( ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinonce is requested for the reason that I have contracted to sell my businezs Droperty (non-conforming use) ~o Frank Sider ~ Martin Sider but to retai~ my residence on a Dlot fronting 70 feet on Legion Avenue ~d having ~ depth ef 150,feet. o~tl~e on other side) Form REASON FOR APPEAL Continued I now have 1. STRICT APPLiCATiON OF THE ORDINANCE woutd produce UNDUE HARDSHIP~m'm~m~ l~t.tl feet on Legion Aven~e. The proposal for me to retai~ 70 feet would almost split this frontage in half a~d woad provide space for the retention of the large scale on the property to Be seldo The retent.i, om of 100 feet By me er the sale ef 100 feet By meWould produce ~n~in.e~ua~.~Yof: divi~ieh, . 2, The hardship created is UNIQUE and is not shared by ail properties alike in the immediate vicinitvofthisorooertyandinthisusedistrictjm~;:~l]~[~:: 0rigi~ally~ the lots on the nertk side of Legion Av~n~e were laid out 60~x--160. ~'~"'~original residence property was such. The lot te the west was also 60 x 160 leaving a right ef way 2¢ feet in width for access to the premises in Back of the lots. The proposal elimin- ates t~J:s small right of way and splits the frontage as above set forth. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT::~BII:E~it~ the exception of the property on the c~rner of Pacific Street s~d Legion Avenue, all the other parcels f~onting on the north side of Legion Avenue are 60 feet in width. Originally, they all had depths of l~0 feet. The only exceptions at the present time are William Newalis, adverting the .premises inquestion, whose property extends to a depth of ~00 feet amd Irving Wells,/whose property no~ ext~nds.inback of two er three ether properties.
