Garrett, Bay Avenue, Cutchogue, New York, for a special exception in accordance with the Zoning Ordinance, Article III, Section 300, Subsection 8, for permission to retain a directional sign on the corner of Bay Avenue, and Sterling Road, Cutchogue, New York., bounded north by Pancaldi, east by Bay Avenue, ,south.by_G. Watts, west by Mudd Creek. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. Dittmann, Secretary After investigation and inspection the Board finds that the appellant request permission to retain an off premises directional sign, directing people to his florist business. The Board points out that there are no provisions in the Southold Town Zoning Ordinance for off premises directional signs for agricultural businesses. The Board of Appeals does not have authority to grant the type of sign requested. The Board finds that the public convenience and welfare and justice will not be served and the legally established or permitted use of neighborhood property and adjoining use districts will be permanentlgr substantially injured and the spirit of the Ordinance will e observed. e Therefore, it was RESOLVED that Emory J. Garret; Bay Avenue, Cutchogue, New,Yotk, be denied- permission to retain a-directional sign on the property located on the corner of Bay Avenue and Sterling Road, Cutchogue, New,York.
