The Town Board, Town Clerk, Town Attorney and Superintendent of Highways
met at 1:00 P.M. to review the Organizational Meeting Agenda.
ORGANIZATION MEETING
3:00 P.M.
The Organizational Meeting of the Southold Town Board was held on Friday,
January 3, 1986, at the Southold Town Hall, Main Road, Southold, New York.
Supervisor Murphy opened the meeting at 3:00 P.M. with the Pledge of Allegiance
to the Flag.

SUPERVISOR MURPHY: I'd like to welcome you to the first meeting of the New
Year. This is the Organizational Meeting and the only order of business' are
resolutions and appointments.
The first one is my appointment of a Deputy Supervisor.
1. Supervisor Francis J. Murphy hereby appointed Frank A. Kujawski, Jr. as Deputy
(a) .Supervisor for the Town of Southold for the term January 1, 1986 through December
31, 1986.
1. Moved by Supervisor Murphy, seconded by Councilman Schondebare,
(b) WHEREAS, it is required by Section 27, Subdivision 1 of the Town Law that the Town
Board fix, from time to time, the salaries of all officers and employees of the Town,
whether elected or appointed, and determine when the same shall be payable, now,
therefore, be it
RESOLVED that the annual salary of Frank A. Kujawski, Jr., Deputy Supervisor of
the Town of Southold, be and hereby is set at $1,925.00 per a¢qnum, effective Jan
uary 1, 1986, and the same shall be paid in regular semi-monthly payments.
SUPERVISOR MURPHY: I might add this includes the 7%.

SUPERVISOR MURPHY: Next is a resolution to designate depositories of the Town
funds.

Moved by Supervisor Murphy, seconded by Councilman Schondebare,
WHEREAS, Section 64 of the Town Law requires the Town Board to designate, by
resolution, banks in the State in whcih the Supervisor or any other officers of the
Town shall deposit all moneys coming into their hands by virtue of their office, and
WHEREAS, the Town Board may require any bank, so designated, to deposit with
such Board bonds or certificates of the United States, of the State of New York,
or any county, town, city, village or school district of the State of New York, as
security for such funds so deposited, but such bond or certificate shall be subject
to the approval of the Town Board and shall be deposited in such place and held
under such conditions as the Town Board may determine, now, therefore, be it
RESOLVED that the following banks are hereby designated as depositories and th~
the following amounts of securities are hereby required, to wit:

SUPERVISOR MURPHY: Next is to allow the use of a signature stamp.

RESOLVED that a facsimile signature be and hereby is authorized to pay all checks,
drafts and other instruments for payment of money drawn upon the accounts of th~
Town of Southold by Francis J. Murphy, Supervisor, Town of Southold, ~n amounts
not to exceed $2,500.00, on the following banks:
The Bank of New York
Chemical Bank
Suffolk County National Bank
The North Fork Bank & Trust Co.
Hartford National Bank & Trust Co.

SUPERVISOR MURPHY: Numl~er 4(a) is to designate the Traveler-Watchman as the
official paper.
COUNCILMAN STOUTENBURC;H: Is there any discussion on that? (No response.)
4. Moved by Councilwoman Cochran, seconded by Justice Edwards, it was
(a) RESOLVED that The Long Island Traveler-Watchman, Southold, New York, a newspaper
regularly published in the Town of Southold, which has been entered as a second class
mail matter, be and the same is hereby designated, effective February t, 1986, as the
official newspaper of the Town of $outhold for the publication of all notices, resolutions,
ordinances and other matter required to be published.

SUPERVISOR MURPHY: Number 4(b) is to designate an additional newspaper, The
Suffolk Times, and why not?

SUPERVISOR MURPHY: Number 5 is to establish petty cash funds.

RESOLVED that pursuant to Section 64(1-a) of the Town Law, a petty cash fund is
hereby established in the following amounts for the following officers, to wit:

JANUARY 3, 1986 - ORGANIZATIONAL MEETING
SUPERVISOR MURPHY: Number 6 is to authorize the Highway Superintendent to
purchase small equipment up to $3,000.00 for any one item during the 1986 year.
Moved by Justice Edwards, seconded by Councilman Schondebare, it was
RESOLVED that pursuant to Section 14211-A) of the Highway Law, the Southold
Town Superintendent of Highways be and hereby is authorized to purchase equip-
ment, tools, snow plows and other implements and devices without prior approval
of the Town Board in the amount not to exceed $3,000.00 for any one item during
the period from January 1, 1986 through December 31, 1986:.

man Schondebare, Councilman Stoutenburgh, Justice Edwards, Supervisor Murphy.
This resolution was declared duly ADOPTED.
SUPERVISOR MURPHY: Number 7 is to designate the delegate to the Association
of Towns.
Moved by Councilman Stoutenburgh, seconded by Councilman Schondebare, it was
RESOLVED that Supervisor Francis J. Murphy be and he hereby is designated to
represent the Town of Southold at the annual meetinq of the Association of Towns
of the State of New York, to be held in New York City on February 16, 17, 18,
19, 1986, and to cast the vote of the aforesaid Town of Southold pursuant to
Section 6 of Article Iil of the Constitution and By-Laws of said Association of
Towns, and be it further
RESOLVED that Frank A. Kujawski, Jr., Deputy Supervisor, be and he hereby
is designated to act as an alternate to cast the vote of the Town of Southold at
the annual meeting of the Association of Towns in the absence of Supervisor
Francis J. Murphy.

SUPERVISOR MURPHY: Number 8 is to authorize the allowance of $450.00 to attend
the Association of Towns meetings.
8. Moved by Councilman Stoutenburgh, seconded by Justice Edwards, it was
RESOLVED that those officers and employees of the Town of Southold attendinq the
annual meeting of the Association of Towns of the State of New York be and hereby?r-Ti
are allowed $450.00 per officer and employee for the actual and necessary expe6ses
to travel meals, and lodging incurred while attending said meeting .....

man Schondebare, Councilman Stoutenburgh, Justice Edwards, Supervisor Murphy.
This resolution was declared duly ADOPTED.
SUPERVISOR MURPHY: Number 9 is to set 20¢ a mile limit on the reimbursement
for a personal car.
9. Moved by Justice Edwards, seconded by Councilwoman Cochran, it was
RESOLVED that any Town official, elected or appointed, who is required to use
his own automobile in the performance of his duty, be compensated for travel
expenses necessarily and actually incurred, in carrying out the duties of his office,
at a rate not to exceed twenty ($.20) cents per mile.

SUPERVISOR MURPHY: Number 10 is to appoint Elaine Kaldor to do the audit of
the books at a total fee of $7,000.00.
10. Moved by Councilman Stoutenburgh, seconded by Councilman Schondebare,
WHEREAS, Section 123 of the Town Law provides that town officials and employees
who receive and disburse moneys of the Town shall on or before January 20th
account to the Town Board for all moneys received and disbursed by them in the
previous fiscal year, unless the Town shall engage the services of a certified publicly.
accountant or public accountant prior to January 20th, and
WHEREAS, the Town Board deems it necessary to engage a public accountant to
prepare the aforesaid annual account for all Town officers and employees, now,
therefore, be it
RESOLVED that the Town Board of the Town of Southold engage the services of
Elaine F. Kaldor, C.P.A., P.C. to make the annual audit of the books and records
of officers and employees of the Town of Southold for the fiscal year 1985 at a total
fee of $7,000.00. (Town Audit--S4,500.00; Grants Audits--S1,900.00; Compliance
Audit of FRS Funds--S600.00.)

SUPERVISOR MURPHY: Number 11 is to authorize the Supervisor to invest monies.

WHEREAS, Section 11 of the General Municipal Law provices that the Town Board
may authorize the Supervisor, the chief fiscal officer of the Town, to invest moneys
not required for immediate expenditure, now, therefore, be it
RESOLVED that the Supervisor is hereby authorized to deposit or invest moneys not
required for immediate expenditure in special time deposit accounts, or certificates of
deposit issued by a bank or trust company located and authorized to do business in
this state, provided, however, that such time deposit accounts or certificates of deposit
shall be payable within such time as the proceeds shall be needed to meet expenditures
for which such moneys were obtained, and provided further that such time deposit
accounts or certificates of deposit be secured in the manner provided in Section 11 of
the General Municipal Law.

WHEREAS, it is required by Section 27, Subdivision I of the Town Law that the Town
Board fix, from time to time, the salaries of all officers and employees of the Town,
whether elected or appointed, and determine when the same shall be payable and that
the salaries of the members of the Town Board, the elected Town Clerk and an elected
Superintendent of Highways shall not be fixed in an amount in excess of the amounts
respectively specified in the notice of hearing in the preliminary budged published
pursuant to Section 108 of the Town Law, now, therefore, be it

SUPERVISOR MURPHY: Number 13 is to appoint Judy Terry as the Registrar of
Vital Statistics and set a salary of $3,000.00.

RESOLVED that in accordance with Section 4121, Article 41 of the Public Health
Law, the Town Board of the Town of Southold hereby appoints Judith T. Terry
Registrar of Vital Statistics for the Town of Southold for the term beginning
Janaury I, 1986 and ending December 31, 1989, and be it further
RESOLVED that the salary of Judith T. Terry, Registrar of Vital Statistics for
the Town of Southold be set at $3,000.00 per annum and the same shall be paid
in regular semi-monthly payments and be it further
RESOLVED that the Town Clerk be and she hereby is instructed to file such
certificates with the proper parties as are required by Section 30, Subdivision 3
of the Town Law.

14. Town Clerk Appointment
(a) Town Clerk Judith T. Terry hereby appointed Elizabeth Ann Neville as Deputy Town
Clerk for the term beginning January 1, 1986 and ending December 31, 1989.

Registrar of Vital Statistics Judith T. Terry hereby appointed Elizabeth Ann Neville
as Deputy Registrar of Vital Statistics for the term beginning January 1, 1986 and

SUPERVISOR MURPHY: The next appointment is the Deputy Highway Superintendent.
TOWN CLERK TERRY: Superintendent of Jacobs had to leave a few minutes ago, but
he asked that 1 make this part of the record:

(c) Superintendent of Highways Raymond L. Jacobs hereby appointed Barney Ovisinak
as Deputy Superintendent of Highways for the term beginning January 1, 1986 and
ending December 31, 1987.
SUPERVISOR MURPHY: Number 15 is to set salaries of the following appointed
officials.

RESOLVED that the Town Board of the Town of Southold hereby sets the following
per annum salaries for the followin9 appointed employees, effective January 1, 1986

COUNCILMAN STOUTENBURGH: Should there be something in the resolution that
there will be a review of this at a certain time--that we agreed to? That this will
be reviewed in three months, these salaries, after April 15th.
COUNCILMAN SCHONDEBARE: I think the regulations are coming out--what the end
of March? The 30th or 31st, so between that and April 15th we should be in a better
position to review these salaries.
COUNCILMAN STOUTENBURGH: All right, just so long as there is something on th~
record to let the pedple know that we haven't stopped it at 7%, all right?

COUNCILMAN SCHONDEBARE: Right, and we Spent a considerable part of our Wor~
Session today going through all of this. Hopefully we'll have some legal---

SUPERVISOR MURPHY: Number 16 is to appoint Ray Jacobs as Commissioner of
Public Works and set his salary at $3,000.00 a year.

RESOLVED that the Town Board of the Town of Southold hereby appoints Raymond L.
Jacobs Commissioner of Public Works for the Town of Southold for the term beginning
January 1, 1986 and ending December 31, 1987, and be it further
RESOLVED that the salary of Raymond L. Jacobs, Commissioner of Public Works for
the Town of Southold, be set at $3,000.00 per annum and the same shall be paid in
regular semi-monthly payments, and be it further
RESOLVED that the Town Clerk be and she hereby is instructed to file such certificates
with the proper parties as are required by Section 30, Subdivision 3 of the Town Law.

SUPERVISOR MURPHY: Number 17 is to appoint Fred Gordon as the Chairman of
the Board of Assessors for this year.

WHEREAS, Section 22B of the Town Law allows the Town Board of any town having
more than one assessor to establish the office of Chairman of the Town Assessors,
who, in addition to his regular duties, shall perform such services in connection
with assessment and taxation of property for state, county and town purposes as
the Board shall direct, now, therefore, be it
RESOLVED that Assessor Frederick E. Gordon be and he hereby is designated to
hold the office of Chairman of the Board of Assessors until the first day of January
next succeeding such designation, at the pleasure of the Town Board, all in accord-
ance with Section 22B of the Town Law, and be it further

RESOLVED that the compensation for such appointment be fixed at $1,000.00 per
annum, payable in regular semi-monthly payments.

SUPERVISOR MURPHY: Number 18 is to appoint Bennie Orlowski as Chairman of the
Southold Town Planning Board and set his salary of $2,000.00 a year.

RESOLVED that pursuant to Section 272 of the Town Law, Bennett Orlowski, Jr. is
hereby designated Chairman of the Southold Town Planninq Board for the calendar
year 1986, and be it further
RESOLVED that the Chairman of the Southold Town Planning Board be paid a salary
of $2,000.00 per annum, effective as of January 1, 1986, and the same shah be paid
in regular semi-monthly payments.
18.-Vote of the Town Board: Ayes: Councilman Penny, Councilwoman Cochran, Council-
man Schondebare, Councilman Stoutenburgh, Justice Edwards, Supervisor Murphy.
This resolution was declared duly ADOPTED.
SUPERVISOR MURPHY: Number 19 is to appoint Jerry Goehringer as Chairman of
the Southold Town Board of Appeals and set his salary at $2,000.00 a year.
19. Moved by Councilman Stoutenburgh, seconded by Justice Edwards, it was
RESOLVED that pursuant to Section 267(1) of the Town Law, Gerard P. Goehringer
is hereby designated Chairman of the Southold Town Board of Appeals for the calendar
year 1986, and be it further
RESOLVED that the Chairman of the Southold Town Board of Appeals be paid a salary
of $2,000.00 per annum, effective as of January 1, 1986, and the same shall be paid
in regular semi-monthly payments.
19.-Vote of the Town Board: Ayes: Councilman Penny, Councilwoman Cochran, Council-
man Schondebare, Councilman Stoutenburgh, Justice Edwards, Supervisor Murphy.

SUPERVISOR MURPHY: Numbe'r 20 is to set additional salaries of the members of
the Board of Appeals and the Planning Board. $4,975.00 for each member.

WHEREASr it is required by Section 27, Subdivision 1 of the Town Law that the
Town Board fix, from time to time, the salaries of all officers and employees of the
Town, whether elected or appointed, and determine when the same shall be payable,
now, therefore, be it
RESOLVED that the annual salaries of the members of the Zonin9 Board of Appeals
and the Planning Board of the Town of Southold be and they hereby are fixed as
follows for the calendar year 1986:

offices in regular semi-monthly payments, and the appointed officers or employees
shall hold such appointed offices or positions at the pleasure of the Town Board
unless otherwise provided for by law, and it is further
RESOLVED that the Town Clerk be instructed to file such certificates with the
proper parties as is required by Section 30, Subdivision 3 of the Town Law.

SUPERVISOR MURPHY: Number 32 is the Highway Department collected for the
repair and improvement of highways, the sum of $1,137,900.00 may be expended
for general repairs on 184.19 miles of town highways. I offer that.

RESOLVED that pursuant to the provisions of Section 284 of the Highway Law, the
Town Board of the Town of Southold hereby agrees that moneys levied and collected
for the repair and improvement of highways, and received from the state for the
repair and improvement of highways, shall be expended as follows: 1. General
Repairs: The sum of $1,137,900.00 may be expended for 9eneral repairs upon
184.19 miles of town highways, including sluices, culverts and bridges having a
span of less than five feet and boardwalks or the renewals thereof. No moneys
set aside ~for such improvements shall be expended, nor shall any work be under-
taken on such improvements, until the County Superintendent approves the plans,
specifications and estimates for such construction. This agreement shall take effect
when it is approved by the County Superintendent of Highways.

happy. One he asked us to do regarding the Town Attorney's reimbursement for
office expenses.

WHEREAS, the Town Attorney hs submitted estimates of expenditures pursuant to
Section 104 of the Town Law for the reimbursement of a prtion of the secretarial
and offices expenses to be incurred by him in the performance of his duties as
Town Attorney for the 1986 fiscal year, and
WHEREAS, such estimates have been included in the 1986 Town budget adopted by
the Town Board, and
WHEREAS, the New York State Comptroller has recommended Shat the reimbursement
of said expenses should be authorized by a resolution of this board.
NOW, THEREFORE, IT IS RESOLVED AS FOLLOWS:
1. That this board does hereby authorize the reimbursement of a portion of
the expenses incurred by the Town Attorney for secretarial and office expenses
in the performance of his duties as Town Attorney for the 1986 fiscal year of the
Town in an amount not to exceed the sum of $20,000.00, upon the submission of
quarter-annual vouchers therefor in proper form.
2. That the amount of reimbursement for such expenses shall be supported
by the submission of documentation therefor to be filed with the Town Clerk as
soon after the end of the 1986 fiscal year as such documentation is available.

JOHN J. NICKLES: I'd tike to wish you all a happy New Year. When I came in
during the Work Session I thought you were discussing the Conservation Advisory
Council meeting fee and I thought you agreed to $25.00, but you passed a resolution
for $30.007
SUPERVISOR MURPHY: It was changed to $30.00. Anyone else like to address the
Town Board? Yes, sir?
CHARLES PETERSON: Could I just ask you when there's going to be any further
discussion on that airport thing? I haven't been following it lately and I was wonderinc
what's happening with it.
SUPERVISOR MURPHY: There will be, in the papers--hopefully we're hoping for
somewhere around the 15th or the 20th, in that neighborhood. As soon as we hear
from the State DOT. They had a sl~ake-up in their command, and also from the FAA
when they could come out at the same. We will have the ioint meeting, and it will
be in the papers. It will be notified as a public hearing.
MR. PETERSON: Thank you. Could I ask you one more question?
SUPERVISOR MURPHY: Sure.
MR. PETERSON: Why is the condition at the Town Dump allowed to get as bad as
it is? I know this is something off the top of your head, but the papers and the
stuff blowing across the road and it's hardly ever cleaned up. I would think that
a commercial person would probably be fined or something for allowing stuff like
that to happen. It's really a mess.
SUPERVISOR MURPHY: I agree. If a private business operated it they would be
fined. The Police Chief right in front of you would probably be down there yelling
at them. We hope to reactivate, on a regular basis, meetinqs with the Town Board
Landfill Committee and the Highway Superintendent and Rod~ney Douglass who's in
charge of the Landfill, to make the necessary improvements. I mic~ht add just that
it is 'very tough--windy weather, the amount of material going in ~here. We can do
a much better job and we fully expect to. We are looking into various processes
that will eliminate, hopefully, all paper blowing in the Landfill. Okay?
MR. PETERSON: Thank you.
SUPERVISOR MURPHY: Anyone else? (No response.) We are under a mandate
on this Landfill also. We just got another letter from the DEC today and we're
waiting to hear for approval on a new type of system so that we could go forward
