SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article .............................. Subsection ......_................._.. paragraph I............................ of the Zoning Ordinance, and the decision of the, Building Inspector ( ) be reversed ( ) be confirmed because 7:45 P.M. (E,S.T. ) , Upon application of Thomas Jurzenia, Silvermere Road, Greenport, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 307, for permission to reduce the sie yard requirement. Location of property: south side Silvermere Road, Greenport, New York, bounded north by Silvermere Road, east by Silver Sands Motel, south by Peconic Bay, west by land of Frohne. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would)(would not) produce practical difficulties or unnec- essary hardship because SEE REVERSE (o) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. sleoddV ao FORM ZB4 3 — ZONING BOARD OF APPEALS —z n e•.•.o ., �.✓I ���C._i4 Cam-. ` � �7'l�� Barbara C. Dittmann, Secretary After^ investigation and inspection the Board finds that the applicant request a reduction in the side yard requirement. The Board finds that the total area of this lot is 24,000 square feet. This lot is a long narrow lot with less than 100 foot frontage. The reduction in the side yard of 15%, from 10 feet to 8� feet, is well within the permitted reduction. The Board points out that this recution could have been obtained from the building inspector if the lot had less than 12,500 square feet, and a variance would not have been required. The Board points out that the adjoinng property of Frohne to the west has been built on two feet from the pxperty line. The applicant's house will be 8h feet from the property line. The Board finds that this use will not change the character of the district as other houses are built close to the property line. This will be a residential use in a residential district. The Board finds that strict application of the Ordinance will produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance does observe the spirit of the Ordinance and will not change the character of the district.
