Town Trustees during its regular meeting held on February 27, 1992 regarding the above matter: WHEREAS, LAND USE CO. ON BEHALF OF WINDS WAY BUILDING CORP. applied to the Southold Town TrUstees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated December 3, 1991 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on February 27, 1992 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED THAT LAND USE ON BEHALF OF WINDS WAY BUILDING CORP.BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: Construct one 4' X 50' and one 4' X 40' timber stairway from top of bluff to base of slope. Stairway will lead to a 30" X 225' elevated (minimum 2' above marsh)timber catwalk constructed along slope toe to a 30" X 60' timber catwalk connecting adjoining property staircase 4' X 40' and common beach area. Catwalks will provide beach access over wetland area. Additionally, applicant shall to construct a 30" X 260' elevated timber catwalk leading to the 15' contour of elevation and thus leading to a 3' X 10' ramp and (2) 6' X 20' floats in "T" formation secured by 8" pilings. The catwalk shall be elevated 2' minimum over TWL area. A set of access steps must be installed over the dock at or below mean high water to provide for riparian access along the creek. All stairs maximum width 4' All catwalks maximum width 30", may have handrails. All catwalks must not exceed 4" wide deck material with 3/4" spacing to allow light penetration between deck boards. This permit will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completion of said project. Please return to the Building Department for a determination on the need for any other permits which may be required for this project. Box 1179 Southold, New York 11971 TO: Southold Town Board of Trustees FROM: Southold Town Conservation Advisory Council DATED: February 25, 1992 RE: RECOMMENDATION OF WETLAND APPLICATIONS The following recommendation were made by the Southold Town Conser- vation Advisory Council at its meeting held February 13, 1992: On a motion by John Holzapfel, seconded by Bruce Loucka, it was RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 37-4-17 of Gardiners Bay Estates Home- owners Association to construct a 3' x 16' catwalk (4' elevation), 3' x 16' ramp; 4' x 24' float with two (2) 3' x 14' fingers and three (3) piles; also, move existing catwalk 12' east. All work on Association's ROW and pond property. The Council recommends disapproval because it has a policy of one dock, with a capacity of four (4) boats on a single piece of property. The Council does not wish to see marians developed by property associations. sPring Pond, East Marion. Vote of Counci: Ayes: All Motion carried. On a motion by Stephen Angell, seconded by Cynthia Sturner, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 122-4-32 of Robert Johnsen to construct an 8' x 24'fioating dock with a 3' x 16' ramp using CCA treated lumber. The Council tabled Wetland Application No. 113~6-8 of Joyce Beckenstein Lakin to add a second '6' x 20' float plus one 8" diameter pile to existing dock to reach deep water. On a motion by John Holzapfel, seconded by Cynthia Sturner, it was RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 110-7-25 of Gustave Wade to construct a one family dwelling, sanitary system, well, 150± 1.f. of timber retaining wall landward of the wetland edge using approximately 35 c.y. of clean sand backfill and an additional 25 c.y. of top soil to establish plantings. The CAC recommends disapproval because the lot is environmentally constrained.
