Appellant Hummel Avenue Southold, New York at a meeting of the Zoning Board of Appeals on the appeal was considered and the action indicated below was taken on your ( ) Request for variance due to lack of access to property - (X) Request for a special exception under the Zoning Ordinance ( ) Request for a variance to the Zoning Ordinance 1. SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article ................Section ................ Inspector ( ) be reversed ( ) be confirmed because 8:30 PM (E.D.S.T.) , Upon application of Nassau Renewal Parts, Inc. , Hummel Avenue, Southold, New, York, for a special exception in accordance with the Zoning Ordinance, Article IV, Section 408, Subsection C, for permission to retain a roof sign. Location of property: south side Hummel Avenue, Southold, New York, bounded north by Hummel Avenue, east by George F. Erath, south by Long Island Railroad, west by Southold Lumber Co. , Inc. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined' that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) 'be confirmed ( ) be reversed. McLean, A ting Secretary After investigation and inspection the Board finds that Nassau Renewal Parts, Inc., Hummel Avenue, Southold, New York, has requested permission to retain a roof sign consisting of three letters on the ridge of the roof. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the ordinance will be observed. It was, therefore, RESOLVED that Nassau Renewal Parts, Inc., Hummel Avenue, Southold, New York, be granted permtission to retain a roof sign as applied for, subject, however, to the following conditions: 1. The sign shall be granted for one (1) year only, renewable annually upon written application to the Board of Appeals. 2. The sign shall be subject to all subsequent changes in the Southold Town Zoning ordinance as it applies to signs. 3 .
