map, provide a SCALE DRAWING which will show Ordinary High Water Mark, the shape
and size of the dock and any supplemental pilings which are needed to hold a floating dock
or tie-up a boat. Give all dimensions necessary to determine the area of the dock surface
which extends offshore froTM the O. H. W. M.
Will any portion of this construction extend offshore into Town Waters beyond a.n, imaginary
line or boundary formed by other similar structures along the area's shoreline? YES or NO.

The decision whether to issue a permit will be based on an evaluation of
the probable impact including cumulative impacts of the activity on the
public interest, That decision will reflect the national concern for both
protection and utilization of important resources, The benefit which
reasonably may be expected to .a~..crue from the activity must be balanced
against its reasonably foreseeable detriments. All factors which may be
relevant to the activity will be considered including the cumulative
effects thereof; among those are conservation, economics, aesthetics,
general environmental concerns, wetlands, cultural values, fish and
wildlife values, flood hazards, flood plain values, land use, navigation,
shoreline erosion and accretion, recreation, water supply and conservation,
water quality, energy needs, safetys food production and, in general, the
needs and welfare of the people.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE ·PREPARED IN WRITING

Reviews of activities pursuant to ~ection 404 ef the Clean Water Ace will
include application of the guideline~ promulgated by the Administrator~

the Clean Water Act and the applicant will obtain a water quality
certificate or waiver from the appropriate state agency in accordance' with
Section 40~ of the Clean Water Act prior to a permit decision~
Pursuant to Section 307(c) of ~he Coastal Zone Management Act of 1972 as
amended (16 U~S.Co 1456(c))~ for activities under consideration that are
located within the coastal zone of a state which has a federally approved
coastal zone management program~ the applicant has cer~lfied in the permit
application that the activity complies with and will be conducted in a
manner that is consisteng with the approved s~ate coastal zone management

DESCRIPTION OF WORK
The applicant, Michael Withers requests Department of the
Army authorization to dredge, construct a bulkhead with
attendant backfill and to replace (in-kind and in-place)
existing marine structures in Schoolhouse Creek, Great
Peconic Bay at New Suffolk, Suffolk County, New York.
The work would involve the in-kind and in-place
replacement (within 18") of 90 linear feet of existing timber
bulkhead at the northern end of the property. Also, timber
· pilings and fixed piers which are no longer serviceable would
be replaced~ in-kind and in-place with new timber pilings and
floating piers respectively. In addition, a new steel
bulkhead, 110 feet in length would be constructed
approximately 2.5-3 feet in front of the existing bulkhead
and backfilled with dredged material. Approximately 200 cubic
yards of material would be dredged as needed from the basin
to be used as backfill for the proposed steel and timber
bulkheads.
The purpose of the proposed project is to replace old piers, repair leaks
in the existing bulkhead and acquire material to backfill the bulkhead.
