Mr. Williams: The fo%lowing action was taken by the Board of Trustees during their regular meeting held on September 25, 1986 regarding your request for a waiver for work on property located on Truman's Path, Orient. WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area and WHEREAS, the Board has considered all of the documentation submitted concerning this request and WHEREAS, the Board made the following findings of fact: 1. By this request appellant requests permission to excavate and build a concrete block perimeter foundation for existing dwelling located at 1820 Truman's Path, East Marion and to construct new dormers with windows. 2. Property is bulkheaded and all work is to be done behind same. Accordingly on motion made by Trustee Smith seconded by Trustee Larsen it was RESOLVED to APPROVE THE WAIVER of the Wetland Ordinance for John C. Williams as requested with the following provisions: t. Care should be taken so as to preclude the entry of any construction material into the wetland/water area. Very truly yours, Henry ~. Ye 11971 This letter, and the accompanying applications and attach- me,ts, are to request a waiver of you~ ~egulatory Ju~le~ic- tion over oertain repairs on a l~-story resi~entiA1 cottage at 1820 Truman' s Path, East Marion, N. Ye 11939. M~ wife and I are o~aers of the cottage. We also are offi- cers of $ouad Rehabilitation Contractors, I~c., formed to raise ~ey for its purchase because it was ua-mortgageable, beLug ~-heated a~d un-insulate~ when we bought it. We, and m~ father, are the ealy stockholders of the corporati~. The corporate name was chose~ to facilitate relationships with suppliers ef comstruction/renovation materials. The house, when purchased last March, ~as suDported by about 30 brick p~.~lars, resting om-grade a~d in various states of decay a~d skew. The interior floors of the house ha~ departed from the horizontal by as much as 10 degrees. It is that dif- ficulty which the me~ fou~datio~ w~1~1 remedy, and I h~pe you will agree that it comes un,er the category of estructural re- pa[r," rather tha~ a~ditio~, alteration or new c~structioa. The ~esiga for the foundation (Attachmemt A) was prepared by the Gree~port architectural firm of Fatrweather*Br~, and George Fisher of Penny Lu~ber Ce. subsequently re-worked the plaa (Attachment B) to provide ~re detail, followi~g the sug- gestion of the Tows Building Department. I spent several months seeking contractors to Jack ~p the house a~d undertake the excavatio~. I fouad both, but they were met ava~_lable u~til after Labor Day. Meanwhile, mY inquiries a building permit left ~e with the impression that the review woul~ coacentrate om ~ew construction (the two views in Attachmeat C) rather tha~ the foundation, and a mo~- ification of the f~a~k perch (also sho~a on Attachment C). (The modified perch wtJ_l have the same dime~sione as the old; the mo~ification is replace~eat of the presser gle~s-and-scree~ It was not u~til August 29, ~hem I submitted the application for a per~it to the Building Departmemt, that I learned of the Trustees' Jurisdiction. By that time, to have requested a delay from the house-Jacki~g contractor (Frank Zaleski of .Matt~tuck) would have beem to force a re-scheduling into late fall--and, from a practical standpoint, probably until spring. The Board of Toga Trustees The house was raised by two feet o~ September 2, amd the ex- cavating co~tractor (Nolam Crenshaw cf Gre~port) ~ bee~ ~ke~ to ~e~ the st~ ~ ~ork ~t~ yo~ ~ecisi~. ~- ~h~e~ the ho~ is s~t ~er~ to f~ sto~. With regard to your principal concern, the environmental pact of the foundation work= I believe there will be none. The property is protected by bulkheads which & structural en- gineer, Lawrence Tuthlll, has informally assured me are sound. The proposed excavatio~ will not impinge on the slope leading to the bulkhead, a~d the excavated material will be re- moved, restoring the property to its earlier state. The a~d windows, for which final working Arawimgs are being pre- pared, w~ll. have no effect e~apt to improve the v~ew am~ hea~- room of the upstairs bedrooms. The house is b&img re-wired throughout by Paul Bur~m and, after the dormers are constructed, JED Plumbing will be installing an upstairs bathroom. Both of these Jobs are covered by sep- arate permits; neither will have environmental consequences. I plan to fully insulate the house amd re-shingle it. These activities w~l be covered by the Building Permit applica- tic~, amd will have ~o eavirc~mental impact. For your further ~-~ormati~a, I enclose a copy of the survey map (Attachment D) done by Re~erick Van Tull at the time of the house purchase.
