A reversal of the Board of Trustees May 18, 2022 determination preventing the issuance of a coastal erosion permit in accordance with Chapter 111 of the Town Code. FACTUAL BACKGROUND AND PROCEDURAL HISTORY A. Description of the proper1y and applicants: The property that is the subject of this application is located at 305 North Sea Drive, Southold,NY, SCTM#1000-54-4-5. The property is currently improved with a single family home, decks and foundation. The property is located in the residential zone. As confirmed by the Board of Trustees, and acknowledged by the applicant, the property where the proposed work is to be performed is located within the Coastal Erosion Hazard Area as established by New York State in 1991. The applicant submitted an application to the Trustees to authorize for the existing 28. F x45. 2' dwelling; reconstruct existing 435sq.ft. deck, new deck railing with cables and from deck a 4' wide stair to a 4' x4' landing to a 4' wide stair to grade; replace existing 4"x4" support posts with 6' x6" support posts; convert existing 193sq.ft. screened-in porch to a living space by adding insulated walls and new windows; install a 5' x12' enclosed elevator with a 175sq.ft. deck with railings for handicap access on landward side of dwelling; for the existing 12' x8' shed; existing 4' wide wood walks on grade to T wide wood walk on grade to beach; and existing 3. 7' x5.9'vinyl storage locker on wood platform against 4' wide wood walk; within a near shore area in a Coastal Erosion Hazard Area located on property on parcel 305 North Sea Drive, Southold, NY, SCTM#1000-54-4-5. B. Trustees Procedural History: I. Application The applicant filed an application with the Board of Trustees on March 9, 2022 to authorize the existing 28. 1' x45. 2' dwelling; reconstruct existing 435sq.ft. deck, new deck railing with cables and from deck a 4' wide stair to a 4' x4' landing to a 4' wide stair to grade; replace existing 4"x4" support posts with 6' x6" support posts; convert existing 193sq.ft. screened-in porch to a living space by adding insulated walls and new windows; install a 5' x12' enclosed elevator with a 175sq.ft. deck with railings for handicap access on landward side of dwelling; for the existing 12' x8' shed; existing 4' wide wood walks on grade to 3' wide wood walk on grade to beach; and existing 3. 7' x5.9'vinyl storage locker on wood platform against 4' wide wood walk; within a near shore area in a Coastal Erosion Hazard Area located on property on parcel 305 North Sea Drive, Southold, NY, SCTM#1000-54-4-5. II. Public hearing: The Trustees held a public hearing on this application on May 18, 2022 at which times all those interested were given the opportunity to speak. Patricia Moore appeared on behalf of the applicant. III. Trustees Determination and Certificate of Compliance. On May 18, 2022 the Trustees issued a determination stating that the proposed construction fell outside the jurisdiction of the Board of Trustees due to the proposed application being located within the designated Coastal Erosion Hazard Area and therefore the Trustees could not issue a permit under the tidal wetlands act denied the application without prejudice, and as such further application would need to be made to the Town Board. IV.The Town Board Proceeding On June 25, 2022, the property owners timely filed an appeal of the Trustee's determination pursuant to Town Code Chapterl l l with the Coastal Erosion Hazard Board of Review(the Board) seeking the reversal of the Trustees denial. The Board held a duly noticed public hearing on July 5, 2022, at which time all interested parties were given the opportunity to present testimony on the application. Patricia Moore, Esq. on behalf of the applicant addressed the Town Board's concerns with regards to the application to authorize the existing 28. 1' x45. 2' dwelling; 2 reconstruct existing 435sq.ft. deck, new deck railing with cables and from deck a 4' wide stair to a 4' x4' landing to a 4' wide stair to grade; replace existing 4"x4" support posts with 6' x6" support posts; convert existing 193sq.ft. screened-in porch to a living space by adding insulated walls and new windows; install a 5' x12' enclosed elevator with a 175sq.ft. deck with railings for handicap access on landward side of dwelling; for the existing 12' x8' shed; existing 4' wide wood walks on grade to Y wide wood walk on grade to beach; and existing 3. 7' x5.9'vinyl storage locker on wood platform against 4' wide wood walk; within a near shore area in a Coastal Erosion Hazard Area located on property on parcel 305 North Sea Drive, Southold, NY, SCTM #1000-54-4-5. Members of the public had the opportunity to appear and the record was closed on August 9, 2022. APPEAL OF THE TRUSTEE'S DETERMINATION Pursuant to §111-24 the Town Board is designated as the Coastal Erosion Hazard Board of Review and has the authority to "[h]ear and decide appeals where it is alleged there is error in any order, requirement, decision or determination made by the Administrator in the enforcement of this chapter."See, Town Code §111-24 (B). Furthermore, the Coastal Erosion Hazard Board of Review has the authority to "reverse or affirm, wholly or partly, or may modify the order, requirement, decision or determination of the Administrator, including stop or cease-and-desist orders." See, Town Code §111-25. When considering appeals pursuant to §§ 111-24 & 25, the Board is limited to the record on appeal and the arguments made before the Board of Trustees. In this instance, this Board finds, based upon the record before it, that the applicant has supplied the sufficient information regarding the criteria set forth in §111-9(A-C) of the Town Code to support the granting of a Coastal Erosion Management Permit. CONCLUSION Therefore, in the interests of justice and for the reasons set forth herein, this Board grants the appeal of the Applicant pursuant to Chapter 111 of the Town to authorize for the existing 28. Install an elevator on the landward, south, side of the home. 2. Incorporate the existing 193 square foot deck into the living area of the home. 3. Resurface the existing deck and stairs 4. Replace windows. Settin The existing home is located on a 0.90 acre (39,120 square foot) parcel of land known as 305 North Sea Drive and designated on the SC Tax Map as 1000-54-4-5. It is bounded to the north by Long Island Sound, to the south by North Sea Drive and to the east and west by private lands. The land is improved with a single family home of 1,270 square feet, an enclosed porch of 193 square feet, decks of 435 square feet, as well a landscaping, hardscaping, driveway utilities and a sub-surface sanitary system. Coastal vegetation including beach grass and bayberry are common and well represented. The shoreline has fluctuated in the past 20 years but appears stable to slightly accretive over the period from 2001 to 2020. First Coastal Consulting Page 2 of 4 Sonnenborn Residence 305 North Sea Drive,Southold NY SCTM 1000-54-4-5 Section 111 Interpretation and/or Variance The property where the home is located is within a FEMA flood zone (AE-12) indicating that is would be subject to flooding up to 12 feet above NAVD88 in a 100-year storm. A portion of the property is also designated as a Natural Protective Feature area under the Town Coastal Erosion Hazard Area regulations. The home and deck are located approximately 240 feet from the high-water line of Long Island Sound, which is also the NYS tidal wetlands line based on the survey by Kenneth M. Woychk, PLLC last dated September 3, 2019. Potential Impact of the proposed development on the Natural Protective Feature The proposed improvements will have no discernible impact on the Natural Protective Feature (NPF) located at 305 North Sea Drive. The footprint of the structure within the NPF area will remain unchanged. No sand will be removed from the dune. No vegetation within the NPF area will be damaged. The NPF will be identical in size, composition and effectiveness in preventing flood and erosion damage both before and after the proposes improvements. This fact makes the proposed action consistent with both the intent and the specific regulatory language of the Section 111, Coastal'Erosion Hazard Areas. The purpose of the CEHA regulations is given at 111.4 C Regulate new construction or placement of structures in order to place them a safe distance from areas of active erosion and the impact of coastal storms to ensure that these structures are not prematurely destroyed or damaged due to improper siting, as well as to prevent damage to natural protective features and other natural resources. The proposed action meets this intent as they are safe from areas of active erosion and have no impact to Natural Protective Features. In addition, the proposed activities also meet the specific letter of the regulations as they pertain to dunes within a NPF as given in 111.13 The key to maintaining a stable dune system is the establishment and maintenance of beachgrass or other vegetation on the dunes and assurance of a supply of nourishment sand to the dunes. The proposed activities will not diminish the amount of sand in the dune, impact the vegetation that stabilizes the dune, nor the sand naturally supplied from the beach. No reasonable, prudent, alternative site is available. The improvements are wholly within the footprint of the existing home. B. All responsible means and measures to mitigate adverse impacts on natural systems and their functions and values have been incorporated into the activity's design at the property owner's expense. Project limiting fence will ensure no impact to the dune or the vegetation. C. The development will be reasonably safe from flood and erosion damage. The proposed activities will be built to Town of Southold, NYS Building Code and FEMA standards and thus reasonably safe from flooding and erosion. D. The variance requested' is the minimum necessary to overcome the practical difficulty or hardship which was the basis for the requested variance. The variance is the minimum necessary to achieve the desired improvement. E. Where public funds are utilized, the public benefits must clearly outweigh the long-term adverse effects No public funds are involved. The Town of Southold has issued pre-existing Certificates of Occupancy, and Certificates of Occupancy for all the structures on the property. All structures were existing prior to the Town's adoption of the Coastal Erosion Hazard Area Law. Most of the existing house is landward of the Coastal Erosion Hazard Line with a small portion and the screened porch seaward of the line. The owners seek to modify the single-family house to render it handicap accessible by installing a small elevator at the front of the house', and to incorporate the 193 square foot screened porch into the living area of the house. In addition,the owners will perform resurfacing of the existing deck and stairs and replace windows in the residence. None of these activities changes the footprint or roofline of the existing residence. There is zero (0%) percent ground area coverage increase. The existing structure does not need a Coastal Erosion Hazard Area ("CEHA") permit—the existing structure is unregulated, exempt from CERA. The Town Trustees believed that a Coastal Erosion Hazard Area permit was required, and then proceeded to deny the permit in its decision on May 18, 2022. The Trustees determination was flawed. The Trustees incorrectly declared that the existing structures were "regulated" activities, and the proposed activity did not comply with the Coastal Erosion Hazard Area Law ("CEHA"). 1 The elevator to be installed is located at the front of the dwelling,outside the Coastal Erosion hazard Area. 1 This appeal is made to the Town Board in accordance with the provisions of Southold Town Code Chapter 111. The Town Board is the body designated to hear and act on appeals of decisions of the Town Trustees, with respect to the CEHA. Issues/Argument: 1. Coastal Erosion Hazard Area Law does not require permits for"existing structures'. When the Town adopted the CEHA,the Town "assume[d] the responsibility and authority to implement and administer a Coastal Erosion Management Program within its jurisdiction pursuant to Article 34 of the New York State Environmental Conservation Law. (Southold Town Code §111-4). The provisions of Article 34 of the Environmental Conservation Law do not apply to activities or development which have received final approval from the local government. (NY ECL§34-0113) In accordance with the provisions of Article 34,the Southold CEHA defines an "existing structure" as "structure[s] and appurtenances in existence, or one where construction has commenced, or one where construction has not begun but for which a building permit has been issued prior to the effective date of the chapter." (Southold Town Code §111-6) The house, porch, deck, walkways, and related accessory structures on this property fall within the Town's definition of"existing structures and appurtenances." All these improvements received approval of the Southold Town Building Department prior to the adoption of the Southold CEHA 2. As such,they do not require a CEHA permit;they are "existing structures". (Southold Town Code §111-6). . The proposed deck, walkway, and window repair and replacement activities are unregulated, and exempt from the CEHA. Z Pre-existing Certificate of Occupancy and Certificates of Occupancy have been issued for all structures on the property. 2 The provisions of the Southold CEHA define "unregulated activities", which are not regulated by the law. (Southold Town Code §111-6) ("Excepted activities which are not regulated by this chapter include, but are not limited to, elevated walkways or stairways constructed solely for pedestrian use and built by an individual property owner for the limited purpose of providing noncommercial access to the beach; docks, piers, wharves or structures built on floats, columns, open timber piles or other similar openwork supports with a top surface area of less than 200 square feet or which are removed in the fall of each year; normal beach grooming or cleanup; maintenance of structures when normal and customary. . . .". The Code also exempts "normal maintenance", which is defined as the "periodic replacement or repair of same-kind structural elements or protective coatings which do not change the size, design or function of a functioning structure." (Southold Town Code §111-6). The proposed repair and maintenance of the existing deck and walkways, and the replacement of windows in the existing dwelling, all fall within the definition of"unregulated activities" and "normal maintenance", which are exempt from the permit requirements of the Southold CEHA. 3. Conversion of the 193 square foot screened porch to living quarters is a minor modification of existing structure, with no material alteration of the conditions. The existing house includes a 193 square foot enclosed screened porch, and is only 15%of the maximum allowed pursuant to 111-13 (5). The owners seek to modify the porch and convert this to living space by adding insulated walls and new windows. The footprint of the house and the roofline will remain unchanged. This minor activity falls below the threshold of a "regulated activity." The Southold CEHA defines a "regulated activity" as "the construction, modification, restoration or placement of a structure, or major addition3 to a 3 The Southold CEHAL defines a "major addition"as an addition to a principal building"resulting in a twenty-five percent or greater increase in the building footprint of the principal building"(Southold Town Code§111-6)The 3 structure, or any action or use of land whichi i i , including grading, excavating, dumping, mining, dredging, filling, or other disturbance of soil." (Southold Town Code §111-6) (emphasis added). The proposed conversion of the existing porch to living space does not materially alter the condition of the land, and therefore falls outside a regulated activity, in which no CEHA permit is necessary. 4. Trustees incorrectl standards associated with "Natural Protective Feature", "including dunes", The location of the home with a defined "Natural Protective Feature" area does not preclude improvements to the home. The conversion of the existing screened porch to living space is permitted. The provisions of Southold CEHA sections 11-13(A)(5)4 and 111-13(6)(3)5 permit for the proposed work is appropriate. The proposed porch conversion to living space, is a modification and not a major addition, even if deemed a "regulated activity", and satisfies the criteria under which a CEHA permit can be granted. S. Trustees erroneously analyze provisions of the Southoldwrongly conclude the proposed project is r i . Proposed porch conversion does not expand the existing footprint at all. Even if the conversion of the enclosed porch to living quarters is deemed an addition to the principal building,it does not constitute a"major addition". The existing house is 1,270 square feet. The area of the porch is 193 square feet(or 15%)which is less than 25%of the existing living area.(Twenty-five percent of the floor area 259 of 1,270 is 317.5 square feet. The porch conversion of 193 square feet falls below the threshold of a"major addition"). 4 Nonmajor additions to existing structures are allowed on primary dunes pursuant to coastal erosion management permit and subject to permit conditions concerning location,design,and potential impacts of the structure on the primary dune. s Nonmajor additions to existing structures are allowed on secondary dunes pursuant to a coastal erosion management permit. 4 The Trustees incorrectly state that "no provision of the Coastal Erosion Hazard Areas allows for regulation of as built unpermitted structures." (Trustee decision May 18, 2022, pg. 2) (emphasis added), and that "the proposed action is located almost entirely within the coastal erosion hazard area and in a primary dune area, the Trustees deem the proposed project to be impermissible under Chapter 111." (Trustee decision May 18, 2022, pg. 2). The Trustees use of the phrase "as built unpermitted structures" is a term used in Southold Town Code Chapter 275, for pre-existing structures that have not received a wetland permit. However, the Southold CEHA in Chapter 111 does not use this terminology. As explained above,the provisions of Southold's CEHA confirm that existing structures, which predate the enactment of the CEHA are exempt, unregulated structures, which are entitled to legal recognition and protection. The CEHA includes provisions for normal maintenance, repair, replacement, modification of existing structures, which are all considered "unregulated activities", and exempt from the permit requirements. The CEHA states that "no coastal erosion management permit is required for unregulated activities". (Southold Town Code §111-8) If the proposed activities at this property are deemed "regulated activities", then the actions satisfy the provisions of the Southold CEHA section 111-9, which require the following findings be made with respect to the regulated activity, which are addressed in turn: A. Is reasonable and necessary, considering reasonable alternatives to the proposed activity and the extent to which the proposed activity requires a shoreline location. The structure is existing, and modifying the existing structure for additional living space has no reasonable alternatives. The owner's option would be to build a new addition on the landward side of the house. This option would require significantly 5 greater interior alterations to the existing house because of the existing floorplan of the rooms. The proposed interior expansion of the house with the existing porch does not result in an increase of the building envelope. All the work is proposed under the existing roof. The footings and support posts will be replaced with code compliant footings and support posts, all work will be done within the existing building envelope, B. Is not likely cause s r l increase in erosionproposed site r locations. The existing house was relocated to protect the house from erosion. The NYSDEC, which implemented the Coastal Erosion Law, reviewed and approved the relocation of the house. The DEC review would have considered the natural protective features such as the beach and dunes. The DEC did not find that the relocated house would impact the shoreline or natural protective features. The owner has maintained the property with pines and planted rosa rugosa along the seaward side of the house to minimize erosion and stormwater impacts. The house is almost 250 feet from the Long Island Sound Mean High Tide. Through the efforts of the homeowner with natural vegetation, the property has been protected from any erosion for the last 30 years. C. Prevents, if possible, or minimizes adverse effects on natural protective features and their functions and protective values, existing erosion protection structures and natural resources. There is no activity proposed seaward of the existing house. The existing vegetation will not be disturbed. The existing vegetation around the existing house is the natural planted buffer between the natural protective features on the seaward side of 6 the property. The natural protective features of the beach and dune vegetation are clearly delineated and end seaward of the existing house. CONCLUSION D. For the reasons set forth, the existing structures are unregulated and exempt from the CEHA and do not require a Coastal Erosion Hazard Area permit. The proposed repair activities and conversion of the porch (193 sq.ft.) are also exempt and unregulated activities which do not require a Coastal Erosion Hazard Area permit.
