Mr. Hass' property is bounded on the north by the center line of Old Cove Boulevard and the southerly line of land of Fiedler, formerly Gibbs, on the east by land of Ruch, cn the south by the ordinary high water mark of Arshamorr~ que Pond, and on the west by Beverly Road. The premises are improved with a dwelling and garage situated in the northeast- erly quarter of the premises. The application is to divide this property into three lots and for access to what will become the southeasterly lot. For the record we submit the following descriptions of: A) the present premises as a whole; B) the northerly of the three lots into which the larger parcel would be divided; the present improvements would be on this piece; C) the southwesterly lot; this is directly on Beverly Road and requires no access; D) the soulheasterly lot: requiring access. (this is on a more or less basis of course, because it is on tidal water); the southeasterly lot will contain 9400 sq. ft. on the same more or less basis. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HAI~DSHI~ because at the time of the adoption of the ordinance the premises in question were pa~rt ?f a larger mapped area which had been acquired in several pa~cel~ by Mr; Hass a~d then divided by deed into several lots, in separate ownership. The area had been dredged, built up with fill, .and bulkheaded.. The westerly part on the water was devoted to small lots with summer cottages, the westerly part on the road was earmarked for ~a motel, the center part on the higl~Way was reserved for business. The westerly part Of the premises on the water Mr. Hass reserved for himself. I-Ie now wishes to builtl two dewllings on lots similar in size to many others in the area for his two daughters. This is now feasible because~ of the availability of a public water supply. However, the proposed division leaves the lots on the water with less than 12,500 sq. ft. and the southeasterly lot is not on a road. Because the area is in a business zone and devOted-almost exclusively to dwell- ings used only in the summer, a lot size a bit smaller than the minimum al- lowed is not unreasonable _and xvill hame nO adverse affect on ~.e..~ealth, safer y, welfare, and morals of fl~ people of the Town. .
