9:00 A.M. - The Board audited vouchers.
9:25 A.M. - Michael Zwe_ig, member of the Economic Advisory Committee, met
with the Board to again discuss his proposal to study..~he grape and wine
industry durling the summer months. Mr. Zweig referred the Board to his
letters of support from the Economic Advisory Committee, vineyard owners
Cathy and John Simicich, and the Cooperative Extension Association of Suffolk
County.. Mr. Zweig has submitted a proPosal to the Department of Agriculture
and Markets for funding, and since his request to the Town for $16,~390.00 is
not being looked upon favorably by the Board, he would like the Town to allocate
one-half, $8,000.00, and he will'deal with the same questions posed by the project,
but not in the depth proposed, and probably without the research assistant. He
guaranteed he would not come back to the Board for the other $8,000.00 if 'he
does not receive it from Agricultural and Markets. Councilman Stoutenburgh
stated he supports Mr. Zweig's proposal for a study of the budding grape and
wine industr~_jn'this Town. CounCilman Schondebare agreed to supl~ort [he
$8,000.00, as did Councilwoman Cochran, Justice Edwards, and Councilman
Penny, as long as the study will cover specifically what is needed from the
study. Mr. Zweig was advised that a contract must be prep,ared by the Town
Attorney, outlining the specifics of the study, and if it is ready will be subject
of a Town Board resolution on May 6th. In the meantime the Board agreed to
transmit a letter to the Department of Agriculture and Markets endorsing Mr.
Zweig's proposal and committing $8,000.00 to pay half the cost; and supporting
Mr. Zweig's application to them for additional funds.
9:50 A.M. - Police Chief H. Daniel Winters met with the Board to discuss the new
soft body armor and the need to wear at all times or have readily available. He
will be discussing this at the Chief's Association meeting coming up shortly to find
out how it is handled by other departments.--Advised the Board that the Suffolk
County Police Academy should be opening in two or three weeks and the three new
recruits will be transferred from the Nassau Academy at that time,--The one new
seasonal officer, who had been attending training school, has left and he will have
to depend on the three seasonals used last year.--The impound area is in need of
new cyclone fence and the cost is between $2,100 and $2,900, which is under the
bid'amount.-.-Brought the Board up to date on the recent motor vehicle accident
of Police Officer Surozenski, his first in seven years with the department. There
were no injuries, and the estimated repair cost to the police vehicle is $600.00.r-
The Chief advised the Board that there has been a 15% increase, over 1985, of
incidents for the first quarter of this year.--Advised he would speak to Vernon
Wermlinger relative to retaining his services again this year as a part-time Bay
Constable in Mattituck Creek--Will join with Superintendent of Highways Jacobs
in requesting permission from the County of Suffolk to remove a Sycamore tree
in the county right-of-way at Moores Lane North, Greenport.
10:10 A.M. - A group of six young people appeared before the Town Board to
present a petition from the youth of Southold Town (103 names), and adult 'residents
(15 names), expressing their concern about the delay in the repairing of the
Southold Town Youth/Senior Citizen Center.....".We would like to take this opportunity
to make you aware of the need for a place to "Center" increasing activitieS. We
urge you to continue your efforts to do whatever is necessary to speed up the
progress.'L-Councilman Penny explained that the Town is ready to advertise for
bids and due to the lengthy process, it will'be at least three months before the
Center will be ready for occupancy.--Maryann Fleishman, Youth Counselor, who
accompanied the young people, explained that they are now meeting in her office
at the Center, a room which is not affected by the renovation, but there is in-
sufficient area for activities in that room. Ms. Fleishman also informed the Board
that they have been utilizing the Southold Legion for dances, and Town funds have
been used for those activities.

10:15 A.M. - Town T~ustee Presid~qt.~Henry P. Smith met with the Board to discuss
the Conservation AdviSory Coun~'ii's proposal for one of their members to conduct a
creek run-off survey during the summer months. Mr. Smith feels this survey would
be premature. Presently there is a road run-off correction project on Skunk Lane
and he would like to evaluate that first to see how it works out. Furthermore, he
feels such a survey is a Trustee matter. He feels the anticipated money to be paid
to the CAC member should be used for water samples at the Skunk Lane site. He
will contact the CAC and arrange a meeting to discuss this matter.
10:30 A.M. - For Discussion Items: (1) Letter from the Long Island Regional
Planning Board regarding census geography which is to be referred to Community
Development Administrator James McMahon. (2) Request by Councilman Penny to
exempt the building permit fee of $553,00 for the Mattituck Youth Activities. Town
Attorney Tasker advised the Board that they are already exempt, as a non-profit

requesting the Board to aid them in paying their liability insurance premium bill
(see resolution No. 39). (4) Proposal to waive the issuance of an Excavation
Permit, filing fee, excavation fee and maintenance bond associated with the "7th
Street Sewer Installation" (see resolution NO. 40). {5) Request of CounCilwoman
Cochran that a letter be sent to the Suffolk County Soil & Water Conservation
District, Riverhead, requesting that agency's expertise and knowledge in'helping
Southold Town solve an erosion problem at the Town's Laurel Lake property (see
resolution No. 41). (6) Letter from Assessor Chairman Frederick E. Gordon
advising the Board that A§sessor Clerk Typist Julia E; King will be retiring
June 1st. The Supervisor will call for a Suffolk County Civil Service List (see
resolution No. 42). {7) Interview date for part~time Clerk Typist for the Board
of Town Trustees to be scheduled by Trustee President Smith. (8) April '29th,
beginning at 6:00 P.M. set for interviews of applicants for the position of Board
of Appeals member. :(9) Proposal by Michael Zweig for a study of the grape and
wine industry - discussed with Mr. Zweig at 9:25 A.M. (10) Letter from Suresky
& Son, Inc., Goshen, NY. asking if the Board would like to purchase 50/50 added
coverage for the new 1986 Seven Passenger Dodge Caravan S.E.--Board.does not
wish same.
11:05 A.M. - Deputy Sup.efivisor Kujawski spoke about the maintenan;e dredging
problems, which he has also discussed with Shelter Island, with respect to a
possible coop dredge for the East End. He requested permission to explore this
possibility further. Board members thought this should be pursued and suggested
he work with Trustee President Smith on this.
11:10 A.M. - Franklin Bear, Chairman of the Water Advisory Committee, appeared
before the Boa'rd to ciiscus~ th'e Committee's' rep(Jrt to the Town Bc~d, da~ed April
29, 1983, which contained recommendations relative to types of actions to solve water
problems. Mr. Bear stated that Howard Weismann, on behalf of ERM, will be prepar-
ing an addendum to the ERM report to correct the shortcomings. Mr. Bear also
informed the Board that the April 29, 1983' recommendation addressed a townwide
information pr~ogram be established to promote public understanding of the water
supply situation. Mr. Weismann has advised the Committee he would be willing
and able to help with the information program. On May 1st some members of the
Water Advisory Committee will meet with Mr. Weismann-- to make a list of priorities,
and Mr. Weismann will also meet with Bill Gremler, water treatment distributor, to
discuss what services he can provided, as well as securing information from the
Water Associatio~ and Department of Health Services. The information program will
consist of printed material, support from the press and radio stations, and a slide
program to make the public aware of the problems we are facing and what can be
done on their behalf. Mr. Bear referred to resolutions No. 20 and 21, which were
placed on the regular meeting agenda by Councilman Penny, calling for the Town
Board to rescind their September 24, 1985' resolution which established a policy
with respect to the establishment of water districts in the Town, and calling for
a new policy of requiring that any new community water systems be dedicated
without cost to the Suffolk County Water Authority. He asked that these resolutions
be tabled since the Committee is concerned about the Water Authority coming into
Southold Town, and the Committee would like to meet with Water Authority Attorney
Roy VanNostran~t to make it very clear that if the Water Authority does come into
Southold Town that the town does not lose its control over the future.--Councilman
Penny stated the Town should not get into the water business when the Suffolk
County Water Authority will administer it free of charge. Councilman Stout~nburgh
said the Town should have local control over water systems. Deputy Supervisor
Kujawski asked the Board to hold up on the two resolutions until the Supervisor
returns from vacation, he did not see the resolutions until Friday afternoon, and
would like to be present to discuss them; furthermore Councilman Stoutenburgh
and Supervisor Murphy were movers of the September 24th resolution which Council-
man Penny is asking to rescind. Mr. Bear. again asked the Board to hold the
resolutions; he would like an opportunity to clarify what the policy of the Depart-
ment of Health Services is relative to the Suffolk County Water Authority coming
into Southold Town. Deputy Supervisor }(ujawski said he had called the Health
Department the day before and the said they do not have a policy with respect

to the Water Authority coming into Southold Town.--Members of the audience,
Ronnie Wacker and Linda Fletcher, League of Women Voters, urged the BOard
to wait and further study the water problem to determine if 'local control wouldn't
be the best measure. Richard Wilton and William Behr both favored the Water
Authority who would control the problem without cost, and both pointed out that
the Town Board, has the ultimate control with zoning.--Following the lunch recess
Councilman Penny agreed to table resolutions 20 and 21 until the May 6th regular
meeting.
EXECUTIVE SESSION - 12:15 P.M. - The Board dicussed personnel matters.
12:25 P.M. - Recess for lunch.
2:00 P.M. - Work Session reconvened and the Board met with Rob Brown of
Fai~eather-Brown, Architects, to review the specifications for bid for the build-
ing repairs and new hung ceiling at the Senior/Youth',Center. The speficiations
were determined to be in order and the Town Clerk will advertise for bids.--
Mr. Brown was asked to prepare a proposal to oversee the project and approve
the work to be done as per the specifications.
2:15 P.M. - M~ry Mooney-Getoff and Pat Combs, representatives ~f Host Homes
ofr the North Fork met with the Board to discuss a proposed zoning code amend-
ment with respect to bed and breakfast homes. The Board tentatively agreed
this proposal should be by Special' Exception of the Board of Appeals, the rooms
would be clearJy incidental and secondary to the principal use of the dwelling,
which shall be owner occupied, and there shall not be more than three rooms
and a maximum of six persons, exclusive, of the family of the owner. Off-~street
parking shall be provided for each.room, in addition to the parking requirements
for the owner.--Town Attorney Tasker will~ draft a proposed Local Law.
2:30 P.M. - The Board reviewed the regular meeting agenda, as well as a proposed
Local Law entitled, "A Local Law in relation to boat operators, boat equipment and
anchoring in West Harbor (Fishers Island)", which must be sul~mitted to the
Commissioner of Parks, Recreation and Hisioric'Preservation before a Town Board
public hearing. The Board approved the proposed Local Law and authorized Town
Attorney Tasker to submit it to the CommisSioner for approval.
3:40 P.M. - The Board reviewed the draft proposed Local Law entitled, "A Local
Law to make provision for Affordable Housing for moderate income familieS,'' which
will be redrafted by Town Attorney Tasker.--They also agreed to amend Local
Law No. I - 1986, Accessory Apartments, to provide for "Approval by the Suffolk
County Department of Health Services of the water supply and sewage disposal
system" (see resolution No. 45).

A Regular Mpeting of the Southold Town Board was held on Tuesday, April
22, 1986 at the Southold Town Hall, Main Road, Southold, New York. Deputy
Supervisor Frank A. Kujawski, Jr. opened the meeting at 7:30 P.M. with the
Pledge of Allegiance to the Flag.

Richard Jersey, President of the North Fork Chorale. I would like to introduce you
to the members of the Board. Councilman Penny, Councilman Schondebare, our Town
Clerk Judith Terry, our Deputy Supervisor Frank Kujawski, Councilman Paul Stoutenbu
Judge Edwards, Councilman and Judge, and our Town Attorney Robert Tasker. If I

Moved by Councilwoman Cochran, seconded by the Entire Town Board,
WHEREAS, THE NORTH FORK CHORALE, INC. is celebrating, the FIFTIETH
ANNIVERSARY of their debut, and
WHEREAS, THE NORTH FORK CHORALE, INC. was first formed in 1936 under the
name of the SOUTHOLD TOWN CHORAL SOCIETY by a group of music loving people
who made singing their hobby, and
WHEREAS, then the Southold Town Choral Society was formed, Walter Williams, a
music teacher at Mattituck High School, and Arturo Papalardo, their voice teacher,
were instrumental in pulling the group together, and
WHEREAS, at least three charter members of THE NORTH FORK CHORALE, INC.
will be performing at a four-performance anniversary concert in May: Elsie Downs
Kiski, Karen Phillips Eckert, and Barbara Bergmann Sayre, and
WHEREAS, for the past fiftY years THE NORTH FORK CHORALE, INC. has provided
an opportunity for people to sign together, and provide musical education and
appreciation to its members and the community, now, therefore, be it

DEPUTY SUPERVISOR KUJAWSKI: Jean?
COUNCILWOMAN COCHRAN: Yes, I attended the Parks and Beaches meeting, which
Councilman Stoutenbur'gh will' be report on. And also as to a meeting up at the bo?h
ramp in Mattituck. Also attended, On the 15th, CSEA meetin9, of whicl~ C~uncilma~i il
Penny is Cha~n~n. And on the 16th attended the Commerce and Industry
of which was on the agenda was the status of the Master Plan and the Zoni~;~:p,
and we understand that that review has been completed by the Planning Board~:'~ind
has been suUmitted to RPPW for drafting and printing. Also as a result of discussion,
a suggestion grew out of the discussion that evening that perhaps a committee should
be formed and established consisting of the Town Planner, the heads of the Boards--
the ZBA, the Planning, the Trustees, along with the Building Department overseer
Vic Lessard, and the Town Attorney, to review the regulations to simplify and to
consolidate. It was the feeling, during discussion, that the regulations as they have
been presented to us are bulky and could be streamlined. I'm sure this 'will be some-
thing that the Town Board will' be discussing; in fact i'd like to see it discussed at
the next Board meeting as to what the continaing process is going to be in relation
to the Master Plan. Also one of the things that was discussed is the coming along
of the Chamber Booth in Mattituck, and it is coming along very nicely. The outside
is pretty well constructed and the Chambers--the combined Chambers are responsible
for finishing off part of the inside--the sheetrock and that sort of thing. They have
appointed a new committee from the Chambers to be responsible for overseeing the
building and its operation and that is Peter Kren and Lois Southoff, and Joe Nolan.
So the new committee is appointed by the Chambers to be responsible and for us to
work with. I think that's it, Frank.
DEPUTY SUPERVISOR KUJAWSKI: Thank you, Jean. Paul, do you have anything
to report ?
COUNCILMAN STOUTENBURGH: Yes. Parks and Beaches Committee met, as Jean
said, and we met for an exploratory meeting at Mattituck Inlet, and we had invited
a person from the County to come a]ong and give us some ideas and basiCally he
proposed that we get some soundings and some elevations which are going to be
done tomorrow by our Highway Superintendent, and then he would give us some
rough ideas of where to go from there. Also another part of our Beach and Parks
Committee meeting was two things we took up--one was the Kenneys Beach and the
New Suffolk areas. Kenneys Beach, again~ I'll repeat just to make sure that people
understand. We had some questions of what we were doing down there, and that is
that we are going to surely open up the beach at the usual area, hopefully covering
the debris on the beach with sand so that it will make a worthwhile' beach, and I
think we found out that in New Suffolk the parking area that we spoke about also
had a problem in the sense that we didn't have money enough to make a large parking
area that was requested down there, and so we're going to hold that one off and
park the cars on the grass. I might add, to bring it up, to where we are as far
as the County Dredge is going--we do have the County Dredge at the New Suffolk
ramp. It was there and has comPl~&iSl~'it~' work there--has now moved on to Halls

Hole Creek.
DEPUTY SUPERVISOR KUJAWSKI: Brushes Creek isn't it? Laurel?
COUNCILMAN. STOUTENBURGH: I'm sorry. I said Halls Creek. That's right, it
is Brushes Creek. Thank you for the correction, Frank. Also I attended a Water
Advisory meeti.n.g, on April 14th in which the committee was reviewing its goals and
it is probably going to come up to the Town Board with a suggestion on where to
go from here as far as water districts go, and I think I'm also going to leave part
of this :off for George, who was attending another meeting which was called because
of this one and I couldn't attend that one. So I'm going to leave that to George.
I attended the CSEA meeting,. I think, Jean, you were there--no, you were not
there, were you, Jean?
COUNCILWOMAN COCHRAN: Yes, I was.
COUNCILMAN STOUTENBURGH: You were there?
COUNCILWOMAN COCHRAN: Yes.
COUNCILMAN STOUTENBURGH: Yes, you were. Okay. I was at one and you
weren't. Which one was that? During the month I thought you missed one.
CSEA was a meeting in which we were trying to get negotiations for the last part
of our contract, which is coming along but very slow. Let's see. We attended a
Trustees meeting in which Victor Lessard met with the Trustees and they--it was
a special meeting and they discussed problems of law enforcement, which some of
you know, know the background of the problems we've had with wetlands and we
have this cleared up once and for all what the obligations, duties, and how to
handle the problems of law enforcement. It was a very good meeting I thought.
And that was on the 14th, and on the 15th I had the pleasure of sitting with the
engineering firm who's doing the Skunk Lane ,drainage problem, and the water
purification people. ! wanted to see what was going on there, and they have
everything ready to go, except for the legal ends of it right now, and they are
very concernecl abOut time element for the one particular project and that is the
project of planting the grasses and the reed bed, which is supposed to filter the
water out, and if we can clear that up that's the big hold right now. They have
to plant within a certain timeframe or it's just like planting potatoes, you plant
them at a certain season and you have to have that done, and I hope we can
clear that problem up. That's it, Frank.
DEPUTY SUPERVISOR KUJAWSKI: Thank you, Paul. .lay?
COUNCILMAN SCHONDEBARE: I attended the Beaches and Parks one with Paul--
he's already commented on. We i~lso had a Landfill Committee meeting. Mostly
nuts and bolts type of operation type of committee, but to give you some idea what
it costs to run that Landfill--th~ tires on the payloaders have to be a certain type
otherwise they'll run across the metal and they'll get cut, so they can't be simply
air~ They try to get the foam type, or. the styrofoam inside the tires. Four tires
cost $32,000. To give you some idea how much your garbage costs and how much
it costs to take care of that on a daily basis and those tires do not last that long.
I keep thinking we had a Police Committee meeting, but I guess we didn't. ! think
the Chief was there are the Landfill ' and that's how we got into that, so we had a
half-quasi Police Committee meeting I think also. That's it. Thank you, Frank.
DEPUTY SUPERVISOR KUJAWSKI: Okay. George?
COUNClLMANY PENNY: On the 9th I attended a meeting of the Mattituck Youth
Activities. I don't know if everybody's aware of it, but it'S a group at Mattituck
which is trying to relocate a building on Mattituck Park District property. They've
got permission from the Park District and we're waiting now for the DEC, as every-
body probably is, and we're also waiting for a surveyor and then we're going to
put up a building there which will be open to the youth of Mattituck hamlet. On
the 11th I attended a Department of State Seminar in Farmingdale and got into all
sorts of interesting discussions. The good news is that the State budget programs
are up. Ther_e seems to be a lot of money floating around the State. The bad news
is is that the Federal budget is down. So it was kind of a mixed report. We got
into economic practices affecting government finances, risk management as far as
liability insurance goes, how to minimize the adverse effects of loss through pre-
planning and pre-funding of all risk exposures. That went on--it was lengthy
and I don't think anybody wants to go into all that tonight. On the 14th there
was a meeting of the Water AdvisOry Committee which I attended. On the 15th we
had a CSEA meeting. We met with John Raynor and we're setting up a regular
session of meetings with the Town Labor Management Committee to deal with problems
before they happen. We think it's going to be very, very productive and we're
trying to develop a good rappot with the Town employees. At the same time that
that was going on there was an uno. fficial Dog Pound meeting. Bill Zitek met with

Gary Strang to discuss some possible changes for the Dog Pound plans and some of
the other people from the Animal Welfare League were there, only I was unable to
attend that one. On the 16th I attended the Commerce and Industi~y Committee.
On the 17th the Landfill' Committee, and last night was a very thoroughly productive,
very lengthy session--Ruth Oliva didn't let me leave until '11:00 o'clock last night,
of the Water Advisory Committee. We're going to be setting steps for an informational
program to make the public aware of the help that is available to them and how we
can possibly help them through accumulating the information that is around, and this
will be coming up future meetings. It was a very, very productive session last
night and there'll be a lot more come out of this. We're going to be hopefully
looking to get some funding out of the Town Budget for 1987. Thank you.

DEPUTY SUPERVISOR KUJAWSKI: Under Communications we have a letter (1)
from the Stirling. Eastern Shores Association, Inc.. Basically the~'letter concerns
a tree on Route 48 and Moores Lane North that obstructs vision, and I think Mr.
Jacobs will be taking care of that.
TOWN CLERK TERRY: Mr. Schroeher is here, so you might tell him what was
discussed.
DEPUTY SUPERVISOR KUJAWSKI: Mr. Schroeher, Mr. Jacobs and Chief Winters
are going to get together. It is a county road, but I think they were going to
ask the County if :they could take it down.
MR. SCHROEHER: The tree is on either private property or County property.
It's on the corner there and it's a terrible obstruction, and as I explained in
the letter, I wrote to the Town Board that there was a serious accident there
about a week ago. Now the Chief, he did have the hedges cut down on the
west side of Moores Lane North. That was an obstruction too. It took me two
years to have them cut back. The Chief finally had them cut back and now this
tree--there was a serious accident, so ! contacted him' immedia[ely and he said,
write a letter to you people and he said he'll take care of it with the County, I
presume.
DEPUTY SUPERVISOR KUJAWSKI: Yes. We get permission from the County, but
we'll take care of it.
COUNCILMAN SCHONDEBARE: The way I understood it was is we get permission
from the County because it's their property, but I think the Highway Department
is going to cut the tree down. Our Highway Department.
DEPUTY SUPERVISOR KUJAWSKI: It's coming down.
COUNCILMAN STOUTENBURG: I think we're going to have it taken down, for
sure, one way or the other.
MR. SCHROEHER: Thank you very much. I appreciate it.
DEPUTY SUPERVISOR KUJAWSKI: The next letter (2) is from CAST it's very
brief, so i could read it: "Thank you very much for the use of the council room -
on Tuesday, April 1. Our meeting on substance abuse was quite well attended
with people coming from most of our villages. Parents, teachers, social workers,
boy and girl scout and 4-H leaders, police and local government officials took part
in an active and rewarding discussion on substance abuse by children and youth.
I believe the use of Town Hall lent status to the meeting and the room itself is
both attractive and comfortable. Thank you again;" This is from Margaret
Katzenberg, Chairperson.
COUNCILWOMAN COCHRAN: Frank, if '1 just may add to that. The next meeting
has been scheduled--again here for Town Hall for May 27th, and this will be directed

JUSTI'CE ED~WARDS: I'll explain what this is. The Town of Southold has a large
holding of real property on Fishers Island that is under control of the Ferry
District, but the Town of Southold has really the final say in it, and with the
upcoming Master Plan there were some people on the Island that didn't think that
the Town of Southold would do iustice to them and that they would possibly want
to sell of this real estate, and so in changing the legislation, which Mr. Tasker, I
believe, wrote it up, or had something to do with it---
TOWN ATTORNEY TASKER: I wrote it.
JUSTICE EDWARDS: --it now leaves the Ferry District in control of this property
and any property that is to be sold down there on the Island that was formerly
the Town of Southold and under custodialship of the Ferry Dis[ric[, can only be
done by a vote of the taxpayers of the said district, so in a sense the people on
the Island now have better control over this property, and this is what these two
resolutions mean.

DEPUTY SUPERVISOR KUJAWSKI: What I meant, Ge~)rge, was to explain what
that meant about meeting with petitioners. What this means is that if people
who are going to be asking the Town Board for a change or for something, can
no longer meet with the Town Board to discuss their proposal prior to the public
hearing. If there's goin9 to be any information given by the party, it should
be given at the public hearing when everyone gives their opinion.
COUNCILMAN STOUTENBURGH: The idea is that you should have two sides to
the story, not just the person who's bringing the idea to the Town Board, but
there should be the other side represented.

from "C" Industrial Districi to "M-l" General Multiple Residence Districl~, and
WHEREAS, pursuant to the provisions of Article 8 of the Environmental Conservation
Law, Part 617 of Title 6 of the New York State Codes, Rules and Regulations, and
Chapter 44 of the Code of the Town of Southold, the Town Board, as lead agency,
determined that the action proposed is a Type I action and is likely to have a
significant effect on the environment, and

BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK, ADOPTED APRIL
22, 1986, AUTHORIZING THE CONSTRUCTION OF A DOG POUND AT PECONIC
LANE IN SOUTHOLD TOWN, STATING THE ESTIMATED MAXIMUM COST THEREOF
IS $125,000.00, APPROPRIATING SAID AMOUNT THEREFOR, AND AUTHORIZING
THE ISSUANCE OF $125,000.00 SERIAL BONDS OF SAID TOWN TO FINANCE SAID
APPROPRIATION.
THE TOWN BOARD OF THE TOWN OF SOUTHOLD, NEW YORK, HEREBY
RESOLVES (by the favorable vote of not less than two-thirds of
all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, New York (herein
called "Town"), is hereby authorized to construct a dog pound at
Peconic Lane in Southold, and to purchase the original
furnishings, equipment, machinery and apparatus required in

connection with the purpos said building is to be
used. The estimated maximum cost of said specific objec5 or
purpose, including preliminary costs and costs incidental thereto
and the financing thereof, is $125,000 and said amount is hereby
appropriated therefor. The plan of financing includes the
issuance of $125,000 serial bonds of the Town to finance said
appropriation, and the levy and collection of taxes on all the
.taxable real ~roper~ty in the Town to pay the principal of said
bonds and the interest thereon as the same shall become due and
payable.
Section 2. Serial bonds of the Town in the principal
amount of $125,000, are hereby authorized to be issued pursuant
to the provisions of the Local Finance Law, constituting Chapter
33-a of the Consolidated Laws of the state of New York (herein
called "Law") to finance said appropriation.
Section 3. The following additional matters are hereby
determined and declared:
(a) The existing building is of Class "A" construction
as defined ~y Section 11.00 a. 11. a of the Law, and the period
of probable ~sefu!ness of said specific object or purpose for
~hich said $125,000 serial bonds authorized pursuant to this
resolution are to be issued, within the limitations of Section
11.00 a. ! of the Law, is thirty (30) years, however the bonds
authorized pursuant to this resolution or the bond anticipation
notes issued in anticipation of the sale of said bonds shall

issuance of bonds or notes heretofore or herein authorized for

(b) Current funds are not required by the Law to be

d. 5 of the Law.
(c) The proposed maturity of the bonds authorized by
this resolution will not exceed five (5) years.
Section 4. Each of the bonds authorized by this
resolution and any bond anticipation notes issued in anticipation
of the sale of said bonds shall contain the recital of validity
as prescribed by Section 52.00 of the Law and said bonds and any

obligations of the Town, payable as to both principal and
interest by general tax upon all the taxable real property within
the Town without limitation of rate or amount. Hhe faith and

notes issued in anticipation of the sale of said bonds and
provision shall be made-'annUaliy in the ~b~dg'e~ 0f the ToQh~by
appropriation for (a) the amortization and redemption of the
bonds and any notes in anticipation thereof to mature in such
year and (b) the payment of interest to be due and payable in

Section 5. Subject to the provisions of this resolution

relative to the authorization of the issuance of bond
anticipation notes and of Section 50.00 and Sections 56.00 to
60.00 of the Law, the powers and duties of the Town Board
relative to authorizing bond anticipation notes and prescribing
the terms, form and contents and as to the sale and issuance of
the bonds herein authorized and of any bond anticipation notes
issued in anticipation of said bonds, and the renewals of said
notes, are hereby delegated to the Supervisor, the chief fiscal
officer of the Town.
Section 6. The validity of the bonds authorized by this
resolution and of any notes issued in anticipation of the sale of
said bonds, may be contested only if:
(a) such obligations are authorized for an object or
purpose for which the Town is not authorized to
expend money, or
(b) the provisions of law which should be complied with
at the date of the publication of such resolution
are not substantially complied with,
and an action, suit or proceeding contesting such validity, is
commenced within twenty days after the date of such publication,
or
(c)_ such obligations are authorized in violation of the
provisions of the constitution.
Section 7. This bond resolution shall take effect
immediately, and the Town Clerk is hereby authorized and directed
to publish the foregoing resolution, in full, together with a

RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs the Town Clerk to instruct Val Stype & Sons, Insurance Agents,' to increase
the insurance coverage for the contents of the Collection Center buildin9 at the
DEPUTY SUPERVISOR KUJAWSKI: Number 44.

RESOLVED that the Town Board of the Town of Southold hereby authorizes the
installation of a rear window defogger by Suresky & Son, Inc., Goshen, New York,
at a cost of $150.00, in the newly purchased 7-Pasenger Dodge Caravan S.E. for
the Assessor's Office.

WHEREAS, there has been presented to the Town Board of the Town of Southold
a proposed Local Law entitled, "A Local Law in relation to Accessory Apartments
in existinq dwellinqs", now, therefore, be it
RESOLVED that the Town Clerk be and she hereby is authorized and directed to
transmit this proposed Local Law to the Southold Town Planning Board and Suffolk
County Department of Planning in accordance with the Code of the Town of SotJthold
and the Suffolk County Charter. Said'proposed Local Law reads as follows, to wit:

Chapter 100-30B, Subsection (15) as added by Local Law No. 1, 1986, is amended
by adding a new paragraph thereto to be paragraph (p) to read as follows:
(p) Approval by the Suffolk County Department of Health Services of the water
supply and sewage disposal system.

COUNCILMAN STOUTENBURGH: What this does is it adds to the law, actually,
the Health Department must come in and check the residence to see lhat the water
supply and sewage is adequate for it. Basically that's what the law reads.

!ead agency.in regard to the State Environmental Quality Review Act in the
matter of a p. roposed contract between National Gas and Electric Corporation of
America and the Town of Southold for a franchise to extract landfill gas for the
purpose ~f crea~i'~g electric ~nergy,-selling or ot'~erwise disposing of the gas or
electricity from the premises commonly known as the Cutchogue Landfill si{e, for
a period of five (5) years.

COUNCILWOMAN COCHRAN: I would like to address the other members of the
Board. Since 'we now have night meetings, ! think we should begin to look very
seriously at r~eservations on Fishers Island, since we will be forced to stay over-
night because all meetings are at night and what do we do with Fishers Island,
and what do we do with our budget hearings that we usually schedule one at
3:00 and one at 7:00?
COUNCILMAN STOUTENBURGH: We can make special resolutions.
COUNCILMAN SCHONDEBARE: Oh, sure, we'll pass a resolution iust amending
it. ·No problem.
COUNCILWOMAN COCHRAN: Okay. I just wanted to make you aware of this
situation, Mr. Schondebare.
COUNCILMAN SCHONDEBARE: No problem there, Councilwoman Cochran.
COUNCILWOMAN COCHRAN: Okay.
TOWN CLERK TERRY: Do you want to make that resolution soon? You want to
make those reservations for Fishers.
COUNCILMAN PENNY: We're staying at the Judge's house, aren't we?

COUNCILMAN STOUTENBURGH: In other words you have meetings--of the people
in the audience and the press--that's what I'm saying. The number of people in
the audience of each meetin9.
TOWN CLERK TERRY: Oh, no, I don't, Paul.
COUNCILMAN STOUTENBURGH: I think this would be rather interesting figure to
look at some day.
TOWN CLERK -TERRY: Exclusive of the press, Paul?
COUNCILMAN STOUTENBURGH: Yes, exclusive of the press.
TOWN CLERK TERRY: Five people, exclusive of the press. Press four.
COUNCILMAN STOUTENBURGH: I think it would be a good idea if we did this
at every meeting. Get an idea of where we are and how much interest there is.
COUNCILMAN SCHONDEBARE: I agree with you, Paul. Because if'we've sinned,
we'll ce.rtainly change it back the other way.
COUNCILWOMAN COCHRAN: I don't know why, if I may, keeping track at this
point is going to serve a purpose. If it had been done over the past year when
you had some of your meetings at 3:00 and some at 7:30, and all of us, I think,
realize that when you have your biggest attendance is when it's a controversial
issue, rather it's scheduled in the daytime or at night. That's when you bring
people out, if it's something that is controversial'.
COUNCILMAN STOUTENBURGH: I would like to have it done. On article 16--
that's Southport--when you send the letter, could you say it's unanimous? Okay?
Just put that i-n there. I think it's important that they realize that we're all in
agreement on this.
TOWN CLERK TERRY: Yes.
COUNCILMAN SCHONDEBARE: Speaking of Southport. I read that letter from
the CAC, and I'll speak as myself, as a Board member, the person who--one of
the attorneys, I think, who represents Southport, got up and took exception to
the letter that was written, and upon reviewing the letter, I have to confess that
I'm somewhat disappointed that one of our Boards would write such a letter to
an applicant, and I expect that a Board, when they're writing letters for public
record do so in an objective manner, and not subjective, and put their own personal
feelings in it. The only thing that will accomplish will get us all into a lot of trouble.
