please be further advised that this letter does not relieve you of %ke
responsibility of obtaining any necessary permits or a~prcvais frcm other
agencies. ' ·
