Duryee Appellant Pike Street & Love Lane Mattituck, New York 11952 at a meeting of the Zoning Board of Appeals on Thursday, -Sept. 22, 1966 the appeal was considered and the action indicated below was taken on your ( ) Request for variance due tolackof access to property (]Q Request for a special 'exception under the Zoning Ordinance ( ) Request for a variance to the Zoning Ordinance 1. SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article .................Section ................ Subsection ................ paragraph .............1., of the Zoning Ordinance, and the decision of the Building Inspector ( -) be reversed ( ) be confirmed because - - - 8: 10 P.M. (E.D.S.T. ) , Upon application of W.V. Duryee Est. , Pike Street and Love Lane, Mattituck, New York, for a special exception in accordance with the Zoning Ordinance, Article IV, Sectlon 408, Subsection (b) , for permission to retain wall signs. Location of property: south east corner of Pike Street and Love Lane, Mattituck, New York, bounded north by Pike Street, east by Lutz and Long, south by W.H. Drum Est. , west by Love Lane. 2. VARIANCE. By resolution of the Board it was determinedthat (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the districtbecause SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. i 41 It � C ZONING BOARD OF APPEALS FORM ZB4 'SIA `�'� 1 Barbara C. Dittmann, Se re After investigation and inspection the Board finds that the appellant request permission to retain a wall sign on the east wall of his building. The building is located on a cor- ner of two streets, Pike Street and Love Lane. The Board finds thatthe sign on the east wall of the building faces an empty lot. The Board points out that the appellant does not have the necessary area to erect a ground sign and the side wall sign re- quested is in lieu of a ground sign. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. Therefore, it was RESOLVED ,that W.V. Duryee Est. , Pike Street and Love Lane, Mattituck;i New York, be granted permission to retain a wall sign on the east wall of the building located on the souoh east corner of Pike Street and Love Lane, Mattituck New York, subject to the following conditions: 1. This sign shall be granted for one (1) year only, renewable annually upon written application to the Board of Appeals. 2. This sign shall be subject to all subsequent changes in the Southold Town Building Zone Ordinance as it applies to signs. 3. The appellant agrees that no ground sign of any type will be erected at this premises.
