(E.D.S.T. ) , Upon application of Mattituck Presbyterian Church, Main Road,Mattitucke New York, for a special exception in accordance with the Zoning Ordinance, Article III, Section 300, Sub- section 10, and Article IV, Section '408, Subsection A, for permission to retain two on premises ground signs; and for permission to retain an off premises sign on the property 'of Alrod Realty Corp. , on the south side of the Main Road, Laurel, New York, bounded north by Main Road, east by E.J. Murphy, south by Old Road-Nawrocki, west by Shell Oil Company_ LL 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because - - - -�— SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all.properties alike inthe immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE IVERSE 1 and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. Dittmann, Secretary After investigation and inspection the Board finds that the appellant request permission to retain two on premises signs and one jointly owned off premises sign. One sign, on the Church premises is an identification ground sign. The„ other sign is an illuminated bulletin . or schedule sign. oth signs are setback the required distance from all property 'fines. It is the opinion of the Board that both of these signs are necessary to the Church. In regards to the off premises directional sign, jointly owned by three churches in Mattituck, it is the opinion of the Board that this sign is in the interest of the travelling public. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. Therefore, it was RESOLVED that Mattituck Presbyterian 'Church, Main Road, Mattituck, New York, be granted permission to retain two on premises ground signs and one off premises sign on the property of Alrod Realty Corp. This permission is granted subject to the following conditions: 1. All signs- shall be granted for one (1) year only, renewable annually upon wtitten application to the Board of Appeals. 2. All signs shall be subject to all subsequent changes in the Southold Town Zoning Ordinance as it applies to signs. 3. All signs shall be located at least five (5) feet from any property line. 4. All signs shall be located at least three (3) feet above ground level.
