Mattituck, New York, for a special exceptiOn in accordance with the Zoning Ordinance' Article l-g, Section 408, Subsection (aj, for permission to re%a in pole signs with insufficient setback from the property line. Location of property: south side Main Road, Mattituck,~ New York, bounded north by Main Road, east by Maratooka Road, south by C.H. Wickham and J. Sobrie~ay, west by Sunset Ave. , , ~ 2. VARIANCE. By resolution of the Board it was determined ihat (a) Strict application of 'the Ordinance (w0uld) (would not) produce practical difficnities or unnecessary hardship because SEE RE]~ERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) Tl~e variance (does) (does not) observe the spirit of the Ordinance and (would) (~vould not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. Dittmann, Secretary After investigation and inspection the Board finds that the applicant requests permission to retain a pole sign with insufficient setback from the property line. The Board finds that even if this pole sign was located fife feet from both roads it would still be a traffic hazard. The Board denies permission forthe existing pole sign, and grants permission for the pole sign to be placed the same distance from the Main Road as the gas pumps. The Board finds-that the public convenience and welfare and justice will'not be served and the legally established or permitted use of neighborhood property and adjoining use ~ districts will be permanehtly Or ~ubstantially injured and the spirit of 'the Ordinance ~ill not be observed. '-- Therefore~ ~t was RESOLVED that Tidewater Oil Company, Grand Blvd. & Covert Lane, Westbury, New York, a/c Love~s Service Station, Main Road and Maratooka Road, Mattituck New York, be denied permission to retain a pole sign with insufficient setback as applied~r.
