THE SPED.IAL EXCEPTION m aEQ~ESTEDBECAUSE
A. The large "coming attraction ground sign"
1) The coming attraction ground sign is located 15 ft. from Route 25
on the premises of the drive-in theatre and it is the only means for the
theatre to make known to the general public the programs being presented
therein.
2) The R~.~cmiudi'ty of the sign to Route 25 permits visibility to pasing
traffic and in order not to disrupt the safe, orderly flow of traffic,
the sign must be large enough to permit passing motorists to view same
without the temptation of slowing down for a better view.
3) Reduction of the size of the sign would prohibit the theatre from
utilizing enough letters on its sign to properly and adequately spell out
its attractions.
4) The sign cannot be reduced in size, and to replace the existing
sign requires replacement of all components of the existing sign, includ-
ing the letters presently used to spell out the ~tles of features. Such
replacement would be at a cost in excess of $7,000.00.
B. The "Skyway" sign on the back of the screen of the theatre:
!) The remote location of the theatre makes it imperative that its
identifying sign be located high enough to be visible within a reasonable
area. This is vital for the theatre's existence and lowering the sign
would reduce its effectiveness which would seriously impair theatre
operations. Lowering of the sign would be equivalent to not having an
effective sign, and without an effective sign, the theatre cannot operate.

C. The Entrance and Exit Signs:
1) The entrance and exit signs are so placed for the sole purpose
of safely directing traffic in and out of the theatre.
2) The theatre is a night-time operation and it is imperative that

at least the existing size for the safety of the patrons of the theatre.
3) The signs are set at a distance of 20 ft. from the highway and
present no hazard to highway traffic.
4) The signs are not advertising signs but are strictly functional
for safe operation of the theatre.
5) Signs of this nature are required by the New York State Labor
Dept., and have in fact been so approved.
1) All of the above signs were constructed in accordance with all
applicable local and state ordinances and regulations in effect at the
time of construction thereof.
2) To remove or alter any of the aforesaid signs would alter tbe
established image of the premises to the general public which would create
a hardship affecting the actual business at the theatre.
3) All of the above signs are located on the premises of the
theatre and are not remote advertising signs of the billboard variety.
4) The aforesaid signs are of the type normally used in all
drive-in theatres in the United States, are so identified by the
public, and are in conformity with other normal on-location advertising.
5) For all of the above reasons, special exception with respect to,
and permission and authority to continue the use of, the aforesaid signs
is hereby requested.

Upon closer inspection of your sign at the Skyway Theater on
Route 25, Greenport, New York, it is believed by this Board that your
sign overhangs onto the State Highway property. It is ~mposeible for
this Board to grant permission for any sign to encroach on public
land. Therefore it is our suggestion that you ~btain a map from your
surveyor showing the exact location of your sign in regard to the
State highway line.
I~ will not be necessary for you to appear before us again&
You may forward said survey to this office at your earliest possible
convenience.

After investigation md inspection the Board finds that
the applicant request ~ermission to retain a "coming Attractions"
sign which is oversized, and the word "SKYWAY" on the back wall
of the movie screem. It is~he interest of safety and welfare
that the "coming attractions" sign be maintained at its present
size. If the sign was made to conform to theEpresent zoning
regulations, smaller letters would have to be used on the sign,
thus making it more difficult for the passing traffic to see
what attraction is coming to the theater. The Board believes
that such a sign is in the interest of the travelling public
as a place of amusement.
The Board finds that the public convenience and welfare
and ~wk justice will be served and the Legally ~stablished or
permitted use of neighborhood property and ,adjoining use
districts will not be permanently or substantially injured
and the spirit of the Ordinance will be observed.
Therefore, it was RESOLVED that Greenport,Playhouse, Inc.,
163 Merrick Road, Merrick, New York, be granted permission to
retain an on premises ground sign and an on premises watl~ign
on property located on thenOrth side Main Road, Greenport, New
York, subject, however to the following conditions:
1. The s/~ns shall be granted for one (1) year only,
renewable annually upon written application to the Board of
Appeals.
2. The signs shall be subject to all subsequent changes in
the Southold Town Zoning Ordinance as it applies to signs.
3. The ground sign shall be erected at least five (5)
feet from any property line.
