(E.D.S.T. ) , Upon application of Rosemary Gagen Front Street, Greenport, New York, for a varianceinaccordance with the Zoning Ordinance, Article III, Section 303, Article X. Section 1000A, for permission to divide property with insufficient area and frontage. Location of property: south side Front Street, Greenport, New York, bounded north by Front Street, east by Ernest F. Richter, south -by E. Singleton Atwell, west by Charles Magoey. 2. VARIANCE. By resolution of the Board it was detdrmined that - (a) Strict application of the Ordinance (would)(would not) produce practical difficulties or unnec- essary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character sof the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) Abe confirmed ( ) be reversed. yl Z G BOARD OF APPEALS FORM Z134 Barbara C. Dittmann, Secretary After investigation and inspection the Board finds that the appellant request permission to divide property with insufficient area and frontage. The Board finds that there are two dwellings on the two lots Which were bought separately, six years apart. The appellant wishes to sell one house and retain the other for her own use. The Board finds that all other lots in this area are 50 foot lots and they all have one family dwellings constructed upon them. There are no other double lots in this block. The Board finds that this variance will not change the char- acter of the district as there are already buildings on each lot. The Board further points out that public water is available to both lots to be created. The Board finds that strict ;application .of the Ordinance will, produce practical ,difficulties or unnecessary hardship; the hardship created _is unique ,and would not be shared by all properties alike in the immediate vicinity of this .property and in the same use district; and the variance does observe the spirit of the ,Ordinance ,and.will not change the character of the district. THEREFORE, IT WAS RESOLVED that Rosemary Gagen, Front Street, Greenport, New York, be granted permission to divide property with insufficient area and frontage on property located on the south side of Front Street, Greenport, New York. Ail ~ots in .the area.are based on fifty foot fromtage~, and are developed with one family dweilings. A denial to separate these two lots as they were purchased back in 194-2 and i9~8 would impose an un necessary hardship as all other lots in the area are on fifty foot frontage. 2. The hardship created is UNIQUE and is not shared by all properties, alike in the. immediate vicinity of this t~roPerty and in this use district because: : there are no other double lots in this block 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT becaus~ This will not change ~ e charicter of the neighborhood as there are already building on each lot~ The area is residential and will remain the same as each of the two dwellings will be used for residential purposes.
