After investigation and inspection the Board finds that
the appellant request permission to retaina "for sale" sign
on the Main Road. The house that is for sale is set back
off the Man Road. The Board points out that "for sale" signs,
must be exibited on the property that is for sale. The sign
must be set back in line with the front of the house. A "for
sale " sign is not permitted some 100 feet from the premises
that is for sale.
The Board finds that the public convaience and welfare
and justice will not be served ant the legally established or
permitted use of neighborhood property dnd 'adjoining use
districts will be 'permanently or substantially injured and
the ' -spirit of the Ordinance will not be observed.
There fore, it was RESOLVED thdt Roger H. Williams,
Hale Hollow Road, Huntington, Neal York, be denied permission
to retain a "for sale" sign on property located ori the south
side of the Main Road, East Marion, New Yo3k . This sign must
be removed by September 3Q, 1966.

As you know the Southold Town Building Zone Ordinance has since its
adoption in April of 1957 controlled the size of lots, the placing of structures
and the uses that may be carried on in the various districts. This has been
done in an effort to insure the proper development of our rapidly growing com-
munity.
In an effort to continue the orderly growth of the Town, I have been
instructed to write to you to apprise you of the provisions of the Zoning Ordinance
concerning the size and location of signs.
Section 1002 of the Zoning Ordinance provides that signs which do not
conform to the provisions of the ordinance shall be discontinued within five
years from the adoption of the ordinance unless their continuance is authorized by the
Board of Appeals. Section 1423 of the New York State Penal Law prohibits the
placing of signs within the limits of any public highway.
Set forth below is information with respect to signs on your property which
are in violation of the above provisions of the Zoning Ordinance. If you desire to
continue the use of such sign, it will be necessary for you to make application to
the Board of Appeals for permission to continue the same. Applications for such
purpose may be obtained at my office.
In the event that you fail to either remove the unauthorized sign or make
application to the Board of Appeals for authorization to continue the same, I
must as Building Inspector of the Town proceed to take the necessary legal steps
to remedy such violation.
Yours respectfully,
your "house for sale" sign
must be removed from the enterance
to bay lake park. such signs HOWARD M. TEARY
may only be displayed on the Building Inspector
house being sold.
