1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because no residential building could be constructed on the premises,

2. The hardship created is UNIQUE and is not shared by all properties ?lik~ in th_e immediate ~
vicinity of this property and in this use district because the pazCicuZar propercy is now in
~ingle ~and se~pa~rate ow~nership. It was formerly parC of a larger parcel that
had been built up of two separate acquisitions. The owner divided and sold just
as he had acquired but the zoning ordinance intervened. A self-created hardship
resulted because of the fact that prezoning the premises in question had an area
of but 12,000 square feet.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the premises are on a corner -with 50' roads
on the west and south sides, There are no buildings on adjacent properties
closer to the property lines than permitted by She ordinance; ~ fact~ they are a
considerable distance from the lines, The area is largely devoted to seasonal

I stopped by to ask about next Thursday's meeting
with regard to a variance asked by the new owners of the
property in East Marion--corner of Cedar Drive and Stars
Road.
Why in 1966 does anyone sell a lot as a building
lot when the area is not adequate, b~ Town law~ for building?
Why does anyone buy a lot when it does not meet
the requirements?
Why does the Town Board dignify sudh non, sense
with a hearing?
Naturally we'll be here to have our say, but it
does seem to me with the Town considering changing to 20,000 sq.
feet instead of the present 12,500 there wouldn't be any
auestion about refusing permission to build when the law says
~pecifically what size lot is required.
As you know~ my husband and I have property on
Cedar Drive. As it stands now it can be divided into about
five lots. Are we supposed to "obey" the letter of the l~w
when these people are continua31y encouraged to ignore it?

Dear Sir!
In reply to your letter of May 8th! Please be advised that
a single lot anywhere in the Town of Southold must be at least 100 feet
wide and12% feet deep ( 12,500 sq ft in area).
Mr 8tamos lot on the corner of Stars Road & Cedar Ave.~ East
Marion, is an ilegal lot - it is undersize, no one can build on it as
he sold too much land to Mr. Trikoukas.
The lot on the corner of Aquaview Ave. extention and Star!
right of way to the sound beach can be used for a one family house~ and
the lot owned by Couphos on the opposite side of Aqua View Ave. Extention
can be used for a one family house but this lot will have a problem
with the setback requirements.
To the best of my knowledge there are no "double lots" in
this area, unless you go to the farm land on Sedar Ave. A double lot
would have to be at least 200 feet wide on the road and at least
feet or deeper containing at least 25,000 Sq ft of area.

In answer to your letter of April 17th about a lot on
AQua View Ave., extention, Mast Marion, N.Y. bounded by Road on
N/ES Mitchel on E/8S W. 8tars on 8/8 and TrikouMas on W/8S I believe
it is owned by Costas ~tars.
This lot could be used as a single lot, but might need
some variance to fit a house on it. This would have to be determined
when plans were f~ed.
Also there might be a health Dept problem on a permit for
well point and cesspool permit, this will have to be taken up with
the Board of h,~th in Riverhe~d.
