After investigation and inspection the Board finds that the
appellant request permission to retain an on premises identification
sign with insufficient setback. The appellant is in the real
estate business. The appellant's property is zoned "B" Business
District and is surrounded by "A" Residential and Agricultural
District. The Board finds that the sign presently projects beyond
the property line. The Board points out they do not have authority
to grant signs on Federal, State or Town property. The Board finds
there will be no hardship involved for the appellant to move the
sign back the required five feet.
The Board finds that the public convenience and welfare
and justice will not be served and eht legally established or
permitted use of neighborhood property and adjoining use districts
will be permanently or substantially injured and the spirit of the
Ordinance will not be observed._
Therefore, it was-RESOLVED that Charles Dougherty, d/b/a
Teves Realty, North Road, Southold} New York, be denied per-
mission to retain an on premises identification sign with
insufficient setback as applied for on the application
to the Board ,of Appeals, application dated November 21, 1966.
The sign shall be relocated to be at least five feet from the
property line.
