The validity of this permit is or may be subiect to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying' for or obtaining such approval. In the 'event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Trustees upon receipt by the Trustees. of written notice from such other governmental or municil3al authorities of its refusal or disapproval..- The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-, fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this. permit are being conducted, do, by theracceptance of this permit, give consent tothe Town, and its officers and employees to enter upon the premises where such operations are being conducted To make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. Williams New York State Dept. of Environmental Conservation 50 Wolf Road Albany, New York 12233 Re: Suffolk County Agricultural District No. i, Town of Southold Dear Commissioner Williams: The following resolution was adopted by the Board of Town Trustees during their regular meeting held on June 25, 1987 regarding the above matter. ~EREAS, the Southold Town Trustees believe that a portion of the land (parcel No. 30, Agricultural District No. 1) is owned by the people of the Town of S6uthold in the name of the Southold Town Trustees, and WHEREAS, it is further concurrent that the adjacent upland owner, John Wickham, has requested a Quit Claim Deed for land NOW THEREFORE~BE IT RESOLVED that the Southold Town Trustees request the Commissioner of the New York State Department of Environmental Conservation, request on behalf of the Town Trustees, a restructuring of the boundary line for parcel No. 30 in Agricultural District No. 1 (copies of said map attached), and WHEREAS, the Town Trustees feel that the Agricultural District Policy may be inconsistant with current Wetland Protection Policies. WHEREAS, John Wickham applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated December 24, 1986, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing wa~ held by the Town Trustees with respect to said application on January 29, 1987 and concluded on February 26, 1987 at which time all interested -- persons w~re given an opportunity to be heard, and WHEREAS, the Board members have personallY viewed and are familiar with the premises in question and the~surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as.proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that John Wickham BE AND HEREBY IS GRAMTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Rebuild a dike using only material washed away from the dike, adding a wing wall to headwall and to armor in front of same. Application also amended to armor the dike in two 'additional locations as per the map submitted and subject to the recommendations of the U. S. Department of Agriculture Soil Conservation Service. Box 728 Southold, New York 11971 November 30, 1987 CERTIFIED MAIL RETURN RECEIPT REQUESTED 'Mr. John Wickham Route 25 Cutchogue, New York 11935 Dear Mr. Wickham: Complaints received, by this office, and recent inspections, and review of land clearing operations being-,--.undertaken by you .on property located on the West side of New Suffolk Avenue north of Grathwohl Road raise serious questions as to your intentions to continue clearing into wetlands. We believe to be in our jurisdiction under Chapter 97 of the Code of Southold Town. We assume your clearing of previously tilled Agricultural lands have ceased, so no reply is necessary at this time. However, further clearing may require: a Trustee/Wetland permit, and you are invited to contact this office to diScuss your plans. Clearing of new lands not previously under tillage should be put under a cooperative legal review so as not to endanger your rights nor our jurisdiction. This permit will expire on February 26, 1988 if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work° Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insurance policies insuring against any liability which may arise in the performance of the operations pursuant to such permit in such amount as shall be fixed by the Trustees, which said policies shall name the Town as a name insured. Please take further notice that this declaration should not be considered a determination made for any other department or agency which may also have an application pending for the same or similar project. The Council recommended a denial of the request. They felt an inspection of the site would be necessary. Should you!~haue any[~questions, please do not hesitate to contact me. No. 476 - Paul Ferdenzi - Recommend disapproval. Dredging will destroy the shellfish producing bed and do irreversible damage to the bottom. As an alternative measure the CAC suggests applicant either apply for a mooring elsewhere in the creek or seek docking at Boatman's Harbor. No. 477- Larry and Sandy Stahl - Approve with stipulations. Use haybales to avoid runoff; put in more plantings as used elsewhere on property; have the Bay Constable do frequent inspections., during construction. No. 478 Elizabeth Yaro - Recommend approval with stipulations. Strict adherance to the DEC regulations; use down spouts; drywells, etc. Have the Bay Constable check ofter during Construction to be sure guidelines are adhered to.
