Villa~ Pursuant to our conversation this date, I enclose here- with copies of the action of the T~wnof Southold Zoning Board of Appeals on Appeal #99§ and the proposed map attache~ hereto, the ori- ginals of which are on file in the Town Clerk's Department. This i- a classical case of a property owner being ill represented by a real estate broker. The broker made the original application in 1966 under Town Law 0280(a) for recognit~on of access of a road to lots to be created. The e~lication was granted and the road was oonetructed. Since then in 1968, the Town adopted Sub- ~lvision ~egulations applying to all future sttbdivisions and the Cotmty adopted the 40,000 square foot rule pursuant to paragraphs IV and V of the standards promulgate~ under Article VI §1 SUFFOLK COUNTY SANITARY CODE. The ~wners have now retained my office and would like to sell severs1 of the lots. I think it best to place these facts before your department and obtain a written waiver of the aforesaid regula- tions end & statement ir~icat~ng that purchasers of the lots shall have Health Department approvals necessary to obtain building permits and to ins~ll Cesspools and wells. Public wa~er is not a feasible alternative, since the property is located on the East side of Light- house ~oad several thousand feet frc~ the main coedng out of the pump house at the intersection of North Road and Horton's Lane, Southold, New York. At $8.00 per foot, the main would cost more than ell the lots, at Current market value. Mr. Robert Villa has indicated that his department has no objection to issuing the requested waivers, however, he would like a letter in his file from the Planning Board or building inspector to the effect that this is a "pre- existing subdivision" to which the present Southold Town subdivision regulations will not be applied. Essentially, the Health Department wants to clear this matter with all parties before acting. I would appreciate if if such a "pro forma" letter could be sent to the Health Department forthwith. The Board of Appeals grants recognition of access to the appellants as applled for on Appeal number 995, and as shown on the survey map by Otto Van Tuyl and Son, map dated November 21, 1966. This approval ls subject to the final approval of the right of way by the Southold Town Building Inspector. You w111 receive the formal action of the Board of Appeals in three weeks. Schmitt and Mr. Best & Mr. Syverson (Mr. Schmitt's son-in-laws); and Mr. Eugene Daneri, all of Camp Mineola Road, Mattituck, New York, appeared before the Planning Board in reference to their properties. They complained about the property owners in this area dividing their properties. The Board informed them that a minor subdivision was granted to Lena F. Howell by the Planning Board. However, some of these lot owners in this area were granted permission to divide their properties by the Board of Appeals. The Planning Board advised them that they would not go along with any further minor subdivisions in this area, due to the lot sizes and the new requirements of the amendments to the Zoning Ordinance. The Planning Board advised them to go to the Board of Appeals and either complain about the granting of these variances or apply for variances on their properties. George Stankevich, Attorney appeared before the Planni Board in reference to the property of Ilie Wacs and Werner Rosenb~rg, located at east side of Lighthouse Road, Southold, N.Y. (formerly the Tillinghast Estate) Mr. Stankevich advised the Board that he has been retained by the owners for the sale of several of these lots. Mr. Stankevich has contacted the Health Dept. on this matter. Robert Villa informed him that the Health Dept. has no objection to issuing the requested waivers, however, he would like a letter in his file from the Planning Board or Building Inspector to the effect that this is a "pre-existing subdivision" to which the present Southold Town Subdivision Regulations will not be applied.
