( ) (X) ( ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance is requested for the reason that, to afford ad.iaceni property owners access to the beach and waters of Long Island Sound, a right 6f way has bee~ granted which results in insufficient unrestricted width and road frontage. STRICT APPLICATION OF THE ORDINANCE would produce practical difficultie~ or unneces- sary HARDSHIP' because in spite of the lack of 100 feet imrestricted road frontage, %here is ample area and the width of the lot without the right of way will admit ~ full compliance with the side yard requirements of the ordinance. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because the property is the only land available for the creation of a right of way to affOrd adjacent land'owners access to the beach. 3. The Variance would observe the spirit of the Ordinance and WOUI-D NOT CHANGE THE CHARACTER OF THE DISTRICT because with the right of way, on which no one can build~ there will be no crowding or other condition created which would offend the spirit of the ordinance. Will you please ascertain whether your records indicate this property was held in single and separate ownership at the time of the adoption of the zoning ordinance so as to enable a prospective purchaser to obtain a building permit without the necessity of applying for a variance ?
