2. VARIANCE. By resolution of the Board it was determined that

After investigation and inspection the Board finds that
the applicant request permission to erect a studio for writing
in his front yard area. The Board points out that the
location chosen by the applicant for the studio is the only
feasible location. The property in question slopes down on
all sides and toward the water. The Board has granted
variances in other cases for accessory uses in the front
yard area where the property has waterfrontage. The pro-
posed studio building is to be 16 feet by 20 feet. In
general, the Board is in agreement with the reasoning of
the applicant as set forth in the application to the Board
of Appeals.
The Board finds that strict application of the Ordinance
will produce practical difficulties orunnecessary hardship;
the hardship created is unique and would not be shred by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance does observe
the spirit of the Ordinance and will not change the character
of the district.
THEREFORE IT WAS RESOLVED that A.A. Cooke, Nassau
Point Road, Cutchogue, New York, be granted permission to
erect a studio building in his front yard area on property
located east side of a private road off the south side of
Nassau Point Road, subject, however, to the following
conditions:
1. The proposed building shall be not used for residence
or dwelling purposes, or for a guest house on a temporary basis.
2. The building shall not be located closer than 20
feet to the private right of way.
