By resolution of th~ Board it was determined that (a) Strict application of the Ordinance (would) (would not) ~oroduce practical difficulties or unnecessary hardship SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the s~me use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (~vould not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) ~e confirmed ( ) be reversed. ZB4 NING BOA~%D OF APPEALS After investigation and inspection the Board finds that the applicant requests permission to retain a pole sign with insufficient setback from the property line. The Board finds that if the sign was setback any further it would be in the driveway of the station and hazardous to traffic using the facilities of the service station. The Board finds that the public convenience and welfare and justice will be served and the. legall~ established or permitted use of neighborhood property.a~d~adjoining use districts~will not be permanently or substantially -injured and'the spirit of the Ordinance will be observed. The sign shall be located at least three (3) feet from any property line. 2. No part of the sign shall overhang State property. 3. The sign shall be granted for one year, renewal~le annually upon written application to the Board of Appeals. 4. The sign shall be subject to all subsequent changes in the SoutholdTown Building Zone Ordinance as it applies to signs.
