Information, for record purposes, is necessary to show the layout of the building including the number of residence rooms, kitchen, entrance and exit areas, and other areas, of the former adult home. A second plan would be needed if there are any changes proposed in the former adult home layout. Please also label the use (if proposed) of the third story, and show a general parking plan. Price, Jr. As requested by you, we called Bill Price after receiving his first letter of inquiry and asked him to clarify what is being proposed in the Oysterponds Adult Home, for which a use-type variance was issued by the ZBA many years ago (copy attached). Mr. Price indicated that Ed Forrester had referred him to you, based on conversations with Ed directly that he had. Bill also said that it was Ed Forrester's opinion that a letter could be requested from the ZBA to confirm that the use of the property as a "tourist home" is similar to "an adult home" and therefore would fall under the prior variance for an "adult home." As I read your decision, it was never determined that the establishment of an adult home as opposed to the tourist home or inn was a use of a "more restrictive nature" [Section 100-241 (c)]. It is my understanding that a letter from you will suffice under these circumstances to re- establish the "tourist home" or inn on the subject property.
