SOUTHOLD TOWN BOARD

9:00 A.M. - Board of Appeals Chairman Gerard Goehrin~er met with the Board to
discuss computerization of! the town departments. He suggested the appointment of
a steering committee of two Town Board members and some of the department heads
to investigate computerization possibilities. He spoke about the Lanier computers used
in the county offices which? might be considered by the town. Assessor Chairman Fred
Gordon suggested hiring a consultant which was generally agreed upon by the Board.
9:30 A.M. - Planning Board members William Mullen, G. Ritchie Latham and Richard
Ward to seek input from the Town Board with respect to the Norris "M" zoned property
at New Suffolk Avenue. and Camp Mineola Road, Mattituck, presently under contract
by Richard Carr, who intends to develop the property in accordance with the "M" zone
regulations. Mr. Ed Sieqmann, representing area property owners, expressed their
objections to the proposed construction of 95 condominium units. The Town Board
directed the Planning Board to proceed with the present application. Although the
proposed Master Plan calls for two acre zoning on that property, the Master Plan is
not in place, and a Supreme Court decision in the 1970's upheld the change of zone
to "M" against the objections of adjoining property owners.---Mr. Ward presented
proposed Cluster Development amendments for the Board's consideration, and proposed
covenants and restrictions for affordable housing.--Counc,ilman Stoutenburgh presented
a proposed Local Law with respect to an architectural review board which had been
drafted by the Planning Board in July of 1984. This proposal will be reviewed before
final presentation to the Town Board.
10:00 A.M. - Housing Advisory Committee Chairman Herbert R. Mandel, and committeo
members George Wetmore and Lois Callis appeared before the Board to present the
committee's Southold's Affordable Housing Program, dated January 23, 1986.. "It is
the belief of the Southold Housing Advisory Committee that affordable housing for the
citizens of the Town should be provided by a special zoning ordinance which permits
varying densities in specific districts; by mitigating some infrastructure regulations;
and by streamling the process of obtaining permits to build .... The program is focused
in the hamlet areas of town, where it is judged to have the best chance of success
and where it is most likely to conform to traditional patterns of development in rural
and small town communities .... . A copy of the program is on file i~n the Town Clerk's
Office. :-Former Superintendent of Highways Raymond C. Dean~w~-:present during this
meeting and spoke to the Board with respect to the highway specifications, definition
of ~econdary ~roads, and the consequences of constructing ~ubstandard roads, which
would require approval by a Town Board resolution.
11:30 A.M. - Lewis L. Edson, on behalf of the North Fork Country Club, appeared
before the Board to request the Town to condemn the country club building and
order the demolition and backfill of the building. The request was referred to the
Building Department for inspection.
11:45 A.M. - For Discussion Items:(1)Letter from Bay Constable Donald Dzenkowski
with reference to a request of Fishers Island Harbor Ma'ster Clavin for channel markers,
mushroom anchors, signs for the harbor and proposed changes to Chapter 32 of the
Code with reference to West Harbor, F.I. Bay Constable Dzenkowski will be working
with Mr. Clavin to satisfy his requests. (2) Upcoming expirations of terms of two
members of the Farmland Committee. Town Clerk instructed to advertise for resumes
(see resolution No. 24). (3) Resumes received for Water Advisory Committee vacancy--

Supervisor to schedule date for interviews. (4, 5, 6) Requests for waivers from the
provisions of'Local Law No. 14 - 1985 - applicants to appear at 2:00 P.M. (7) Letter
from Historian Goodrich relative to preservation of the historic quilt now on display in
the Meeting Hall. Board feels quilt should be encased in a cabinet and Supervisor
will make arrangements for the construction of same. (8) Letter from Harbor Master
Clavin which was discussed in item (1) above. (9) Letter from the NYS-DEC with
respect to the Sewer Use Ordinance for the Fishers Island Sewer District. Town
Attorney Tasker will be asked for review same. (10) Councilwoman Cochran asked
the Board's feelings on the proposed allocation of funds for updating and reprinting
the "Southold Town Resource Book of Service Agencies and Related Associations" by
the CAST Substance Abuse Committee. The Board was in agreement and it was
suggested a large portion of this could be done on the Town Hall copy machine.
(11) Request of the Conservation Advisory Council to use the Town Hall meeting
hall between 9 AM and 2 PM on Saturday, March 8th and the use of their budgeted
funds for refreshments, when they will meet with CAC's from Southampton~ East
Hampton, Riverhead and Shelter Island. Board agreed. (12, 14, 15) WaiVer requests--
applicants to appear at 2:00 P.M. (13) Date for interviews for Building Inspectors
will be coordinated by the Supervisor's Office in conjunction with the Building Depart-
ment. (16) Letter from Pelletreau & Pelletreau relative to approval of site plan for
premises zoned M-Multiple at New Suffolk Avenue and Camp Mineola Road, Mattituck
was discussed with the Planning Board at their 9:30 A.M. appointment. (17) Receipt
of report from Attorney General Robert Abrams with respect to Sanitary Landfills in
New York State and the Potential for Hazardous Waste Dumpings in which the town
of Southold is mentioned. (18) Proposal by Phone-Review, Inc. to report discrepancies
to the New York Telephone Co. and obtain credit was accepted by the Board (see
resolution No. 25).
EXECUTIVE SESSION
12:25 P.M. - The Board discussed personnel and wages.
12:50 P.M. - Recess for lunch.
2:10 P.M. - Work Session reconvened and the Board met with the following applicants
for waivers of the provisions of Local Law No. 14 - 1985:
Andrew E. Goodale, relative to the consturction of an office in an existing d~elling
~-7--~-~-~-~in~ Mattituck [see resolution No. 26). Garrett A~ Strang, on~h~i
of Gordon Schlaefer, relative to changing the status of the Wedgewood Shop,
Road, Southold, from home furnishing accessories to home furnishings and accessories.
This request is being held pending the redefinition of uses in a Limited Business
District in the proposed zoning code. Charles Cuddy, on behalf of Barbara Schriever,
with respect to the uses of her premises located on the west side of Tabor Road,
Orient (see resolution No. 27). Gary Flanner Olsen, and Edmund and Joan Pressler,
with respect to the use of the Pressler premises located on the north side of Route
25, Southold (see resolution No. 28). John C. Tsunis, on behalf of "280 North Road",
with respect to the premises on the south side of Route 25, Greenport. A Waiver was
denied with respect to a proposed use and now Mr. Tsunis stated the applicant proposes
to utilize the premises to conform with the uses in a Residential Office Distric[ (see
resolution No. 29). Katherine Farr and her husband with respect to their premises
at 110 Manhanset Avenue, Greenport (see re'solution No. 30). Patricia Moore, rep-
resentin9 Rudolph Bruer, and Mrs. Janet Tucker, with respect to Mrs. Tucker's
premises at Fishers Island (see resolution NO. 31...which was denied).
3:05 P.M. - Jeanne Marriner, representing the Leaque of Women Voters, appeared
before the Board to urge them to undertake a program of public education about the
proposed zoning law amendments before going further with the process of enacting
the new amendments, and the League's offer to assit the Board in informing Southold
Town residents in whatever way they feel is most enlightening and appropriate.
Mrs. Marriner also addressed the Board, as a private citizen, with respect to the
Master Plan and her opinion that the Town Board are going for short-term profits
without considering the long term economic vitality of Southold Town; there is no
marketing plan 'to develop the economy around. In a prepared statement Mrs.
Marriner stated, "We do have a potential unifying concept - the unique character for
which there is and could be a great demand. The North Fork could be another
Williamsburg, Virginia for example - attracting tourists and our seasonal residents
year round and providing dollars for our local businessmen." She offered to explore
her concept further at another time, but urged the Board to think long range plans
and what they are building for the future when they consider zoning changes, and
urged that they talk with the Economic Advisory Committee before they are pressured
by the developers into making serious mistakes with the North Fork.
3:15 P.M. - Tony Blados and ~wo colleagues met with the Town Board to discuss
possible life insurance coverage for certain Town officials, the overall cost of which
will be analyzed by the Board before further consideration.

3:40 P.M. - Ralph Condit, Conserv~{~'~¢~'~isory Council member, met with the Board
to discuss a recent study of critical areas of coastal fish and wildlife habitats in the
Town of Southold as released by the New York State Department of State, and the
re-evaluations and expansions of the areas proposed to be submitted by the CAC.
Councilman Stoutenburgh requested the Supervisor to send a covering letter supporting
the re-evaluation and upgraded ratings,, which will be done.
4:15 P.M. - The Board reviewed resolutions for the Regular Meeting agenda and
audited outstanding vouchers.

7:30 P.M.
A Regular Meeting of the Southold Town Board was held on Tuesday, February
4, 1986 at the Southold Town Hall, Main Road, Southold, New York. Supervisor
Murphy opened the meeting at 7:30 P.M. with the Pledge of Allegiance to the Flag.

SUPERVISOR MURPHY: The first order of business I'd like a resolution approving
the audit of the bills of February 4, 1986.
Moved by Councilwoman Cochran, seconded by Justice Edwards, it was
RESOLVED that the following audited bills be and hereby are ordered paid: General
Fund Whole Town bills in the amount of $20,689.48; General Fund Part Town bills in
the amount of $18,751.09; Highway Department bills in the amount of $14,798.83;
Fishers Island Ferry District bills in the amount of $9,690.83; and Southold Wate-
water Treatment Plant bills in the amount of $25,153.18.
Vote of the Town Board: Ayes: Councilman Penny, Councilwoman Cochran, Council-
man Schondebare, Councilman Stoutenburgh, Justice Edwards, Supervisor Murphy.

of January 21st, 1986 and the Special Meeting of January 28th. 1986.

held on January 21, 1986, and the minutes of the Special Meetinq of the Southold

at 3:00 P.M., Tuesday, February 25, 1986, at the Southold Town Hall, Main Road,
Southold, New York.

I. REPORTS.
SUPERVISOR MURPHY: Next on the agenda is Item No; I, Reports. For anyone
in the audience, these reports are on file with tile Town Clerk. Any reports that
you are interested in you may always find there.
1. Southold Recreation Department - Susan Fossett - December 1985 report.
2. Town Clerk Terry - monthly report - January 1986.
3. At this time I'd like to ask the Councilmen on special reports of their
activities for this month; George.
COUNCILMAN PENNY: Yes, we had a meeting of the Highway Committee last
Friday and a couple of things were discussed. One was the concern frOm someI'~
of these citizens in the western portion of Town about the traffic limit on Sound
Avenue and that has been addressed. The Chief of Police is sending a letter ,t~j
requesting that it be--it's a bad zone and it's going to be dropped, hopefully, to
45 miles per hour, which will coincide with Riverhead. Mind you that is a section
of Town, or a section of the road in Town that is going to be coming up for improve-
ment in the next few months. The funds have already been approved for this, so I
think that we're acting in a timely fashion on that. We got into another discussion
on some of the roads of subdivisions which we've put off right now. They will be
brought up at a later date with a recommendation from the Highway Department. As
far as the Dog Pound goes, we haven't made any progress at this point, but starting
tomorrow we have an architect that will be working with us and I hope to meet with
him: tomorrow at noon and start making plans for the new building, there. As far
as Buildings and Grounds goes, a little bit of bad news on the Peconic Civic Center.
We've got a delay because the labor to fix the outside of the building is running a
little higher than we anticipated and it's going to have to go out for bids, so there
may be, hopefully, a short-term delay in this until we can go out to bid on it, but
the materials are on their way and what we've got to do at this point is just basically
line up somebody to do the labor and we have to do it through the bid process, so
it's unfortunate, but there's going to be a slight delay [here. That's all.
SUPERVISOR MURPHY: Thank you, George. Jay?
COUNCILMAN SCHONDEBARE: Yes, Frank, I attended the Highway Committee, as
Councilman Penny indicated. We also attended the seminar we had here on the
digester, waste digester. We had a very good audience and it was a very good
presentation, color and slides, and a lot of interesting questions and answers. It
sounds like a concept that we will definitely explore for Southold Town. We had
a Landfill Committee meeting. We've made some changes at the Landfill. Ray Jacobs
has assumed direct supervision of the Landfill. We had a Police Committee meeting and
one of the things that came out of that is that we're going to change the colors of the
police cars in town, so long as it is correctly reported--it's not baby blue or light
blue, but it will be a blue in color, at the request of our Chief of Police. And we
also discussed whether or not additional police officers are necessary. We'll probably
have a further meeting to finalize that. A whole bunch of meetings going on at the
Town Hall lately. That's all ! can remember at the present time.
SUPERVISOR MURPHY: Thank you, Jay. Paul?
COUNCILMAN STOUTENBURGH: Thank you. I attended those meetings also~ except
for the Police Committee meeting, and the two I'd like to report on is this one which
people might be interested in, an area in Orient a lot of people are concerned about
and is our highest shellfish area, Hallocks Bay. The Orient Association asked us to
look into seeing if we could set this area aside as a critical environmental area. We
had a meeting on this of the CAC, the Baymen, the Town Trustees and many of our
Town Board members were there also, and we had a good discussion. Thereare two
alternatives to follow. One is the one which the Association asked us to follow, and
the other would be to see if we could get the local land owners to work out a plan
of their own. We agreed to follow both of these and we have are now waiting to find
a boundary map. and Jay Bredemeyer and I are working on that map and in the inter~
Mr. Tuthill, along with Mr. Latham and Mr. T~rry are going to get together with th~ !
landowners and .come up with a meeting. So it s something new. We t~ad the DEC da, ~
here and they gave us some guidance and hopefully this will take effect:. The other
which would probably be interesting to the public, would be the Waterways Committee,
which has again involved the Town Trustees, Henry Smith and Jay Bredemeyer and some
of our Town Board members. Frank Kujawski was there also for his input from last
year, being a Trustee. And we set up priorities for dredging in our town. This
priority list will be sent to the Public Works in Yaphank. They're the people who do
the dredging and I'd like to read through the list for the record. We have priority
#1, #2 and #3. #1 being the highest priority. East Creek is #1, Corey Creek #1,
Little Creek #1, Wickhams Creek #I, New Suffolk Boat Ramp #1, and Deep Hole Creek.
Deep Hole Creek is one which we're having a little trouble with for the simple reason
that it doesn't quite meet the standards that the County has put forth for maintenance
dredging. We hope to meet with Legislator Blass and hopefully change that, but this
is a real problem for us and we're hoping to find a solution to getting Deep Hole
dredged this year. Priority #2 would be Budds Pond and some of you might know it
as Mill Creek. This is where the fishing stations are. Gull Pond is a #2, Cedar Beach
is a #2, and Goldsmiths Inlet is a ~2. A #3 priority would be Halls Creek and that is
the end of our list and we had no action, in other words of areas that didn't meet it
would be Downs Creek, Jockey Creek, James Creek and Goose Creek, and that's my
report.
SUPERVISOR MURPHY: Thank you, Paul. Jean?
COUNCILWOMAN COCHRAN: Yes, on the 22nd we had a Housing Advisory meeting,
and the results of some of the committee's work, as far as guidelines, was reviewed
by this Board this morning in the work session. Also on the 23rd the Wacje and
Policy Committee had a short meeting to review the present policy file, of which I
believe we have three policies in the Town. Also I had the pleasure to attend the
dedication of the parking area in Mattituck, dedicated to Ray Dean. I'd like to
thank the Mattituck Chamber of Commerce for a lovely luncheon which was provided
us after the dedication. We've also been busy as Town Board members. On the
25th I flew to Fishers Island for a Master Plan informational meeting, and we've had
two more on the mainland, Mattituck and Orient. As Jay mentioned, in between this
we had a session on compostin~t, the digester. Also Councilman Penny reported on
the Highway meeting, which I attended on the 31st. I attended a meeting last night
which ! would like to report to you on more fully, and it was--there were twelve
community persons attending, and the purpose for the meeting was to begin'discussing
or to put into place a Southold Town Hospice Services. This is a service to both the
patient and the family for the terminally ill and it's usua.l.l¥ done within the last six
months of life. This group of people have been very interested in starting a hospice
in Southold Town. They did ask if they could come in and do a presentation to the
Town Board and ! have put them on the agenda and scheduled them for the Work
Session on the 25th at 10:30. Alice Albertson and Linda Graham will be doing a
presentation because they are in need of start-up funds. Vee McKeighan, who does
a great many of our health services from the Nutrition Center, was in attendance,
and she will also be here for their presentation. It's a service that does fill a very
strong need and it does fit to interlock some of the services that the Town now
supports. Thank you, Frank.
SUPERVISOR MURPHY: Thank you, Jean. Ray?
JUSTICE EDWARDS: A couple of things, Frank. Number one, the research/photograph
vessel The Sea Level, was out taking pictures of the barge--the sunken oil barge off
of Fishers Island, and they spent about a week, week and a half' on the scene. The
only time they could dive with a diving bell out there to take pictures was on the
slack tide, which only happens four times a day, and they were out there and they
did get pictures of the barge. They left the scene last Friday. They did find some
cracks in the bow section which is the air compartment of the barge, not the cargo
compartment, and they're supposed to have the Coast Guard and the DEP is supposed
to have some reports out the end of this week. Secondly, the Fishers Island Ferry
District is getting some appraisals of some property in New London that the Town of
Southold owns, and it's about six or eight acres, including raparian rights, that's
worth quite a bit of money right down there on the shoreline of the City of New
London, and the City of New London is trying to do some swapping for the waterfront
property, and it's about 800 feet, I believe, of waterfront that the Town of Southold,
through the Ferry District, owns. And also on Saturday, the 25th of January, I was
very glad to see some of my fellow Councilpeople and the Planning Board fly over in
the horrendous weather we had that Saturday, for our hamlet meeting of Fishers Island
regarding the Master Plan, and also a special commendation to Dave Spohn who flew
over there on his own iust to be there at the meeting to offer any assistance or helping
the people get back to Long Island if they had to. So it's appreciated by all of the
300 or so residents on Fishers Island. Thank you, Frank.
SUPERVISOR MURPHY: Thank you, Ray. As you could see the Town Board has
been quite busy and one of the things that is probably most rewarding is that we
are winding down, hopefully, on the Master Plan and we will have a plan up for a
public hearing very shortly.
II. PUBLIC NOTICES.
SUPERVISOR MURPHY: Moving on to the second item on the agenda, the Public
Notices.
1. Corps of Engineers, application of John Xikis to construct a groin_ and fill
at Long Island Sound. Written comments by February 17th.
2. Corps of Engineers, application of Greenport Yacht and Shipbuilding Co. to
construct a bulkhead and deck and backfill bulkhead. Written comments by February
24th.
3. Corps of Engineers, application of Henry Smith to dredge with 10 years
maintenance and upland disposal, Town Creek. Written comments by February 24th.
4(a). Suffolk County Legislature desiqnation of the official County newspaper~,.
4(b). Suffolk County Legislature setting meeting dates for 1986,.
5. New York State Department of Environmental Conservation, notice of the
revision of the state-wide regulations which implement the State Environmental Quality
Review Act (SEQR). Comments by April 15, 1986.

application of George Newman & lrvin~ NeWman to subdivide a 19.2 acre parcel into
four residential lots. Written comments by February 21st.

are in the Town Clerk's Office if you want any more information.
III. COMMUNICATIONS.

Bolger as a member of the Board of Assessment Review, effective February 24, 1986
for a five year term to expire on February 24, 1991.

RESOLVED that the Town Board of the Town of S0uthold hereby amends their
Resolution No. 15, adopted on January 3, 1986, with respect to the salary o£
Susan Steinmetz-Fossett, Recreation Director, who was hired from a Suffolk County
Civil Service List, and is not in an exempt or provisional appointed position, and
hereby authorizes a $500.00 Step I salary increment for Mrs. Fossett, effective
retroactively to December 1, 1985.

Muir as Beach Manaqer for the 1986 season and sets his salary at $3,531.00.

SUPERVISOR MURPHY: All right, I might comment. This does cost the Town quite
a bit of money. We feel it's very worthwhile. Some of these people are going ~n
to take courses that qualify them to stay in their iobs, as the Assessors and the
Town Justices. They have some very good programs. We were holding off to see
just what the agenda was, but we haven't had it yet, but normally they have a very
good agenda and programs that are very valuable to Town Board members and to
members of the local government and we feel it's a very worthwhile expenditure,
and a good expense for the Town. One that will be repaid many times over. Any
other questions?
COUNCILWOMAN COCHRAN: Frank, the only thing I would llke is that the people
that are attending be required to submit a report of the workshops attended.
SUPERVISOR MURPHY: We'll send that out to them. We tried it last year and some
responded very well.
COUNCILWOMAN COCHRAN: I'd like to request it again.

of Greenport and the Town of Southold for radio transmissions to be received and
dispatched on behalf of the Village of Greenport by the Town of Southold, for a
term of five years, commencing on January 1, 1986 and ending on December 31,
1990, at the following annual sums to be paid on or about the 15th day of March
of each year during the term of this agreement: 1986 - $11,670.00; 1987 - $13,340.00;
1988- $15,010.00; 1989- $16,680.00; 1190- $18,350.00.

stars representing the golden years of senior citizens of al 50 states, and
WHEREAS, said ~l~g originated in Suffolk County, provides seniors with a ,common
symbol and identity,
NOW, THEREFORE, BE IT RESOLVED that said flag concept is hereby adopted by
the Town of Southold as a symbol for its senior citizens.

thanks and appreciation to Franklin Bear whose term of office has expired as the
Southold Town Representative as a Trustee on the Board of the Suffolk County Dep~-
ment of Parks, Recreation and Conservation, after serving faithfully for the hast
five years; giving unselfishly of his time, energy and expertise in the performance ~ ..-~
of his duties as a direct, liaison between the Town and County government in matters
relating to park acquisitions, development and use policies.
SUPERVISOR MURPHY: I might comment on this. Frank is very sick and he asked
not to be extended. He was appointed five years ago by Bill Pell and just for the
record, he probably had the best attendance of anybody on the Board of Commissioners,
and he was the one responsible for getting the Commissioners to attend meetings again
and to do the job that this was set up. It's a very important post. It set policies
in county parks and it's very important and Frank was very instrumental in bringing
back a revision of these people doing the job that they were appointed to do.
COUNCILMAN STOUTENBURGH: By the way, their meetings are down in Sayville
and this young man of 80 travels there at the darndest hours of the night you ever
saw. So I take my hat off to him.

individuals to attend the West Coast Workshop, Recycling Sludge, Solid Waste,
and Wastewater, on March 5, 6, 7, 1986 at the Holiday Inn Union Square, San
Francisco, California, and the actual cost for travel, registration fee of $195.00,
meals and lodging shall be a legal charge against the Town of Southold.
SUPERVISOR MURPHY: ! might comment on this. This is probably our area of
most concern in the Town is the Landfill. This conference has many courses and
programs that we are directly looking into, as well as on the West Coast there's
various cities that I know of where they are doing very unique and different
programs to reduce the volume of waste that has to be buried, and it's one I feel
is very important that we go and follow through on our efforts so far.

of the uses for which he proposes to use the premises in question, and
WHEREAS, this Board finds that the applicant proposes to construct an office in an
existing dwelling at 7655 Main Road, Mattituck, and
WHEREAS, this Board deems such use consistent with the uses in a General Business

WHEREAS, Gary Flanner Olsen, Esq., on behalf of Edmunc~ and Joan Pressle~,
has requested that this Board waive the provisions of Local Law No. 14 - 1985
with respect to the decision of the Town Board on October 8, 1985, and
WHEREAS, Gary Flanner Olsen, Esq. and Edmund and Joan Pressler appea~ed
before this Board and explained the nature of the uses for which the premises
are to be used, now, therefore, be it
RESOLVED that the Town Board hereby waives the provisions of Local Law No.
14 - 1985 ~o allow the applicant to submit an application to the Southold Town
Board of Appeals with respect to the use of said premises located on the north
side of Route 25, Southold, subject, however, to the applicant obtaining any and
all permits and approvals required by the Town and other governmental agencies
having jurisdiction thereof.

WHEREAS, John C. Tsunis, Esq., on behalf of "280 North Road", has requested
that this Board waive the provisions of Local Law No. 14 - 1985 with respect to
their application presently pending before the Southold Town Planning Board, and
WHEREAS, John C. Tsunis, Esq. appeared before this Board and explained the
nature of the uses for which he proposes to use the premises in question, and
WHEREAS, this Board finds that the applicant proposes to utilize the premises to
conform with the uses in a Residential' Office (RO) Distric~ as proposed by Raymond
Parish, Pine & Weiner, Inc.'s Master Plan Update Zoning Code revisions,
NOW, THEREFORE, BE IT RESOLVED that the applicant be and they hereby are
.granted a waiver of the provisions of Local Law No. 14 - 198~ to the extent of
permitting such uses on said premises as set forth in their application presently

WHEREAS, Katherine Farr has requested that this Board waive the provisions ot
Local Law No. 14 - 1985 with respect to her application to be submitted to the
Southold Town Planning Board, and
WHEREAS, Katherine Farr and her husband appeared before this Board and explained
the nature of the uses for which they propose to use the premises in question, and
WHEREAS, this Board finds that the applicant, has constructed a building for marina
and brokerage office use at her property at 1100 Manhanset Avenue, Greenport, and
WHEREAS, this Board deems such use consistent with the uses in a Marine Recreation
District as proposed by Raymond, Parish, Pine & Weiner Inc.'s Master Plan Update
Zoning Code revisions,
NOW, THEREFORE, BE IT RESOLVED that the applicant be and she hereby is granted

this Board and explained the nature of the uses for which the premises are to be
uses, now, therefore, be it
RESOLVED that the Town Board hereby waives the provisions of Local Law No. 14 -
1985 to allow the applicant to submit an application to the Southold Town Board of

FRANK CARLIN, Laurel: i'm glad there's not many people here tonight because
what I have to say isn't too pleasant and this subject is animals, which is one I'm
very sensitive in, because I had one for 16 years and ! lost it two years ago.
She had a brain tumor and outside of my wife i ;;'c~,;~;-have gave up anything I

had for that animal if we could have saved her, but it was impossible. There's
several ways how ] can phase in to what I want to say tonight, but I'll just get
on with it and you can go home. It's hard for me to believe that nobody on this
Board cared about these animals. I want to tell you why. You know we needed
these buildings over four years already and really what was done? Mrs. Cochran,
I believe you mentioned in the media something like, well, let's don't more or less
blame Rinky or Dinky, or Whatever you call him.
COUNCILWOMAN COCHRAN: I believe his name is Mr. Dean.
MR. CARLIN: Well, you call him Rinky. I call him Mr. Dean.

COUNCILWOMAN COCHRAN: That's where it starts and this is where the buck sro
MR. CARLIN: Right. And in a practical way you're correct, but I believe the Board
had good intentions in October to see winter was coming on and I believe that the
intentions were right in what they did trying to get this building put up before winter.
Here we go. Unfortunately the man you put in charge was a mistake. Now I see now
that I could see that right away. How can you have a project two to three hundred
feet away from the Supervisor,s office and not know what's going on. And this has
been proved. The footing was put in wrong. The materials laying all over. It wasn't
an oversight. It wasn't oversighted or managed. Pure neglect. Taxpayers money or
whatever. These poor animals. They're put here like we are created they're created.
Birds are created. That's nature. And they rely on us to look after them. And what
do we do? We don't care. Ray Jacobs said in the media that given good weather he'll
have the outside of the building completed and the concrete work done in a week, and
I believe him, because right now I think we've got a good Supervisor here. He might
come close to another Harold Price, because I'll be honest with you, a Democrat or
Republican, doesn't matter to me. I call him up--whenever I call up Ray to do some-
thing he'll do it for me. And you know something, the same pattern is being set up
there in the building in Laurel Park. I can see it coming. The hole has been dug
almost two months. The only thing is up there is the contractor's sign advertising
his business. Now don't nobody on this Town Board tell me that you can't handle
concrete in the wintertime. I don't buy it. There's ready-mix trucks roll by my house
every day. There's chemicals they can put in. There's anti-freeze they can put in.
I believe there's aluminum shim they can put in when it freezes the box won't expar~.
to a point where they'll crack. ! don't buy that that you can't handle concrete in
the wintertime. This was pure neglect and the man who's responsible should
for it. In my job I handle a 28 million dollar airplane with two lives involved. If
I don't get an airplane to fly, whatever happens I'm responsible for it. I have to
answer for it and I feel the same way in this. Whoever was responsible, put in
charge to see that that job was done, is responsible for it. There's no way out.
What else can I say? Mr. Penny, it's unfortunate that you and Ray in October looked
at the civic building, which is a good project. It's an important project. It should
be there. Nothing against the building. You had an interest in looking at that
building. Is the roof leaking? And 'that was fine. It's just unfortunate that you
just couldn't walk acorss the road and look at this project here that was going the
way it was going and have a little interest in it. It's unfortunate that that was so
interested in that building in October, but' nobody even cared to see how it was going.
COUNCILMAN PENNY: Might I remind you, Mr. Carlin, I was directed by the Town
Board. I was not a member of the Town Board at that time.
MR. CARLIN:' I'm not saying you was.
COUNCILMAN PENNY: Well, I had nothing to do with the Town Board back in
October. I was running for office.
MR. CARLIN: But you still was with Ray Dean when he inspected the building and
you looked the building over.
COUNCILMAN PENNY: I don't see how that applies...
MR. CARLIN: You were in it.
COUNCILMAN PENNY: I don't see how that applies to the Dog Pound.
MR. CARLIN Okay. Ray Dean then should have walked over there.
COUNCILMAN PENNY: Well, what Ray Dean does and what I do, I mean, I would
kindly ask you just not to pursue this any further. I started on this Town Board
January 1st. I might remind you of that.
MR. CARLIN: You had been there and you has worked with Ray Dean and you
said, we're going to look into it, we're going to see about this.
COUNCILMAN PENNY; I was requeSted~by;the SUpervisor and the Town Board to
look at the Peconic Youth Center, which i . I was at no time asked or instructed
or advised at any time to investigate this site at the Dog Pound.
MR. CARLIN: I didn't say you was asked. I just said...l'm not asking you to do
anything, but I see something out here..involvement...the people or whatever it
is. You know it's very fortunate to have people that are interested in animals and
I take my hat off to these people, men and women, who belong to the North Fork
Animal Welfare League. It's good to see that we have people that are interested in
animals in this Town, and I believe there's a lot of people that are interested in
animals, but give them a chance. The building we have there now...let's face it..
for four years and then we decide in October or December let's rush it through,
which again I know the Town Board, their intentions were right and the meanings
were there trying to get this thing through before the wintertime is over. We know
we're not going to make it now, but if this was done like other things we want to
do, it would have been done. Like raises, increase in benefits. That's done, but
something for these poor animals we have to go through this. Now, Mr. Penny, 1
have faith that you're going to do the job. I read an article in the paper and I
know you're sincere and you looked into it and ! Know you're going to do the job,
but I don't feel it should take to this time next year, because I want in the back
of my mind say that l'm wrong when I say nobody cares. I want to be able to
come back here before this ~time next year and say that I was wrong and you all
care because the job is done. I don't want to have to come back here next year
and say..this time and say I was wrong. You know you watch the Highway Depart-
ments, not in Southold alone, but in Riverhead or anywhere..,we-call it show and
tell. You ever watched six months before election? Ever watch it? Trucks all
over the Town, signs being put in, sidewalks being put in, in the village or front
of the supermarket where the people can see it. Parking spots being painted. What
happens after election? It is like an hour after the Superbowl. The stadium is
empty. But I think it's a disgrace that we can't give these animals..they have to
suffer through this winter and probably some won't survive because it indicates
nobody cares. If you cared the building would have been up before now. And
one more thing, Mr. Penny. We are not building a Shoreham atomic plant here,
we're building a building that's about 40 to 50 foot long, blocks. You know? You
need an architect. We need all this, fine. You know? Oh, why don't I ask you.
Where was the material purchased on this project?
COUNCILMAN PENNY: To be very specific about this. The material that was
purchased, was purchased by an outside contractor at that time. It did not go
directly through the Town, and I believe the material was supplied by Southold
Lumber, although I'm not absolutely sure, but I'm sure if you're as interested as
you seem to be and not bent on trying to destroy something in public which we
are trying to build up, I'm sure that you can check with the Town Clerk and she
will verify when the bills come through.
MR. CARLIN: I'm not trying to destroy anything in public. I'm just trying to get
this thing moving and get it done.
COUNCILMAN PENNY: I strongly suggest that you join the Animal Welfare League
and help us in designing this building. You can do a lot more working behind the
scenes than standing out here in public picking it apart.
MR. CARLIN: I'm not picking it apart, I'm picking the facts apart that are true.
It's nothing I'm creating here. It's there, l'm not dreaming things up. They're
there and if you're man accept them. They're there. They're facts. They're there.
Even if they didn't have rules anybody...even a highway man or supervisor would
know the Town ordinance is 36 inches footing. You should know that. If you see
it's not being done, stop it before it's even done. It wasn't even watched, it wasn't.

COUNCILMAN PENNY: Who are you referring to now?
MR. CARLIN: The man who was in'charge of this project.
COUNCILMAN PENNY: Well, who was in charge of it?
MR. CARLIN: Ray Dean.
COUNCILMAN PENNY: Well, I spoke to the Supervisor regarding this entire
circumstance and he told me that everything was proceeding perfectly well and
that's why I called the special meeting, so I don't think that you should be throwing
the blame around because you're going to find that the blame is spread a little further
than you think.
MR. CARLIN: Well, if everything proceeded so well, how come this happened?
How come we're on this condition? It's no use. That's all I have to say.
SUPERVISOR MURPHY: Is there anyone else that would like to address the~Town
Board ?
DIANE BERGMANN: I'm just going to be very short, but I missed the last Town
Board meeting ! noticed it's been asked that we do have a town airport meeting.
I was just wondering if anything has been done on it and if so when?
SUPERVISOR MURPHY: Yes, Diane, I heard on Friday, after many calls to .VIr.
Kosz!owski, that they are satisfied with the plan and that we can go ahead and
make arrangements. [ had planned to do it on Monday, to talk to our consultant
down in Florida. I had a personal friend we had a funeral for. I wasn't here
all day on Monday, so I was not able to do it. It will be done tomorrow and we'll
have the meeting arrangements set up very shortly.
MRS. BERGMANN: Thank you.
