By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared 'by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (docs not) observe the spirit of the Ordinance and (would) (~vould not) change the character of the district because SEE REVERSE and therefore, it was further detemine6 that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Impector ( ) be confirmed ( ) be reversed. Dittmann, ~ecre~ary After investigation and inspection the Board finds that the applicant requests permission to retain an on premises identification sign with insufficient setback on the property line and insufficient height from ground level. The Board finds that the sign i~rotected by a utility pole which is placed in fzont of it. There is no other feasible location for the sign other than its present location. The Board finds that the public.cQn~enience and welfare and justice will be served~and the legally establisSed use or permitted use.of neighborhood property and adjoining use districts will not be~permanentl~ or,substantially injured, and the spirit ofthe Ordinance will be observed. Therefore, it~was RESOLVED that Walter Sle~Jeski, d/b/a Porky's Restaurant, North Road,,Greenport, New,York, be ~ granted permission to retain an on premises ground sign with insufficient setback from the property line and insufficient height from ground levelt as applied for. This permission is granted subject to the following conditions: 1. The sign shall be granted for one year only, renewable annually upon written application to the Board of Appeals. 2. The "Higiu-Tension" utility pole in front of the reatau'rant is set back on my property so that the sign is in reality the required five feet back from the true property line. The sign in it's present location is not a traffic hazard to vehicles using my parking area on the westerly side of the restaurant and is far from the street intersection at So'smd Road & North Road.
