Location of property: east side Main Road, Southold, New York, bounded north by Southold Bayview Corp. , east by Bay View Road, south by V. Volinski-Shell oil Co., west by Main Road. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. McLean, Acting Secretary After investigation and inspection the Board finds that Mrs. Josephine dePaz, 47480 Main Road, Southold, New York, has requested permission to retain two on-premises identification signs with insufficient setback; one on Bay View Road, the other on the Main Road. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining ]. use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. It was, therefore, RESOLVED that Mrs. Josephine dePaz, 47480 Main Road, Southold, New York, be granted permission to retain two on-premises identification signs as applied for, subject, however, to the following conditions: 1. The small sign on Bay View Road is granted in lieu of a sign on the building, but .-must be moved back five feet from the P"perty line. 2. The sign on the Main Road must be moved back one foot inside the property line. 3 . Both signs shall be granted for one (1) year only, re- newable annually upon written application to the Board of Appeals. 4. Both signs shall be subject to all subsequent changes in the Southold Town Zoning Ordinance as it applies to signs. 5. The signs shall be located at least three (3) feet above ground level. As, I am permitted a sign on the building~ I ask that this sign be permitted to remain. Tho, I will have it moved back ~ feet from the road, just as soon as we have an old Cedar, cut dcam, which has died. hoping for a favorable decision on my behalf.
