Dear Mr. Haje,
The following action was taken by the Board of Town Trustees
during its regular meeting held on September 25, 1996, regarding
the above matter:
hFHEREAS, Eh-Consultants Inc., on behalf of NORMAN WENK,
applied to the. Southotd Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated Aug. 15, 1996, and,
~dEREAS, said application was referred to the Sou~hotd Town
Conservation Advisory Council for their findings and
recommendations, and
'WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on September 25., 1996, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar withthe premises, in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
h5{EREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town 'Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORM BE IT,
RESOLVED, that the Board of Trustees approves the application of
NORMAN WENK to replace 142' of timber bulkhead within 18"
including return on west side, backfill with 50+/- c.y. of clean
fill, remove and replace a 4' X 12~ stairway seaward of wall, a
4' X i5' platforms and stairs landward of wall and down face of
bank, and remove existing 68' of timber groin and replace with a
low profile structure of same length. Located: 415 South Lane,
East Marion.
BE IT FURTHERRESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are. required and the Trustees are to be notified
upon completion of said project.

The following recommendation was adopted at the meeting of the Southold Town
Conservation Advisory Council on September 23, 1996 :

Moved by Allan Connell, seconded by Bruce Loucka, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
OF EVERYTHING BUT THE GROIN of the Wetland Permit Application of
NORMAN WENK 31-16-2.2 to replace (within 18") 1/;2 I.f. of existing timber
retaining wall including return on west side. Backfill with 50 +/- c.¥. of
clean spoil to be trucked in from upland source. Remove and replace existing
/;' x 12~ stairway seaward of wall; and /;' x 15' platforms and stairs landward
of wa~l and down face of bank. Remove existing 68' timber groin and replace
with a Iow profile structure of same length.

The CAC recommends approval of the project with the exception of the groin.
The Trustees should disapprove the groin because it can cause damage down
gradient of the littoral drift and Iow profile groins are not maintained,
