Dear Mr. Haje:
The following action was taken by the Board of Town Trustees during
its regular meeting held on July 26, 1990 regarding your request to
amend the above permit.
RESOLVED that the Town Trustees approve the request of
En-Consultants, Inc. on behalf of David Winkler to amend permit
number 3798 to state the following:
Add a second 6' x 20' float to existing dock.
Ail other terms and conditions in the original permit granted shall
remain.
The amended permit shall take effect upon receipt of payment of the
following fees:

in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstruc~on to free navigation, the said Permittee will be required~
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permittee ot the completion of the work auth-
orlzed.
9. That the Permittee will obtain all other pem~its and consents that may be required sup-
plemental to this permit which may be subject to re,-oke upon failure to obtain same.

The following action was taken by the Board of Town Trustees
during its regular meeting held on February 22, 1990 regarding the
above matter:
WHEREAS, En-Consultants on behalf of David Winkler applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated December
21, 1989 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on February 22, 1990 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT EN-CONSULTANTS ON BEHALF OF DAVID WINKLER BE AND HEREBY
IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Construct a timber dock consisting of a 4' X 130' fixed elevated (4'
above grade of marsh) walk; 4' X 12' ramp; 6' X 20' float secured by
(2) 8" diameter pilings.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid, if
applicable, and permit issued within six months of the date of-'this
notification. Two inspections are required and the Trustees are to
be notified upon completion of said project.
Please return to the Building Department for a determination on
the need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for
work to be done below Mean High Water Mark:

Recommendation of Applications
The following recommendations were made by the CAC at its last meeting of
February 16, 1990:
RESOLVED to recommend to the Southold Town Trustees APPROVAL of Wetland
Application No. 478 submitted by Costello Marine on behalf of JOHN VASSIL (o
amend Wetland Permit no. 478 to extend existing 6' x 24' float dock 10' for a
total of 6' x 34'.
Salt Lake Lane, Mattituck
Vote of Council: Ayes: All
Motion carried.
RESOLVED to recommend to the Southold Town Trustees APPROVAL AND DIS
APPROVAL of Wetland Application No. 1-4-90-81-1-16.1 submitted by En-Consultants
on behalf of Edward Deutsch. The Council approves the construction of a
4' x 16' hinged ramp secured to drest of bank by two 4" posts; and a 6' x 20'
float secured by two 8" diameter pilings.
The CAC disapproves the construction of 215 I.f. of timber retaining wall at or
above the line of MHW. The Council feels this is actually bulkheading and
suggest the applicant plant native vegetation to stabilize the beach and bluff.
Regarding the construction of the single family dwelling with garage, deck, drive-
way, well and sanitary system the CAC feels the applicant move the house back
so there will be no disturbance within 75', i.e. trucks clearing the area for work.
All work should be at least 75' away.

RESOLVED to recommend to the Southold Town Trustees DISAPPROVAL of Wetland
Application No. 1-3-90-90-4-12 submitted by En-Consultants on behalf of Erika
Swimmer to construct a one family dwelling, sanitary system with retaining wall,
well and bulestone driveway, all as shown on submitted site plan. Approximately
On a motion by John Holzapfel, seconded by Margaret Feeney, it was
RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland
Application No. 6-1-90-78-4-45 submitted by Land Use Company on behalf of
Core¥ Creek Association to install a 4' x 35' catwalk leading to a 3' x 10' ramp,
6' x 140' float with seven (7) 4' x 18' fingers and 30 mooring piles. An existing
"L" -shaped 2' x 55' catwalk and 4' x 10' float to be removed. Catwalks to be
elevated over existing tidal wetland area and facility would be for the property
owners of Corey Creek Estates only. The CAC recommends disapproval because
of concern over the sewage discharge and chemicals from the amount of boats.
Also it is a valued shellfish area and possible ISSC regulations may cause the
area to be closed to shellfishing should this project go through. The CAC
recommend the project be declared a Type I action with a positivedecla~ation
that a fUll ElS be required.

RESOLVED to recommend to the Southold Town Trustees approval with stip-
ulations of Wetland Application No.5-2-90-15-9-9 submitted by Sanders & Thomas
for the U.S. Dept. of Ac~riculture to install replacement bulkheads adjacent to
existing bulkheads along approximately 200 feet of northern end of USDA Orient
Point Harbor, replace ixisting earthen finger pier with wooden finger pier, and
in-stall mooring piles and a maneuvering dolphin. The CAC recommends approval
with a stipulation that all runoff be contained. All runoff from the parking lots
and adjacent areas be contained by installing dryweils in the parking lots.

Weland Application Recommendations
The following recommendations were made by the Southold Town CAC at its meeting
held Thursday, June 14, 1990 at Southold Town Hall:
On a motion by Bruce Loucka, seconded by Stephen Angeii, it was
RESOLVED to recommend to the Southold Town Trustees approval with stipulations
oF Wetland Application No. 3-3-90-99-4-1 submitted by Permit Research and
Acquisition Co for Care¥ Tank Farms to demolish Carey Tank Farms (above ground
petroleum tank storage), demolition of three (3) 250,000 gallon tanks and three
(3) 100,000 gallon tanks, and two (2) 20,000 gallon tanks. The CAC approves
provided that during the course of removal, nothing is allowed to enter the
creek or groundwater and that any connecting lines or plumbing be removed also.

RESOLVED to recommend to the Southold Town Trustees approval with stipulations
of Wetland Application No. 5-1-90-115-17-6.2 submitted by Bookmiller Realty
on behalf of Brent Bookmiller to construct a single family dwelling, well and
associated sanitary system. The CAC approves provided all runoff be contained
on property (hay bales, filter cloth, etc.), gutters, downspouts, and drywells
be installed and a 45' native vegetation buffer be maintained. The~suggests
applicant site the house as closer to the road, as much as zoning will allow.

RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland
Application No. 5-3-90-117-5-31 submitted by John H. Geideman on behalf of
Joseph Fudjinski to excavate to create a small boat basin (pleasure craft), and
place spoil on owner's land close to site. The CAC recommends disapproval
because no need is shown for this project. The project would result in the
removing of wetlands, dredging would destroy the whole waterfront area by his
property and damage would occur to the wetlands. The Council suggests the
applicant instead submit plans for a dock and catwalk.

GENERAL CONDITIONS
By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compli-
ance with the ECL, ail applicable regulations and the conditions specified herein or attached hereto.
The permittee shall file in the office of the appropriate regional permit administrator, or other office designated in the speciaLconditions, a notice of intention to commence
work at least 48 hours in advance of the time of commencement and shall also notify him/her promptly in writing of the completion of the work.
The permitted work shall be subject to inspection by an authorized representative of the Department of Environmental Conservation which may order the work suspended ff
the public interest so requires pursuant to ECL §71-O301 and SAPA §401(3).
The permittee has accepted expressly, by the execution of the application, the full legal responsibility for ali damages, direct or indirect, of whatever nature, and by whomever
suffered, arising out of the project described herein and has agreed to indemnify and save harmless the State from suits, actions, damages and costs of every name and descri~-
lion resulting from the said project.
The Department reserves the right to modify, suspend or revoke this permit at any time after due notice, and, if requested, hold a hearing when:
a) the scope of the project is exceeded or a violation of any condition of the permit or provisions of the ECL and pertinent regulations are found; or
b) the permit'was obtained by misrepresentation or failure to disclose relevent facts; or
c) newly discovered information or significant physical changes are discovered since the permit was issued.
The permit'tee is responsible for keeping the permit active by submittin8 a renewal application, including any forms, fees or supplemental information which may be required
by the Department, no later than 30 days (180 days for SPDES or Solid or Ha:~arduous Waste Management permits) prior to the expiration date.
This permit shall not be construed as conveying to the applicant any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the
permitted work or as authorizing the impairment of any rights, title or interest in real or personal property held or vested in a person not a party to the permit.
The perm~ttee is responsible for obtaining any other permits, approvals, lands, easements and rights-of-way which may be'required for this proiect.
Issuance of this permit by the Department does not, unless expressly provided '~or, modify, supersede or rescind an order on consent or determination by the Commissioner

if, in the opinion of the Department of Environmental Conservation
it shall cause unreasonable obstruction to the free nawsation of said
waters or flood flows or endanser the health, safety or welfare of
the people of the State, or cause loss or destruction of the natural
resources of the State. the owner may be ordered by the Department to
remove or alter the structural work. obstructions, or hazards caused
thereby without expense to the State. and if, upon the expiration or
revocation of th~s permit, the structure, flit, excavation, or other
modification of the watercourse hereby authorized shall not be com-
plet'ed, the owners, shall, without expense to the State, and to such
extent and in such time and manner as the Department of Environmental
Conservation may require, remove all or any portion of the uncompleted
structure or fill and restore to its former condition the navigable
and flood capacity of the watercourse. No claim shall be made against
the State of New York on account of any such removal or alteration.
That the State of New York shatl in no case be liable for any damage
or iniu~ to the structure or work herein authorized which may be caused
by or result from future operations undertaken by the State for the
conservation or ~mprovement of navigation, or for other purposes, and
no claim or right to compensation shall accrue from any such damage.
Granting of this permit does not relieve the applicant of the responsi-
bilit¥ of obtainin8 any other permission, consent or approval from
the U~S. Army Corps of Engineers, U.S. Coast Guard, New York State
Office of General Services or local government which may be required.
All necessary precautions shall be taken to preclude contamination
of any wetland or waterway by suspended solids, sediments, fuels,
solvents, lubricants, epoxy coatings, paints, concrete, leachate or any
the
project.
14 Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, w~thout leaving large refuse piles, ridges across
the bed of a waterway or floodplain or deep holes that may have a
tendency to cause damage to nawgable channels or to the banks of
a waterway.
15 There shall be no unreasonable interference with nawgation by the work
hereto authorized.
16 If upon the expiration or revocation of this permit, the prolect hereb~
authonzed has not been completed, the applicant shall, w~thout expense
to the State, and to such extent and in such t~me and manner as the
Department of Environmental Conservation may require, remove all or
any portion of the uncompleted structure or i:dl and restore the s~te
to its former condition. No claim shall be made agamst the State of
New York on account of any such removal or alteration.

(PL 95-217) provided that all of the conditions listed herein are met.

SPECIAL CONDITIONS
1. A copy of this permit with supplementary conditions and approved plans
must be available at the project site whenever authorized work is in
progress.
2. The permit sign enclosed with the permit or a copy of letter of approval
must be protected from the weather and posted in a conspicuous location
at the work site until completion of authorized work.
3. At least 48 hours prior to commencement of the project, the permittee
must complete and return the top portion of the enclosed receipt form
certifying that he is fully aware of and understands all provisions and
conditions of this permit. Within one week of completion of the
permitted work, the bottom portion of that form must also be completed
and returned.
4. If the permittee intends to undertake any project design modifications
after permit issuance, the permittee must submit the appropriate plan
changes for approval by the Regional Permit Administrator prior to
undertaking any such modifications. The permittee is advised that
substantial modification may require submission of a new application for
permit.
5. Those portions of docks, catwalks and ramps which extend over vegetated
tidal wetlands shall have a maximum surface width of 4 feet and shall be
a minimum of 3 1/2 feet above grade, as measured from the ground surface
to the bottom of the planking. Floating docks shall not rest on
vegetated tidal wetlands at any tidal stage.

Docks and floats shall not extend laterally beyond property lines, be
placed so that docked boats extend over adjacent property lines,
interfere with navigation, or interfere with other landowners' riparian
rights.
Dock reconstruction or replacement or seasonal installation shall not
involve expansion or substantial modification of existing structures or
facilities.
Installation of additional docks at marinas, boat basins, or other
commercial facilities is not authorized by this permit.
No dredging, excavating or other alteration of shoreline or underwater
areas is authorized by this permit, nor shall issuance of this permit be
construed to suggest that the Department will issue a permit for such
activities in the future.

SUPPLEMENTARY SPECIAL CONDITIONS
The following conditions apply to all permits:
If any of the permit conditions are unclear,the permittee shall con-
tact the Division of Regulatory Affairs at the address and telephone
noted below.

For projects involving activities to be accomplished over a period of
more than one year, the permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to the commencement
of resumption of work each year.
If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by
the Regional Permit Administrator prior to undertaking any such modi-
fications. The permittee is advised that substantial modification
may require submission of a new application for permit.
AIl necessary precautions shall be taken to preclude contamination of
any wetlands or waterway by suspended solids, sediment, fuels,
solvents, lubricants, epoxy coatings, paints, concrete, leachate or
any other environmentally deleterious materials associated with the
project work.
Any failure to comply precisely with all of the terms and conditions
of this permit, unless authorized in writing, shall be treated as a
violation of the Environmental Conservation Law.
The permittee is advised to obtain any permits or approvals that may
be required from the U.S. Department of Army Corps of Engineers, NY
District, 26 Federal Plaza, New York, NY 10278, (Attention: Regulatory
Functions Branch), prior to commencement of work authorized herein.
The granting of this permit does not relieve the permittee of the
responsibility of obtaining a grant, easement, or other necessary
approval from the Division of Land Utilization, Office of General
Services, Tower Building, Empire State Plaza, Albany, NY 12242, which
may be required for any encroachment upon State-owned lands underwater.
