REVIEW PERFORMED FOR SITE EVALUATION (CHECK ALL THAT A PLY): Southold Town Office (Desk) Determination. Date: March 23, 2017 Board of Trus e ❑ Field Determination. Date(s): TABLE OF AQUATIC RESOURCES IN REVIEW AREA WHICH "MAY BE"SUBJECT TO REGULATORY JURISDICTION. Site Latitude Longitude Estimated amount Type of aquatic Geographic authority number (decimal (decimal of aquatic resource resource(i.e.,wetland to which the aquatic degrees) degrees) in review area vs. non-wetland resource"may be" (acreage and linear waters) subject(i.e.,Section feet, if applicable) 404 or Section 10/404) 1 41.0470472 -72.428712 0. 10 Waters 10/404 1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in the review area, and the requestor of this PJD is hereby advised of his or her option to request and obtain an approved JD (AJD)for that review area based on an informed decision after having discussed the various types of JDs and their characteristics and circumstances when they may be appropriate. 2) In any circumstance where a permit applicant obtains an individual permit, or a Nationwide General Permit (NWP) or other general permit verification requiring "pre- construction notification" (PCN), or requests verification for a non-reporting NWP or other general permit, and the permit applicant has not requested an AJD for the activity, the permit applicant is hereby made aware that: (1)the permit applicant has elected to seek a permit authorization based on a PJD, which does not make an official determination of jurisdictional aquatic resources; (2) the applicant has the option to request an AJD before accepting the terms and conditions of the permit authorization, and that basing a permit authorization on an AJD could possibly result in less compensatory mitigation being required or different special conditions; (3)the applicant has the right to request an individual permit rather than accepting the terms and conditions of the NWP or other general permit authorization; (4) the applicant can accept a permit authorization and thereby agree to comply with all the terms and conditions of that permit, including whatever mitigation requirements the Corps has determined to be necessary; (5) undertaking any activity in reliance upon the subject permit authorization without requesting an AJD constitutes the applicant's acceptance of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in reliance on any form of Corps permit authorization based on a PJD constitutes agreement that all aquatic resources in the review area affected in any way by that activity will be treated as jurisdictional, and. waives any challenge to such jurisdiction in any administrative or judicial compliance or enforcement action, or in any administrative appeal or in any Federal court; and (7) whether the applicant elects to use either an AJD or a PJD, the JD will be processed as soon as practicable. Further, an AJD, a proffered individual permit(and all terms and conditions contained therein), or individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it becomes appropriate to make an official determination whether geographic jurisdiction exists over aquatic resources in the review area, or to provide an official delineation of jurisdictional aquatic resources in the review area, the Corps will provide an AJD to accomplish that result, as soon as is practicable. This PJD finds that there "may be"waters of the U.S. and/or that there "may be"navigable waters of the U.S. on the subject review area, and identifies all aquatic features in the review area that could be affected by the proposed activity, based on the following information: 11Vt MAR 2 7 2017 Soa.zu:• Board of T; gars SUPPORTING DATA. The proposed coverage of West Creek by the portion of the dock situated seaward of the high water line would be approximately 144 square feet, which represents a 40 sf reduction of the approximately 184 square feet of West Creek covered by the previously permitted catwalk, ramp, and 6' x 20' float. The proposed dock would also be situated between and within the pier line of two adjacent docks, including a similar fixed dock to the west that was permitted in 2009 pursuant to Southold Wetlands Permit No. 7181. Specifically, the proposed dock would extend+13 feet seaward of the high water line or approximately 17%of the width of the waterway at mean lower low tide. Therefore, the dock will be consistent with the dock construction and operation standards set forth by§275-11(C)(2) and will not interfere with navigation or other public use of the adjoining waterway. To minimize the dock's impact on tidal wetlands vegetation, the entire dock structure will be constructed with open-grate decking. Therefore, consistent with Policy 6, the proposed dock will not cause the"fragmentation of ecological communities;"result in the physical loss, degradation, or functional loss of ecological components; or have any other significant adverse impact on the adjacent tidal wetlands or waters of the Town and will otherwise comply with the statutory and regulatory requirements of Chapter 275 and Article 25 of the New York State Environmental Conservation Law. Box 1179 Southold,NY 11971 Re: Castelforte LLC,2100 Glenn Road, Southold,Trustees Permit#1807 Dear Mr. Bredemeyer: Several months ago the owners of the captioned property submitted an application to transfer Southold Trustees Permit No. 1807,which was originally issued to Robert Wilson in 1984 for an "L"-shaped floating dock assemblage, consisting of a 4' x 20' fixed catwalk, 4' x 12' ramp, and two 6' x 10' floats. It is my understanding that after reviewing the application and finding that a 6' x 20' float secured by two pilings is all that presently remains of the previously existing dock, the Board requested submission of updated plans depicting a similarly designed dock to be constructed with open-grate decking and support piles no larger than 6 inches in diameter. To that end,the owners retained En-Consultants to assist them with the design and preparation of the plans for the new dock. And based on a subsequently obtained survey of the existing water depths (measured during mean lower low water); locations of surrounding docks; and width of the waterway, I have recommended replacement of the "L"-shaped floating dock with a fixed "L"-shaped dock, consisting of a 4' x 34' catwalk leading to a 6' x 12' "L"-shaped platform at its seaward end. The proposed seaward extent of the dock is consistent with that of the neighboring docks and with Section 275-11(C)(2). Therefore, please transfer and modify the permit to reflect this proposed dock configuration as it is depicted on the project plan prepared by En-Consultants, dated November 9, 2016, three (3) copies of which are enclosed with an application for permit modification. Should you require any additional information in support of our application, please let me know. Respec ly yours, ;ice, NOV 1 4 2016 -` Robert E.
