'SOUTHOLD TOWN BOARD
JANUARY 7, 1986
WORK SESSION
Present: Supervisor Francis'J. Murphy, Justice Raymond W.' Edwards,
Councilman Paul Stoutenburgh, Councilman James A. Schondebare (11:25 AM) Council-
woman Jean W. Cochran, Councilman George L. Penny IV, Town Clerk Judith T. Terry,
Town Attorney Robert W. Tasker (10:15 AM).
9:00 A.M.- The Board audited outstanding vouchers, and then reviewed the duties
and responsibilities of the Town Board Committees appointed by the Supervisor at
the January 3rd Organizational Meeting.
10:00 A.M. - Police Chief H. Daniel Winters met with the Board to discuss the pending
contract to provide police radio service to the Village of Greenport. He was joined
by Village Trustee David Kapell and Village Police Chief Robert Walden. The chief
factor discussed was the recent agreement with Shelter Island for this service, which
increased from $10,000 to $15,000 for a five year period. Trustee Kapell suggested
the same percentage of increase as that of the East-West Fire Protection Districl~
agreement, a service the Village provides to the Town. It was decided the Board
would further discuss this during Executive Session later in the day and contact Mr.
Kapell with the Town's proposal. Further discussion with Chief Winters included the
proposed purchase of two outboard r~otors for the Privateer police boat, the police
boat itself, and the possibility of a boat for the MattitUck Creek Bay Constable during
the summer season.
10:30 A.M. - For Discussion items: (1) Proposal to consider "Breezey Shores" as a
cluster concept. The Board agreed to recommend consideration to the Planning Board
as Resolution No. 26, but reconsidered just prior to the 7:30 regular meeting and held
this for reconsideration on January 21st. (2) Whether to advertise for resumes for
full and part-time Building Inspectors (see Resolution No. 23). (3) Letter from Irving
L. Price Jr., Esq. on behalf of his 'client John W. Stewart, with respect to a tax
arrears notice on a right-of-way. Town Attorney Tasker to respond and discuss
this problem with the Assessors. (4) Letter from the Orient Association requesting
that Hallocks Bay be declared a critical environmental area. Due to far-reachin~1
implications in making such a declaration, the Board will attempt a meeting with'the
Orient Association, Trustees and a representative of the DEC at the January 21st
Work Session to discuss this in depth. (5~ Lis~ of concerns of the combined Chambers
of Commerce - discussed at 11:35 A.M. wil~h Chamber representative Bill Behr and
President Bernard Dempsey. (6) Request of the Fishers Island Ferry District to
increase the compensation of two employees. This would be in violation of the CSEA
Contract which covers these employees and the Ferry Disf~rict will be so advised,
(7) Councilman Penny outlined the needed repairs to the Senior/Youth Center c~i~ing.
Resolution No. 24 was added to the regular meeting agenda authorizing the Town Clerk
to advertise for bids once the specifications are prepared. (8) Discussed proposed
Hamlet informational meetings with respect to the Update Master Plan, Zoning Map and
Zoning Code Revisions. The last week and January (2 meetings) and first week in
February (2 meetings) was agreed upon. Meetings to be held on Fishers Island, at
Oysterponds School, Orient, Southold Town Hall, CutchOgue Kniqhts of Columbus Hall,
and Mattituck High School - dates to be coordinated by the Sup~rvis0r's Off]ce, Town
Clerk to give public notice.
11:35 A.M. -Greenport-Southold Chamber of Commerce President Bernard Dempse¥
and Chamber Executive Director William Behr met with the Board to discuss the
concerns of the combined Chambers of Commerce: (1) Need for additional moteJ/hotel
zoning to assure a healthy economic base for tourism. (2) Allowance for Guest Houses
in the proposed Zoning Code. (3) Require an Economic Impact Statement for zoning
changes. (4) Method for hiring consultants and renewing their contracts - need to
allow more opportunity to local firms. Mr. Behr also discussed concerns of the
Greenport-Southold Chamber Board of Directors: (1) Opposition to charges to persons-
who are not hooked up to a system in a water district. (2) A member of a town
committee should not only be a resident of Southold Town, but should derive their
livelihood from the township.
12:35 P.M. - Recess for lunch.
2:10 P.M. - Work Session reconvenecl and the Board reviewed the regular meeting
agenda resolutions.
EXECUTIVE SESSION
3:05 P.M. - The Board discussed personnel and salaries with Executive Administrator
Victor Lessard and Assessor Chairman Frederick Gordon, as well as proposed inter-
departmentment transfers of staff. Further discussion was held by the Board members
with respect to the proposed negotiations for the police radio agreement ~vith the
Village of greenport.

A Regular Meeting of the Southold Town Board was held on Tuesday, January
7, 1986 at the Southold Town Hall, Main Road, Southold, New York, Supervisor

SUPERVISOR MURPHY: It'd like to begin with a resolution approving the audit of
the bills of January 7th, 1986.
Moved by Justice Edwards, seconded by Councilman Stoutenburgh, it was
RESOLVED that the following audited bills be and hereby ere approved for payment:
General Fund Whole Town 1985. Accounts Payable bills in'the amount of $8,397.43;
General Fund Whole Town 1986 bills in'the amount of $2,753.89; General Fund Part
Town 1985 Accounts Payable bills in'the amount of $9,273.65; General Fund Part
1986 bills in the amount of $2,675.88.; Highway Department bills in'the amount of
$11,915.25; Fishers Island Ferry Dis~ric~ bills in the amount of $11,242.11.

27th, 1985 meeting and January 3rd, 1986, meeting.

RESOLVED that the minutes of the Regular Southold Town Board Meetincj held on
December 27, 1985, and Orqanizational Southold Town Board Meeting held on January
3, 1986, be and hereby are, approved.

SUPERVISOR MURPHY: Jean?
COUNCILWOMAN COCHRAN: Yes, I attended the Housinq Advisory meeting on
January 2nd, and they are busy working on the development of guidelines for
affordable housing. Their next meeting is scheduled for January 8th at 5:00 P.M..
Also, the Recreation Committ'ee met on January 3rd and inventory lists were reviewed.
We had some discussion as far as the grant that was submitted to the New York State
Division for Youth. The amount submitted was $21,100.00. We also had discussion
on state funding for seniors, our swim program for the summer, and our lifeguard
program, and a full report will be given to the Town Board for their input and for
information at our next Town Board meeting. Also I was pleased to accept an
invitation from the Cast Substance Abuse Committee to serve as ~ member of that
Committee, which I have accepted to serve, and I believe all Town Board members
received an invitation to attend their InterAgency meeting on January 28th at 4:00 P.M.
and I would like to encourage those Town Board members that are available to attend,
because as you all are aware substance abuse affects the entire community. Thank you.

COUNCILMAN STOUTENBURGH: I attended the Recreation meeting also with Jean
and I think she covered it 'well. That's all.

have a Parks and Beaches meeting tomorrow night, I believe, 7:30?

COUNCILMAN PENNY: Yes, ! attended the Housinq Advisory Committee with Jean,
and we've started to make some excellent progress and we shall hopefully continue
to do so starting tomorrow night. And i attended the Economic Advisory Committee
meeting and they're still sorting out priorities and setting direction and I think this
,s going to be an excellent committee. That's it.
SUPERVISOR MURPHY: Thank you, George. I have nothing further to report,
except that there was quite a bit of activity finalizing the year's work and starting
on the new items.
II. PUBLIC NOTICES.
SUPERVISOR MURPHY: Next we'll move on to item II on the agenda, Public Notices.
There is one that some people might be very concerned with.
1. Notice of Complete Application, New York State Department of Environmental
Consekvation, by Frank R. Zaleski, Deep Hole Drive, Mattituck, Tital Wetlands Applica-
tion, and it's to subdivide a parcel into three (3) lots, each of 18,800+ square feet.
All lots contain one or more existing buildings. Project site on ethe east side of D~
Hole Drive, 355+ linear feet south of New Suffolk Avenue, Mattituck. Lead;agency i i

later than January 24th, 1986.
III. COMMUNICATIONS.
SUPERVISOR MURPHY: Moving on to item number III, Communicatons.
1. From the Retired Senior Volunteer Proqram thanking the Town Board very
much for the space that we found for them to continue their program, which is very
important in the Town, after we had our problems with their permanent office in the
Senior/Youth Center. We appreciate what they're doing and they appreciated our
help.
2. Dredging request [Laughing Water Property Owners Association, Inc.) which
will be turned over to the property committee to be looked into.
SUPERVISOR MURPHY: There is a public hearing scheduled at 8:00 o'clock tonight
and we'll wait and move on to item V on Resoiutions.
V. RESOLUTIONS.

the Council on Veteran's Affairs for the Town of Southold for the term January t,
1986 through December 31, 1986; he to serve in said position without compensation,
AND BE IT FURTHER RESOLVED that the Town Board hereby appoints Bernard A.
Heaney, Catholic War Veterans, St. A~]nes Post No. 730, Greenport, a member of
the Council on Veteran's Affairs for the Town of Southoid for the term January 1,
1986 through December 31, 1986; he to serve in said~ position without compensation.

on December 17, 1985, with respect to the public ' hearing on the "East-West
Greenport Fire Protection District, Town of Southold, New York", by adding:
Contract for a term of five years, commencing on January 1, 1986.:
1986 - $ 70,000.00
1987 - $ 80,000.00
1988 - $ 90,000.00
1989 - $100,000.00
1990 - $110,000.00

Resolution No. 18, adopted on December 27, 1985, declaring that an emerqency
exists in the need to immediately repair the H90E payloader transmission for th~
Southold Town Department of Public Works, to increase the authorized repair to
a cost not to exceed $20,300.00. (12/27/85 resolution stated $13,000.00.)

RESOLVED that the Town Board of the Town of Southold hereby authorizes the
following transfers within the Highway Department Whole Town 1985 Budget:

Into: DA5130.2 Machinery - Equipment $14,568.82

RESOLVED that the Town Board of the Town of Southold hereby authorizes the
followincj, encumbrance from the Highway Department Whole Town 1985 Budget:
DA 5130.2 Machinery - Equipment - in the amount of $26,563.82
for the partial payment on the new Street Lighting Truck which
has been ordered in 1985, but delivery will be in 1986.

SUPERVISOR MURPHY: Number 8 is to authorize the execute of an agreement.
Moved by Councilman Stoutenburgh, seconded by Councilwoman Cochran, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs Supervisor Francis J. Murphy to execute an agreement between Szepatowski
Associates, inc. and the Town, at a total cost not to exceed $33,000.00, for the
period January 1, 1986 through December 31, 1986; said Szepatowski Associates, Inc.
to perform and furnish to the Town Board and Planning Board professional planning
services consisting of continuing on-call services to be performed in the Town by
Szepatowski Associates, Inc. personnel and supervised by David Emilita, Principal
Planner; said work program to provide the Town Board and Planning Board with
professional direction and advice on a long range planning policy as well as immediate
issues.

SUPERVISOR MURPHY: Number 9 is'authorizatioh to participate in the CSEA
Benefit Fund.

RESOLVED that the Town Board of the Town of Southold hereby authorizes all
Elected OfficialS, and all Appointed Officials making $7,500.00 and above per annum,
to participate in the CSEA Benefit 'Fund; the Town to pay $3~0.00 per offici'al and
the officials to contribute the balance per annum.

RESOLVED that the Town Board of the Town of Southold hereby sets 8:00 P.M.,
Tuesday, February 4, 1986, Southold Town Hall, Main Road, Southold, New York,
as time and place for a public hearing on the Draft Environmental Impact Statement
submitted by Southport Development with reference to their petition for a change
of zone from "C" Light Industrial District to "M-l" Genera[ Multiple Residence District
on certain property located on the south side. of Main (State) Road, on the westerly~
side of Sage Boulevard, Greenport, New York, consisl~ing of 12.461 acres, l

Resolution No. 22,~ adopted on December 27, 1985, accepting the bid of Herbe,~
:~otors, Inc., West Islip:, New York, for supplying the Town with one (1) 198R
five passenger Voyager mini van, at a total cost of $10,616.00, all in accordance
with the bid specifications.

RESOLVED that the Town Board of the Town of Southold hereby rejects ail bids
received on December 27, 1985, for supplyin9 the Town with one (1) 1986 five
passenger mini van.

directs the Town Clerk to advertise for bids for the purchase of one (1) 1986
seven passenger mini van, all in accordance with the bid specifications.
SUPERVISOR MURPHY: I just want to comment for anyone who's wondering why

JUSTICE EDWARDS: Just a ~omment on this, Frank, for the public.' The Harbor-
master on Fishers Island does a lot of work in laying out the moorings over there,
of which there are over 75 moorings set this past winter. These are permanent
moorings, and has brought in to the Whole Town a package of over $4,200.00 for
these 75 plus moorings and Mr. John Clavin is the one that manages the mooring
area and designates the areas for the moorings, and besides being Harbormaster
he's also a Bay Constable. Thank you, Frank.
